By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties or unnecessary SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the hnmed/ate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. The findings of the Board are that the Board is in agreement with the reasoning of the applicant. The Board finds that the public convenience and welfare and justice will be served and the legally established or per- mitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. THEREFORE IT WAS RESOLVED, Stanley J. Waimey, 1035 Alvahs Lane, Cutchogue, New York, be GRANTED permission to erect side wall sign, Main Road and Pequash Avenue, Cutchogue, New York, as applied for. STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficultiesorunneces- sary HARDSHIP becausea permitted sign would face a residential area because of the location of the building on the lot and the residents already know the location of the office, and because the building is so faced traffic from westward is already passed the front and a sign here is ineffective because the vehicle speed does not permit for easy stopping without causing a traffic hazard. Since my real estate market is generat~ by advertising in the Metropolitan newspapers for retirement and second homes~ most of these customers are not too familiar with the area they would need a few seconds to spot the sign and make the decision to turn in without causing a traffic accident. Traveling at 35 MPH, visibility of 300 feet gives the driver about 7 seconds to make this decision, sa~ely. 2. The hardshipcreatedis UNIQUEand isnotshared by all pr~e~ies alike in the immediate vicinity of this property and in this use district because these~e~ally parallel with the Main Rd., are single occupancies, and have a ground sign. The front of this ~uildihg faces the cOrne~, away from the East bound traffic. Here however, there are three tenants, two of whom already have ground signs and one of these ground signs is directly in fro~ of~y building, se a third sign besides not being permitted, is not feasible of desirable. This application seeks to substitute a change of location for a wall sign from the permitted ~ wall which faces a residential area, to a locatior which faces the flow of traffic. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because it would substitute the sign location from a residential area, which might be considered detrimental, to a location which would be preferred for busines.s purposes.
