VARIANCE. The finding of the Board are that the Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the i~mediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED that Southold Savings Bank, Main Road, Southold, New York, be GRANTED permission to construct accessory off-premises parking lot in excess of 200 feet from main premises, east side of Railroad Avenue (Youngs Avenue), Southold, New York, as applied for. STRICT APPLICATION OF THE ORDINANCE would produce practical difficultiee or unneces- sary HARDSHIP because the Board of Appeals granted your petitioner a variance (Appeal 92398) on March 23, 1978 for permission to purchase the subject property with insufficient lot width for the purpose of creating additional off-street parking. As indicated in the prior appeal dated February 23, 1978 (a copy of which is attached hereto as Exhibit 1), your petitioner is desirous of creating additional parking spaces all in accordance with paragraph 110-112 "Off-Street Parking Areas" of the Zoning Ordinance. However, the one requiroment that your petitioner cannot comply With is that of subparagraph H which requires that "all spaces therein are located within two hundred (200) feet walking distance of such lot". Although the proposed off-premises parking area is within 80 feet of your petitioner's bank premisesj due to the depth of the proposed parking area many of the individual parking spaces will be beyond 200 feet and in some cases will be as far as 570 feet which is the distance of the northeasterly corner of the proposed parking area from the Bank's existing promises, all as shown on the "Map to Accompany Application for Variance to Zoning Law Made for Southold Savings Bank" which is attached hereto as Exhibit 2. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district iamea~ae for the reasons listed in the prior appeal dated February 23, 1978, which is attached hereto as Exhibit 1. 3. ASSOCIATES, INC. and SOUTHOLD SAVINGS BANK REASON FOR APPEAL (continued) 1. continued: are presently enjoyed by the Bank will be disrupted thereby causing inconven- ience to bank customers with the resultant possible interference with the normal traffic flow on Railroad Avenue and Main Road, as well as on-street parking in the immediate vicinity of the Bank. In order to minimize this impact, Southold Savings Bank proposes to provide off-street parking' f~r bank employees and con- tractors during construction. Initially the. Bank had made preliminary arrange- ments to lease the property which is the subject of this petition during the construction period from P.B.M. Associates, Inc. However, due to costs and other factors involved, this is not feasible and therefore petitioner, Southold Savings Bank, opted to purchase this property and construct a permanent off-street parking facility for the use of its employees after the renovation and addition are com- pleted. If the Board grants the petition to this area variance request for lot width, then it is Southold Savings Bank's intention to raze the scales, barn and attached shed which are located on this southerly strip of land as shown on Exhibit 1, and to construct a parkir~3 area in conformance with the requirements of paragraph 110-112 "Off-Street Parking Areas" of the Zoning Ordinance. The proposed parking area is within a short walking distance of the Bank's property and during construction will be available for use by contractors, and bank employees for parkinq purposes, thereby m~nimiz~nq any traffic congestion due to the construction at the Bank's property. Under the existing standards of the Zoning Ordinance, when the renovation and addition are completed, Southold Savings Bank will have adequate off-street parking spaces on its ow~ property for both its employees and customers. However, it is the Bank's position that although meeting existing standards, during peak periods of bank activity, especially during the surm~er months, additional parking facilities should be provided for the con- venience, comfort and safety of the bank's customers. The difficulty with this position is that there just isn't any available land either contiguous to the Southold Savings Bank's property or within a reasonable walking distance to accem- modate the construction of a parking lot; with the exception of the proper~y of petitioner, P.B.M. Associates, Inc. on the easterly side of Railroad Avenue, Southold, New York. It is respectfully submitted to the Board that the granting of this area variance to allow a reduced lot width in the B-1 General Business District will allow the use of this property for an off-street parking facility; is not a sub- stantial deviation from the current Zoning Ordinance and it will not cause an increase in overcrowding or population density, and in fact should produce a posi- tive impact on the use of governmental facilities in relieving traffic congestion; will not prevent the orderly development of legally established uses of neighbor- ing properties in this non-conforming neighborhood; and the difficulties of pro- viding additional parking cannot be avoided by any other method than the granting of this variance since this is the only reasonably available parcel of land in this neighborhood; and the public interest will be served by the granting of this variance.
