Upon application of Scott Ben Corp., Main Road, Southold, New York, for a variance in accordance with the Zoning Ordinance, Article VII, Section 100-71 and Bulk Parking Schedule for permission to construct a front portico on an existing building with insufficient front yard setback and a variance in accordance with the Zoning Ordinance, Article XI, Section 100-112 D for permission to have an access with insufficient width. Location of property: Main Road, Southold, New York, bounded on the north by Colonial Village; east by Ryan; south by Main Road; west by Boyd. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE FORM ) be denied and After investigation and inspection the Board finds that the applicant wishes to construct a portico across the face of a building to be renovated by adding a liquor store and restaurant. The driveway will be located to the east of the building, but will be only 19 feet wide. The colonnade on the front of the building will greatly improve the appearance of the building and add to the character of the Village of Southold, The 6 foot addition of the Colonade reduces the front yard setback by 3 feet and will have no significant effect on the area. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. On motion by Mr. Gillispie, seconded by Mr. Douglass, it was RESOLVED that Scott Ben Corp., Main Road, Southold, New York, be GRANTED permission to construct a front portico on an existing building with insufficient front yard setback and GRANTED permission to have an access with insufficient width. Location of property: Main Road, Southold, New York, bounded on the north by Colonial Village; east by Ryan; south by Main Road; west by Boyd, subject to the following conditions: (1) Site Plan Approval of the Planning Board (2) Suffolk County Planning Commission (3) Applicant will explore all possibilities to work out an arrangement with the Ryans and the Board of Appeals with a view to saving the two maple trees on the easterly side of the Applicant's property. Gillispie: As per your request, the owners, Mr. DeAlbertis and Mr. Courts,had Otto Van Tuyl, Inc. survey the exact location of the hugh maple tree on their property. The tree is 12'6" from the east line of their property and 5'6" from the proposed building line. The tree happens have hugh limbs that project out somewhat horizontally and would have to be cut off on the east to clear for truck heights and on the west to clear the height of the proposed building. to As much as the owners would like to save the tree, it appears that it is not possible, as it would destory the beauty of the tree. The owners to the east might grant an easement for trespass for about 6 feet, but if they did, the limbs still would have to be cut off.
