By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because SEE REVERSE practical difficulties or unnecessary (b) The hardship created (is) (~ not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE FORM ZB4 ) be denied and · A???VED ZONING BOARD OF APPEALS~ After investigation and inspection, the Board finds that the applicants request permission to construct dwelling with insuffi- cient front yard setback, northeast side Sleepy Hollow Lane, Southold, New York. The findings of the Board are that the applicant has a definite hardship by reason of the Tidal Wetlands Act as well as the curve of the road in this area and the unusual shape of the lot. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Carlton T. and Marion G. Latham, 235 Oaklawn Avenue, Southold, New York, be GRANTED permission to construct dwelling with insufficient front yard setback, north- east side Sleepy Hollow Lane, Lot 11, Map of Sleepy Hollow, Southold, New York, as applied for. (Continue on other side) REASON FOR APPEAL Continued ]. STRICT APPLICATION OF THE ORDINANCE would produce proctical difficulties or unneces- sary HARDSHIP because State regulations require 75' minimum from wetlands and with irregularities in rear lot line it is impossible to rn~intain 50' setback for full frontage of house. State has issued permission to situate northeast corner within 70' to coincide with shape of lot. The proposed location of house was se% so as to center it as well as to conform to curve in road and allow for setback from cut in meadow-land. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of ,this property and in this use district because other properties have greater depth and do not have a deep cut-in from meadow-land. State regulation of 75' minimum from meadow-land limits space for building. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE cHARACTER OF THE DISTRICT because the property in question is located on a curve in the road ~and by setting house on an angle follows more in line with other lots in subdivision.
