(D.S.T.) .-Upon application of Long Island Vineyards, Inc., Alvah's Lane, Cutchogue, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 100-30 A (2) (a) (1) for permission to use a building for display and retail use larger than is allowed. Location of property: County Road 27, Cutchogue, New York, bounded on the north by Middle Road; east by R. Simchick; south by Isaacs and Aud; west by Ovisinak. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( that the previous decisions of the Building Inspector ( ) be confirmed ( ) be granted ( ) be reversed. BOARD OF APPEALS be denied and After investigation and inspection, the Board finds that the appli- cant requests permission to use for display and retail sale of agricultural products approximately 1000 feet located in the northerly and westerly portion of a barn which is to be purchased from Wesley Simchick and has a total area of approximately 9,600 square feet. The part of the barn which is not used for display and retail sale use which is licensed under the New York State Farm Winery License No. 8 will be used for wine making equipment and bottling. This property adjoins except for the Long Island Railroad, 66 acres south of the railroad, which the applicant has successfully developed into a wine making business. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. On motion by Mr. Tuthill, seconded by Mr. Bergen, it was RESOLVED that Long Island Vineyards, Inc., Alvah's Lane, Cutchogue, New York, be GRANTED permission to use a building for display and retail use larger th an is allowed. Location of property: County Road 27, Cutchogue, New York, bounded on the north by Middle Road; east by R. Simchick; south by Isaacs and Aud; west by Ovisinak, subject to the following conditions: (1) Parking will be furnished adjoining the barn to accomodate 20 vehicles at 350 feet per vehicle. (2) The parking area will have the topsoil removed and replaced with 6 inches of bank run subject to the approval of the Board of Appeals. ( ) (x) ( ) REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinance is requested for the reason that applicant desires to use a 1,000 square feet section of the barn, which exceeds 1,000 square feet total area, for the display and retail sale of agricultural products. Applicant has contracted to purchase the barn and surroundi.ng property from Wesley Sirachick. (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or ur~eces- sary HARDSHIP because applicant would prefer to use part of an existing larger building for display and sale of its products rather than build a new building having an area of not more than 1,000 square feet. The barn contains a 28' x 90' section on the north side of the barn and applicant would partition off a 28' x 35' section in the northwest corner of the barn for the display and sales area. The remainder of the barn would be used for wine~aking and storage of equipment. 2. The hardship created is UNIQUE and is not shored by all properties alike in the immediate vicinity of this property and in this use district because there are no other properties in the area with the same circumstances. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the property would continue as an agricultural use and the addition of another smaller building for sales would not be required.
