Upon application of Thomas A. and Rosa Fucile, 50 East 89th Street, New York, (Gary F. Olsen, Esq.) for a variance in accordance with the Zoning Ordinance, Article III, Section 100-31 and Bulk Schedule for permission to construct a dwelling with insufficient front yard setback. Location of property: Bayberry Road, and Bridge Lane, Nassau Point, Cutchogue, New York, bounded on the north by Hillmer; east by Hillmer; south by Bridge Lane; west by Bayberry Road. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because difficulties or unnecessary- SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because SEE REVERSE (would not) and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE FORM ZB4 ) be denied and After investigation and inspection, the Board finds that the applicant requests permission to construct a house on a parcel of land containing 1.4 acres of land which has two front yards, one facing on Bayberry Road and the other on Bridge Lane. Many of the houses in Nassau Point do have 35 foot front yards. In some in- stances are in the road bed and the road runs into the lawn. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. On motion by Mr. Gillispie, seconded by Mr. Douglass, it was RESOLVED that Thomas A. and Rusa Fucile, 50 East 89th Street, New York, be GRANTED permission to construct a dwelling with insufficient front yard. Location of property: Bayberry Road and Bridge Lane, Nassau Point, Cutchogue, New York, bounded on the north by Hillmer; east by Hillmer; south by Bridge Lane; west by Bayberry Road, upon the following condition: The building shall be located at least 50 feet from the northerly line, 50 feet from the easterly line, and at least 40 feet from Bayberry Road. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the subject premises contain-, 1.04 acres due tothe fact that it was a lot on a minor subdivision on Nassau Point. The premises is a corner lot, and accordingly, it has two front yards. Due to the terrnin: of the property, theidesl location for a house is in the northeast corner, which is the high point on the property, which should be free from water runoff. Also said location would provide the best view. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because the subject premises is an oversized parcel for most parcels on Nassau Point. Applicant seeks a front-yard Variance of 35 feet and n rear-yard Variance of 35 feetllo that the house can be located as shown on the survey which is made a part of this application. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the house would be ~o located as to be in keeping with the front and rear yard set backs on many other houses on Nassau Point. Due to the fact that this is a parcel over 40, 000 square feet, resulting f~um a minor subdiv- ision, this Variance Application is necessary. The Hillmers feeling is that there is plenty of room to construct theire dwelling near Bridge Lane. The placement of the building as proposed will be 20 feet away from their house now.
