After investigation and inspection the Board finds that the
applicant requests permission to extend his garage 8 feet into his
front yard. The setback when the house was built was 32 feet 6
inches. Most of the houses in this development have the same set-
back and this change would set a precedent.
The Board finds that strict application of the Ordinance would
not produce practical difficulties or unnecessary hardship; the hard-
ship created is not unique and would be shared by all properties
alike in the immediate vicinity of this property and in the same use
district; and the variance will change the character of the neighbor-
hood, and will not observe the spirit of the ordinance.
On motion of Mr. Gillispie, seconded by Mr. Grigonis, it was
RESOLVED that Joseph Cherepowich, Gillette Drive, East Marion,
New York, be DENIED permission to extend garage with insufficient
front yard setback. Location of property: Lot No. 21, Marion Manor
East Marion, New York.
Vote of the Board: Ayes: Messrs: Gillispie, Grigonis, Doyen,
Tuthill and Douglass.

NO structure shall be erected or maintained on any
plot within five (5) feet of any ret or side line.
E. FENC$S: No fence of any kind shall be erected or

prop~ty line or from the front building .line to the front lot
line. No fence of any kind shall ~be erected and maintained ex-
cept a hedge fence o~ a split rail fence. All fences of any kind
herein permitted shall not be more than four (4) feet from the

F. PETS: No pets of any kind whatever shall be kept or
harbored in any premises except not more than one dog and one cat.

H. DURST!ON: These covenants and restrictions are to
run with the land and shall be binding on all p~rties and all
persons claiming under them until January l, 196~, at which time

in writing consenting to an extension for an additional period of
