Upon application of WILLIAM BAXTERr JR. AND JANE BAXTER
GOELLER for Variances to the Zoning Ordinance, Article III,
Section 100-31, Bulk Schedule, for approval of insufficient area
and width of lot in a proposed set-off to be considered by the
Planning Board. Location of Property: Private right-of-way
extending off the north side of Oregon Road, Cutchogue, NY;
County Tax Map Parcel No. 1000-72-2-2.1 and 3.
WHEREAS, a public hearing was held and concluded on
August 18, 1988 in the Matter of the Application of WILLIAM
BAXTER, JR. under Appl. No. 3744; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located in the Residential
and Agricultural Zoning District and is identified on the Suffolk
County Tax Maps as District 1000, Section 072, Block 2, Lot 2.1
and 3.
2. The subject premises is vacant and contains a total lot
area of 5.022 acres, as more particularly shown on the Map
prepared by Roderick VanTuyl, P.C. dated March 10, 1987.

3. By this application, appellant requests approval of the
insufficient lot area of not less than 67,483 sq. ft., having
130.08 ft. frontage along the Long Island Sound and 567.54 ft.
average lot depth (referred to as Lot No. 2). Lot No. 1 will
contain a total area of 151,301 sq. ft. with 224.83 ft. frontage
along the Long Island Sound. The entire premises is accessible
to Oregon Road, the nearest Town Street, by a private
right-of-way within this proposed subdivision.
4. Article III, Section 100-31, Bulk Schedule, of the
Zoning Code requires a minimum lot area of 80,000 sq. ft. (eff.
5/83) and lot width of 175 feet.
5. This Board does agree that the layout of the remaining
section of land (established prior to May of 1983) does lend to
the practical difficulties in this case and that the relief as
requested is the minimum necessary as required by the
Courts.
6. In considering this alternative relief, the Board also
finds and determines: (a) the practical difficulties claimed
are sufficient to warrant a grant of this variance; (b) that the
circumstances are unique to the property and are not shared by
other properties in the neighborhood; (e) there will be no
substantial change in the character of the neighborhood or
detriment to adjoining properties; (d) that the relief requested
is not substantial in relation to the current lot size
requirement; (e) that the difficulties cannot be obviated by
some method feasible for appellants to pursue, other than a
variance; (f) that the relief requested is the minimal
necessary under the circumstances; (g) that in view of the
manner in which the difficulties arose and in considering all the
above factors, the interests of justice will be served by
granting a variance, as conditionally noted below.
Accordingly, on motion by Mr. Sawieki, seconded by
Mr. Grigonis, it was
RESOLVED, to GRANT a Variance for Lot No. 2 of an area of
67,483 sq. ft. and average lot width of 130.08+- feet, as applied

Transmitted herewith for your file and perusal is a copy of
the official findings and determination recently rendered by the
Board of Appeals. Copies of same have also been furnished with
the Planning Board and Building Inspector Offices for their files.
In the event that jurisdiction for Access Approval is
necessary by the Board of Appeals, the standards for improvements
over the entire length of the right-of-way must be as follows (as
a minimum):
(a) Improved minimum width of 15 feet wide with six inches
(6") of soil removed and replaced with six inches (6") of bank
run scarified into the surface; and
(b) filling of any and all pot holes;
(c) continuous maintenance in good condition.

Gentlemen:
Enclosed please find proof of mailing of notice, as I have re-noticed
the adjolnlng property owners pursuant to Mr. Goehringer's letter dated
June 21, 1988.
The proper section that should have been cited in the appeal and
the notice to adjoining property owners is Article Ill, Section 100-31.
The applicants are seeking a variance for insufficient total area end
width.
Approval for the subdivision from the Planning Board will be sought
when and if the Board of Appeals approves the variance.
A single and separate title search will be ordered pursuant to your
request, along with copies of deeds for all chapges. These will be forwarded
to the Board of Appeals and to the Planning Board upon receipt thereof.
There are no wetland areas or ponds which were not shown on the
March 10, 1987 survey.
Please advise if there is anything else needed.

Dear Ms. Stretz:
We are in receipt of the above application recently
filed with our office concerning premises located off the
north side of Oregon Road, Cutchogue, and shown on the
Suffolk County Tax Maps as District 1000, Section 72,
Block 2, Lots 2.1 and 3.
Before proceeding with this application, the follow-
ing information is needed:
(1) Please confirm in writing the nature of the
variances requested under the Zoning Code. It is noted
that the adjoining property owners have been notified
of relief under Section 100-32 (which refers to accessory
buildings), and the application under paragraph 3 of
Appeal Form ZB1 indicates Article I, Section 106.20 and
Article III, Section 100-32. Article I, Section 106.20
is Planning Board jurisdiction, and we are not authorized
to approve set-offs under this section.
(2) Please confirm your position under New York Town
Law, Section 280-a. As you may know, it has been the
position of the Planning Board to review and consider
access approval under 280-a when the right-of-way in
question is within the boundaries of the entire subdivi-
sion project.

(3) Please furnish a single-and-separate title
search certified by a title insurance company in Suffolk
County which includes the history of conveyances involv-
ing this parcel and newly acquired sections of land
between November 23, 1971 to the present time, together
with copies of'the Deeds for all changes, for informational
and record purposes.
(4) At your convenience, please re-notice the
~ ?adjoining property owners confirming the variances
l~equested under the Zoning Code in this set-off
~pplication pending before the Planning Board.
~ (5) Please confirm whether or not thqre are any
wetland areas, ponds, etc. [freshwater] which may not
have been shown on the March 10, 1987 survey.
Attached is a recent memorandum from the Planning
Board which is furnished for your information. Since
the right-of-way is within the subdivision, you should
communicate directly to the Planner (providing us with
copies for our update).

MEMOANDUM
TO: Zoning Board of Appeals
RE: Application for area variance for SCTM # 1000-072-02-2.1-/
With regard to the proposed subdivision noted above; the
applicant should provide the ZBA with property deeds so that a
determination can be made as to whether the 20' strip is part of
the right of way shown to the west.
The applicant should also be asked to produce a title
search to prove that the lot as it now exists is single and
separate.
Upon receipt of this information, the Planning Board will
make a recommendation to the Zoning Board.

way zoning applies to a rural community. This is not an urban
community or suburban. Anyone else?

After investigation and inspection, the Board finds that the
applicant requests permission to divide property with insufficient
width and area, CR27 and Sound Avenue, Mattituck, New York. The
findings of the Board are that the Board is recognizing an existing
situation. The applicant owns two houses and wishes to sell one.
This property was set up prior to Zoning.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same.use district; and the variaace will not change the
character of the neighborhood, and will observe the spirit of
the Ordinance.
On motion by Mr. Gillispie, seconded by Mr. Grigonis, it was

suggested that they get in touch with the Board of Health and
the Building Department. They also stated that Mrs. Cardinal

In reviewing the two maps attached to your January 18, 2001 memorandum, we
find that the lot configurations are identical on the new survey of Mr. Ingegno as
compared to the previous survey from Mr. VanTuyl. Therefore, another variance
will not be necessary for the overall lot area shown on the survey dated December
20, 2000 (now shown to be 61.567+- sq. ft.), after adjusting the location of the
current high water line. Thank you.

The Planning Board has received a new application for the expired minor subdivision of
Baxter Sound Estates. The property is located on Long Island Sound in the R-80 and
A-C zones, requiting a minimum lot size of S0,000 sq. ft. As part of the original
application, the applicant received a variance to approve the undersized Lot #2 at 67,483
sq. ft. (see attached copy of decision rendered September 16, 1988 for Appeal # 3744).
On the new map, Lot #2 is calculated as 61,567.55 sq. ft. An examination of the maps
(attached) shows that most of the disparity is caused by different locations for the High
Water Mark. It is unknown whether this is due to natural erosion or a surveyor error.
The buildable section of the lot is the same size. The Planning Board and applicant
would like to know if a new variance will be required.

the Applicants and approximately 80 persons in the audience.
The Chairman opened the hearing at 9:28 p.m. and read the
notice ofhearing as published in the official newspapers of
the town.
CHAIRMAN GOEHRINGER: I have a copy of a survey produced by Roderick
VAnTuyl, P.C. dated March 10, 1987 indicating a parcel to be set off
from parcel number one which is 151,301 square feet. The parcel in
question is 67,000 which is parcel number two on the map, 67,483
square feet. And I have a copy of the Suffolk County Tax Map indi-
cating this and surrounding properties in the area. Would you like
to be heard Ms. Wickham?
MS. WICKHAM: Thank you. I'd like to speak on behalf of the appli-
cant. I think if anybody asked me to give them an example of prac-
tical difficulty in the extreme, this would befit, .particularly'since
the two proposed lots are both each of considerable size ~nd'dimen-
sion. And also this configuration was created since at least the
early 1940's and a single separate search was submitted.. And I
think the practical difficulty is so evident that it compels the
granting of this variance. As far as the comments of the Planning
Board, I think that, I do want to state it publicly, my client has
given me no indication that he does intend to ask, in the future to
subdivide that larger lot. But the size of that lot being almost 4
acres, would be consent to any provision against future
subdivision for a couple of reasons. Number one; I don't think it's
necessary. Particularly since the application of that nature would
require the approval of at least three Boards; your Board, the Plan-
ning Board and the DEC at the time. And in that case, the practical
difficulty or hardship would be considerably greater than it would
be in this case because with respect to the insufficent area and pos-
sibly how you wouldn't divide the line. I'd be glad to hack this
issue out with the Planning Board but at this point, i don't think
it's one of your conditions. As far as the road goes, the strip of
land coming up from the public road is owned by the applicant, it
is subject-to a right-of-way in favor of the Gallagher parcel which
is the empty parcel. And I think because of that, the Planning Board
would have jurisdiction and it would be a 280-A in front of your
Board.
