1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because a Building Permit for Lot #1 .on the attached survey
would not issue without this variance.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because most properties abut on a
p~bZi~ or approved subdivision road..
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because two houses would be located on the
subject property, whereas in prior years there were three cottages;
thus, the future density will be less than what there was in the past.

The following action, was taken by the Southold Town
Planning Board at a regular meeting held August 17, 1979.
RESOLVED to approve the sketch map of the property
of Celia Vitale located at Bayview, Southold, said map
dated July 24, 1979.
RESOLVED that the Southold Town Planning Board declare
itself lead agency in regard.to the State Environmental
Quali~y Review Act in the matter of the minor subdivision
of prop&rty of Celia Vitale.
The Board will require an affidavit of ownership and
that the right-of-way show 150 foot frontage for Lot #1.
There will be no construction required on this 150 feet.

At a meeting of the Southold Town Board of Appeals held on the ~ 'day of
. 19v9,
RESOLVED, that all rights of way, privat~ roads or other means of access to
one or more parcels of land or buildings shall conform to the following requirement
1. Such access road shall have a width of not less than 15 feet. -
2. Such access road shall be cleared of all trees, brush and ether obstructions
to a width of 15 feet.
3.' Such access road shall be improved in either of the following methods:
(a) Such access road shall be surfaced witha minimum depth of 4 inches
.of packed 3]4 inch stone blend so as to afford access for emergency vehicles. SucL
· stone blend may be either applied to the gr'ound surface and shaped or the surface
may be excavated to permit the application of packed blend to a depth of'h inches.
(b) The access road shall have top soil re.moved to a depth'of 8 inches
and then filled with 8 inches of a good grade of stone and sand bank run. The
surface shall then be covered with a layer of 2inches to 4 inches of 3/4 stone blend
or in the alternative, oiled with a minimum of 4]10ths of a' gallon of road oil per
square yard.
4. All work required as hereinbefore set forth shall be ~performed unde~ the
supervision of the Town Engineer and no building permits or certificates of occupan,
shall be issued by the Building Inspector untiI the Town Engineer has certified that
such access road has been constructed iu accordance with the foregoing require-
ments.
5. Where the'terrain of the land over which such access road is to traverse is
such that drainage pr°blems may occur, the applicant shall be required to construct
such drainage facilities as may be recommended by the Town Engineer.
6. The Board of Appeals may in passing upon any appeal for approval of access
make any reasonable exception as in its judgment it deems appropriate to the
