Wickam, as Attorney), for a variance to the Zoning Ordinance, Article III, Section 100-31 and Bulk Parking Schedule for permission to divide property with insufficient area and width and a variance in accord- ance with Town Law, Section 280A for approval of access. Location or property: Right-of-way off Spring Lane, Peconic, New York, bounded on the north by James, Mealy, Capobianco, Wood and Lucckoff; east by Richmond Creek; south by Bedell; west by Indian Neck Lane. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because SEE REVERSE difficulties or unnecessary (b) The hardship created (is) (}s not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because SEE REVERSE (would not) and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. FOR ZB4 / ) be denied and After investigation and inspection the Board finds that the applicant wishes to divide a parcel containing 80,900 square feet into two plots. The parcel labelled Parcel A will contain 33,300 square feet. Parcel B will contain 47,600 square feet and re- quires recognition of access from Spring Lane, Peconic, New York. The Board agrees with the reasoning of the applicant. There will be no increase in the projected density permitted in the Town of Southold. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. On motion by Mr. Tuthill, seconded by Mr. Douglass, it was RESOLVED, that Richard Schlumpf, 32 Curtis Path, East Northport, 'New York, be GRANTED permission to divide his property into two lots with insufficient area and width and be GRANTED recognition of access to Spring Lane, Peconic. Location of property: Right-of-way off Spring Lane, Peconic, New York, bounded on the north by James, Mealy, Capo- bianco, Wood and Lucckoff; east by Richmond Creek; south by Bedello west by Indian Neck Lane, subject to the following conditions: (t) The right-of-way frQm Spring Lane to Parcel "B" will be improved for a length of 266 feet in length and 10 feet in width by: (a) Stripping the top soil and replacing it with 6 or 8 inches of bank run, sand and gravel. (b) Stone blend, 3/4 inch stone, for a width of 10 feet more or less in the center of the right-of-way. (o) Black top (2) Subject to the approval of the Southold Town Building Inspector. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sap/ HARDSHIP because the two parcels toc~ther fonm one large,narrow lot bozclered by ~uch smaller lots. ~ Mrs. Francisco purchased the property in 1968, the deed described the two parcels as separate parcels, and the front lot (Parcel A) ~t the Town Code requirements. Parcel A has a 125.66 foot frontage, containing apprc~imately 33,300 square feet. The frontage and am~a are consistent with the other lots in the i~mediate vicinity, as shown c~ the survey. Parcel B contains approximately 47,600 square feet, with access over a 30 foot right of way frcm Spring Lane. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because the property as a whole is shaped differently frcm all surrounding parcels and was purchased by the present owner as 2 separate lots. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the property would be divided into 2 lots in keeping with the size and frontage of neighboring lots as shown on the attached tax map. ) ss ...............
