STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because applicant seeks to utilize the existing building aa an office for one business. Due to the fact that the property is only forty feet wide, and due to the topography of the property, it~is impractical to construct parking facilities on the subject premises. Tkere i~,~nrexisting brick building on the pr~mises, which was formerly used l~y the New ~6rk Telephone Company, and said bUilding is located approximately forty-five feet back on the property from the Main Road. Permission has been ob{ained f~om the Mattituck Manor to park the owner's l~nd employees' cars in the Mattituck Manor parking lot located across the street from the subject premi- ses. It is anticipated that the office would be utilized from Monday through Friday, between the hours of approximately 9:00 am to 5:00 pm, which would not interfere with the general hours of operation of the Mattituck Manor. There are practical difficulties in attempting to construct a limited parking lot on the subject premises due to the fact that there is limited land available and due to the terrain of the property ~' ~ 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because there is a pre-existing building on the subject Premises which was so located so as to leave very little room for the con- struction of Parking faciliti~ and du'e So the fact that the terrain of the property is not suitable for the construction of parking facilities. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because this is a pre-existing situation and a license has been received from the Mattituck Manor for permist~ion to utilize its parking lot across the street during hours and days whichwould not conflict with the use by the Matti- tuck Manor of its own parking lot facilities. Winters: Your appraisal of past and future traffic problems on Route 25, Mattituck, New York (accident history, etc.) opposite the Mattituck Manor would be helpful in an application before the Board of Appeals. We have an application on behalf of Albert Brisotti, who wishes to operate a general insurance office with one or two employees on the north side of the road in the former New York Telephone Company building directly opposite Ma~tituck Manor. The Matti- tuck Manor people are agreeable to the applicant using their parking lot on the south side of the street during working hours. An alternative under consideration is to require the applicant to excavate the 40 foot by 40 foot front yard area to create._a parking area for two or thr~e spaces, but might occasionally involve a car backing out onto the Main Road, even though that is prohibited.
