SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article .................... Section .................... Subsection .................... paragraph ...I................ of the Zoning Ordinance and the decision of the Building Inspector ( ) be reversed ( ) be confirmed because 8 ; 25 P.M. Location of property: Fishers Island, New York, bounded on the north by Fishers Island Sound; east by Leeson; south by Private Road; west by West Harbor. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE APPROVED \ `-t '1(" q ZOIJjING BOARD OF APPEALS FORM ZB4 1 (' of Cha,ni,an ar of Appeals s • • After investigation and inspection the Board finds that the applicant is forced to reduce his front yard setback and side yard setback to meet the requirments of the DEC in dealing with the tidal wetlands and marshland conditions which surround the buildable por- tion of this lot. The Board finds there are presently no residences within 100 feet of the property, and agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. On motion by Mr. Gillispie, seconded by Mr. Doyen, it was RESOLVED that Olof Nelson, 3 East 85th Street, New York, New York, be GRANTED permission to build a house with insufficient front yard and side yard setbacks as applied for. Location of property: Fishers Island, New York, bounded on the north by Fishers Island Sound; east by Leeson; south by Private Road; west by West Harbor, subject to the following condition: (1) Approval of the Suffolk County Planning Commission.
