1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP becaus~ my existing home is to close to the cliff, facing
the water east on lot ~17,
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because all homes on Nassau Point Road,
facing east, are near the water llne.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because there are no homes next to the proposed
tennis court on both sides or anywhere else in the facinity east
of Nassau Point Road.

Pursuant to Section 617.13 of the New York State Department
of Environmental Conservation Act, Article 8 of the Environmental
Conservation Law, and Town Law of the Town of Southold, Section
44-4B, the Southold Town Board of Appeals has determined that the
following project is classified as a Type II Action not having a
significant effect on the environment and will not require any
other determination or procedure.

Application for Variance
Dear Mr. Morchel:
We'are in receipt of your application for a variance
to the Zoning Ordinance pursuant to Article III, Section
100-32 for permission to construct accessory in frontyard.
In the Building Inspector's Notice of Disapproval, he
has based his disapproval on two grounds: ·
(a) Article III, Section 100-35, fence over 4-foot high
not permitted in front yard, and
(b) Article III, SectiQn 100-32, accessory use not
permitted in front yard.
It appears that you are requesting permission to con-
struct fence both over 4-foot. high and-in the frontyard as
the Building Inspector has noted. In order for the Board of
Appeals to even consider both, the applicant must make ap-
plication for both. Your application only mentions Article
· III, Section 100-32, accessory use in front yard.
Enclosed are copies of the variance application in
order that you may request permission to construct fence
over 4-foot high. The same procedure applies. The
deadlin~ for the next Board of Appeals hearings that will
be se~ up is December 6, 1979.

and filed with this Department before December 6, 1979:
(a) Short Environmental Assessment Form, which is
enclosed should be completed for each variance application,
(b) six (6) copies of the survey for each file inasmuch

ning Commission for their recommendation.
We are sorry that you were not informed upon your filing
of the first application, but these are procedures now mandated.
