A Variance to the Zoning Ordinance
is requested forthe reason ~x to obtain approval of lot No. 3 containing less
than 40,000 square feet on a minor subdivision approved by the Southold
Town Planning Board.

REASON FOR APPEAL
Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficultiesorunneces-
sary HARDSHIPbecau~Petitioner is the owner of a parcel of land rectangular in
shape on the northerly side of East Road, Cutchogue, New York, containing
2.665 acres. Petitioner has obtained approval from the Southold Town Plan-
ning Board to subdivide this parcel into three building lots. The parcel i:
vacant woodland with no significant terrain problems. Lot No. 1 is general-
square and will contain 40,001 square feet and have road frontage on East
Road of 194.20 feet and road frontage on Fleets Neck Road of 200.0 feet; Lo~
No. 2 also is square in shape and will contain 40,001 square feet and have
199.13 feet of road frontage on East Road; Lot No. 3 is somewhat rectangular
containing 36,087 square feet and will have 186.74 feet of frontage on East
Road. The aforementioned lots are shown on the map entitled "Proposed Minor
Subdivision for Moebius Associates dated February 8, 1979, by R. Van Tuyl,P.C
which is attached hereto as Exhibit 1. Lots No. 1 and 2 meet all the presen~
Town of Southold zoning requirements, and a variance is not being sought for
these lots. Lot No. 3 lacks 3,913 feet although it meets the other zoning
requirements of the Town of Southold. The proposed subdivision is the only
practical means of subdividing this property considering the shape of the
parcel, the lot depth and the surrounding lots in the neighborhood. To divide
the property into two lots each containing 58,000 square feet would not only
be awkward but would lead to further requests for future subdivision of thes:
oversized lots.
2. The hardshipcreatedis UNIQUE and isnotshared by all properties alJ~ in the immediate
vicinity ofthisproperty and in this use district because virtually all of the building lots tc
the east of Pequash Avenue between East Road and Fleetwood Road as shown out-
lined in red on the Suffolk County Tax Map (District 1000, Section 110) an-
nexed hereto as Exhibit 2 contain undersized lots by today's zoning standards
ranging from approximately 10,800 square feet to approximately 20,000 square
feet. The width of these lots range from 50 feet to 100 feet. The lots on
the proposed subdivision ~xhibit '1) contain 2 to 3 times the area and with
of the neighboring lots. The parcels of land to %he south of East Road are
mainly waterfront parcels, some of which contain large houses. To require
any larger sized plots on Petitioner's property will impose an economic
hardship and be an injustice taking into consideration the rest of the
neighborhood.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the proposed subdivision would remain in
residential use and the lots on the proposed subdivision still are far
greater in area and width than the surrounding building lots. Further,
the Southold Town Planning Board in planning for the future has approved
the proposed subdivision subject to the Board of Appeals granting a variance
for lot No. 3. A copy of the Southold Town Planning Board's resolution
dated April 16, 1979,~ is annexed hereto as Exhibit 3.

resolution was passed relative to the above-captioned matter.
On motion by Mr. Tuthill, seconded by Mr. Grigonis, it was
RESOLVED, that Moebius Associates, East Road, Cutchogue, New
York, be GRANTED approval of a lot with insufficient area on a pro-
posed minor subdivision entitled "Minor Subdivision for Moebius
Associates". Location of property: East Road, Cutchogue, New York,
bounded on the north by Williams, Spiro, Lake, and Brower; east by
Williams; south by East Road; west by Pequash Avenue subject to the
following conditions:
(1) There shall be no further subdivision of the lot created
by this action.
(2) Approval of the Suffolk County Planning Commission.

The following actions were taken by the Southold Town
Planning Board at a regular meeting held April 16, 1979.
RESOLVED that the Southold Town Planning Board
recommend to the Southold Town Board of Appeals approval
of the request for a variance for a lot of insufficient
area in the minor subdivision of Moebius. All of the lots
in the area are of much smaller size.
RESOLVED to grant approval to the sketch map of the
minor subdivision of property of Moebius subject to action
of the Board of Appeals granting a variance on the under-
sized lot.

Instructions
A. This application must be filled in typewriter OR ink, and submitted in DUPLICATE to the Building
Inspector with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and
unusual natural or topographic features.
2. Final approval of Health Dept. of water supply and sewerage disposal---(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and
installations, a certificate of Code compliance from the Architect or Engineer responsible for
the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pm-existing"
land uses:
1. Accurate survey.of property showing all property lines, streets, buildings and unusual natural
or topographic features.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code or safety inspection of buildings or premises, or other Pertinent in-
formation required to prepare a certificate.
C. Fees: 1. Certificate of occupancy $5.00
2. Certificate of occupancy on pre-existing dwelling or land use $.5.00
3. Copy of certificate of occupancy $1.00
