Mandel (Mr. ~ohn Geideman, as agent Inlet Lane Extension P.O. Box 416 Greenport, NY 11944 East Marion, NY 11939) 1979 Appellant at a meeting of the Zonl.g Board of Appeals on -- was considered and the action indicated below was taken on your ( ) Request for variance due to lack of access to property ( ) Request for a special exception under the Zoning Ordinance ~10 Request for a variance to the Zoning Ordinance ( ) the appeal 1. PPROVED -~ ~ U~ u '~ ~ .{ , ,.:. '~ 'f.,~i.,' ~f~ ZONING BOARD OF APPEA.I~ ., ~1 /t .,/J.='~-_..~, -'~ Chairmn ~ a A~2 After investigation and inspection, the Board finds that the applicant wishes to 'construct a walk along the westerly side of his house which would.reduce the side-yard setback from 10'6" to 7'6" Recently, the Board divided property on the easterly side of the ap- plicant's house. When that division was made, the Board imposed a 15-foot side yard. The Board feels in view of that decision it would not be proper to grant this reduction which is half the amount imposed on the other side of the property. The Board finds that strict application of the Ordinance would not produce practical difficulties or unnecessary hardship; the hardship cre- ~t~d is notUnlque and would not be shared by all properties alike in tq~-immediate vicinity of the property and in the same use district; and the variance will change the character of the neighborhood and will not observe the spirit of the Ordinance. On motion by Mr. Douglass, seconded by Mr. Grigonis, it was RESOLVED, that Herbert R. Mandel, Inlet Lane Extension, Greenport, New York, be DENIED permission to construct an addition to a building with insufficient side yard. Location of Property: Inlet Lane, Green- port, New York, bounded on the north by Clempner; east by Gull Pond; south by conant; west by Inlet Lane. Vote of the Board: Ayes: Messrs.
