A Variance to Section 280A Subsection 3
A ~/oriance to the Zoning Ordinance

sideyard variance for existing dwelling are requested as premises
were divided into 2 s~wate parcels until applicant took title in
1978. Applicant's ~eed described the 2 parcels as 1 parcel and
applicant did not realize(nor did his attorney) that this would
result in the merging of title into one parcel.

1. STRICT APPLICATION OF THE ORDINANCE would produce procticoldifficulti~ orunn~es-

2 separate Soundfront parcels, one vacant and one improved with a
dwelling based on the fact that the parcels~ had separate tax bills
and. appeared aa separate, items on the tax rolls. Please see attached
copmes of the 1978-79 tax bills for subject property.
2. The hardshipcreatedis UNIQUE andisnotshared by oil properties alike in the immediate
vicinity ofthisproperty andi~this use district because properties in the vicinity
are generally 100' mn width: the 4 properties to the east of sub-
ject property ~ve~age 100, in width (50,,75,,175, & 100') and the
four properties to the west of subject property average 75' in
width (100',100',50',50,). Properties on the south side-of Leeton
Drive are uniformly 100' in width in the area of subject property.
3. The Variance would observe the spirit ofthe O~inance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the average lot width in the entire
neighborhood does not exceed 100' and it would be unreasonable to
require this property to remain 200' in width because of an
unwitting error on the part of applicant in view of the fact
that this property has been 2 separate lots during the entire
period of ownerSAip of the previous owner as evidenced by separate
tax bills and separate assessments.

The following action was taken by the Southold Town Planning
Board at a regular meeting held on February 25, 1980.
RESOLVED to disapprove the sketch map of the minor subdivision
of Thomas F. Maher and Margaret M. Maher for property located at
Southold for the following reasons:
1. The severe erosion rate will place in jeopardy any
proposed structure that will be erected upon the site.
2. It appears to be unreasonable to create more building
lots that will be subject to erosion.
I am enclosing the review of the Suffolk County Planning
Commission in which it disapproves the map. If you wish to pursue
this matter further, let us know.

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on February 6,
1980, reviewed the proposed subdivision plat, entitled, "Minor Subdivision -
Thomas F. Maher", referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to disapprove said map for
the following reasons:
.1. The seVere erosion rate will place in jeopardy any proposed structure that
will be erected upon the site in addition to Placing in jeopardy the
existing structure.
2. No information was provided indicating that the subdivider has~aken or
plans to take any remedial measures to minimize the impact of the erosion
of the shore upon the proposed subdivision.
3. In light of the increasing erosion problem it appears to be unreasonable
to create more building lots that will alsd be subject to the problem.
4. Lot areas are inappropriate as they do not satisfy the zoning requirement
and the variance would not cure the defect.
The Commission also offers the following comment on the map for your use amd
consideration:
Considering the erosion problem that this area has been experie~i~ partic-
ularly over the past few years, the Commission is of the opinion that a moratorium
prohibiting new construction along the beach in this area should be declared until
the erosion problem can be studied amd it determined if there are any measures that
can be instituted that will help to minimize the erosion rate and its impact on

shoreline properties. If it is determined that the erosion cannot be halted or at
least minimized then building should only be allowed under strict regulations and
spacial construction s%andards to help insure the health, safety aRd welfare of
