After investigation and inspection the Board finds that the
applicant requests permission to set off a business lot with in-
sufficient area, width and off-stre~t parking on property located
on Love Lane, Mattituck, New York. The prospective purchaser is
interested in purchasing the retail food store property, modernizing
the interior, and removing the.encroachment on the neighbor's property
to the north. The findings of the Board are that the parcel to be
divided out is surrounded by substandard parcels and the granting of
this variance will not change the character of the neighborhood. The
Board agrees with the reasoning of the applicant.
The Board finds that strict application of the Ordinance would
produce practical difficulties or unnecessary hardship; the hardship
created is unique and would not be shared by all properties alike in
the immediate vicinity of the property and in the same use district;
and the variance will not change the character of the neighborhood and
will observe the spirit of the Ordinance.
On motion by Mr. Tuthill, seconded by Mr. Douglass, it was
P~SOLVED, that M. A. Kelsey Properties, Inc., P.. O. Box 983,
Southold, New York, be GRANTED permission to divide property with
insufficient width and area and off-street parking. Location of
property: Love Lane and Main Road, Mattituck, New York, bounded on
the north by Barker; east by Mattituck Park District;and Stype; south
by Main Road; west by Love Lane, upon the following conditions:
il) The purchasers shall be granted a right-of-way to the post
offide with the possibility that when the post office lease is renego-
tiatedthere will be consideration for the right-of-way to be extended
to-the rear entrance of L &~L. Market.

cient; lot width, yards and area; on-premises off-street parking requirements
~s requested for the reason that Petitioner has the opportunity to sell the premises to be
subdivided to the present tenants, Leon Milowski, Jr. and Lois I. Milowski, so exten-
sive renovations and repairs can be made to the existing building located thereon.
The proposed subdivision is outlined in red on the "Map of Property Surveyed for M.A.
Kelsey Properties, Inc." by Roderick Van Tuyl, P.C,, dated February 7, 1973, which is
attached hereto as Exhibit A, Attacked ke~eto as Exhibit B is a copy of the Building
Zone Map of the Town of Southold w~th tile property to be su~d3-vided outlined in red.

REASON FOR APPEAL O Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce procticol difficulties or unneces-
so~ HARDSHIP because the premises proposed to be subdivided contain a retail food store
known as the L & L Food Market. The building itself occupies the majority of the plot
as seen from the map attached hereto as Exhibit A. The interior of the building is in
need of extensive modernization and repair in order for the tenants, Leon Milowski, Jr.
and Lois I. Milowski, to be able to adequately serve tke public. The parcel to be
divided contains 5,245 square feet and the existing building contains approximately
3,200 square feet. Due to the configuration of the parcel and the existing building
there are no side yards, and the front yard setback conforms to all of the existing
properties on'Love Lane. There is no practical way to relocate the existing building
on the premises and conform to the present front, side and rear yard zoning require-
ments. The variance for area, front side and rear yards being requested will not sub-
stantially affect or change the surrounding business area in that a majority of the
businesses in the vicinity of the property are of the neigb_borhood type, and virtually
all of them are non-conforming parcels by today's zoning standards. At present there
is no on-premises off-street parking provided for this parcel or any of the other shops
on Love Lane. However, off-street parking is presently provided for this and other
stores on Love Lane by the public parking lot owned by the Matti~uck Park District on
Pike Street, Mattituck, New York. The Park District currently leases the parking area
to the Town of Southold for public parking. In addition, the Park District has con-
structed a walkway from the westerly portion of the parking lot over land of L.W.Barker,
which is immediately north of the subject premises, to Love Lane.
2. The ho~ship creoted is UNIQUE ond is not shored by all prope~ies olike in the immediote
vicini~ of this property ond in this use di~rict becouse the present tenants who have operated
this business for some time are reluctant to go to the expense of renovation without
actually owning the property. In addition, there is an encroachment of a wood frame
building on the neighboring property to the north which is owned by L.W.Barker. This
encroachment houses a freezer and refrigerator unit. The Milowskis intend to remove
that part of the building which encroaches on the ne~gb]3oring property and purchase a
refrigerator freezer unit which can be placed in the rear of the existing building.
Otherwise, the Milowskis will be forced to relocate to another location leaving the
building vacant and in a possible state of disrepair.
3, The Variance would obse~e the spirit of the O~inance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because there would be no change in w~at Petitioner could
presently do on a non-conforming basis as there are no new buildings to be added, and
the renovations will be done within the existing structure. The parcel to be divided
is surrounded by substandard parcels, and the granting of this variance to enable the
Petitioner to sell would not affect the public health, safety or welfare. Balancing
all of the com~aunity interests, substantial justice will be performed in granting this
variance as the renovated building will add to the charm and attractiveness of the
Mattituck Love Lane shopping area.
