After investigation and inspection, the Board finds that the
applicant is requesting a variance for a 20-foot frontyard setback
due to the deepness of the land in an area where a building could
be erected without a variance but would be more practical if the
application would place the building with at least a 35-foot front-
yard setback in order to allow for off-street parking. Therefore,
the Board agrees with the reasoning of the applicant.
The Board finds that strict application of the Ordinance would
produce practical difficulties or unnecessary hardship; the hardship
created is unique and would not be shared by all properties alike in
the immediate vicinity of the property and in the same use district;
and the variance will not change the character of the neighborhood
and will observe the spirit of the Ordinance.
On motion made by Mr. Douglass, seconded by Mr. Doyen, it was
RESOLVED, that KIWANIS CLUB OF SOUTHOLD, P.O. Box 150, Peconic,
New York 11958, Appeal No. 2612, be GRANTED a variance to the
Zoning Ordinance for permission to place building for charity use
in a residential district with an insufficient frontyard setback
of not less than 35 feet, in order to provide for off-street park-
ing, SUBJECT to the following conditions:
(1) That off-street parking facilities be made available,
such as paving, gravel, etc.
(2) Approval of the Suffolk County Planning Commission.
Vote of the Board: Ayes: Messrs. Douglass, Grigonis, Tuthill
and Doyen.

Please find enclosed Amended Decision regarding the
application of Kiwanis Club of Southold for a variance to
place building with insufficient frontyard setback. The
copy that was forwarded to you on October 30, 1979 did
not include the conditions as set forth by this Board in
its Resolution adopted October 11, 1979, which are as fol-
lows:
(a) That the building be placed with a frontyard
setback of not less than 35 feet in order to allow for
off-street parking,
(b) That facilities be made available for the off-
street parking, i.e. paving, gravel, etc.
(c) That the suffolk County Planning commission
approve same.
