B~ 232, FISH~q~ ISLAND, STATE OF NE~ YORK, APPEAL 2641 DATE]) 11/9/79 The undersiLrned res]~ctfully requests the Board of Appeals of the Towm of Southold to deny the Petition for a Variamce filed by J. B. Hatsfield, Bos 232, Fishers Island, NY on November 9, 1979 (APPEAL NO. 2641 ) u~less certain restrictions specified below are made par% of the Variance. The res%fictions requested are based on consideration of the followir~ facts: a) that the ~mdersigned is the owner of the proper~y adjacent to and West of:~said Hartsfield proper~r, and that I am the Phelps cited in the Petition aforementioned; b) tha~ the Hartsfield property presently contains three dwellings, each on lots smaller tham permitted by current zoning ordinances; c) that current zoning restrictions require a setback of 50 feet in front arat rear of any dwelling from the property line; d) tkat all three existing Hartfield dwellin~s are in violation of the current 50-foot setback ordinances, both front and rear; e) that one of the Hartsfield dwellings, the garage apartment, is situated approximately six (6) feet from the Phelps property, an~ is in gross violation of setback regulations: f) that J. B. Hartsfield requests a Variance in order to erect a fourtl~ dwelling on a lot smaller than permitted by current zoming ordinances; and %ha% he is requesting a further Variance from se%- hack ordinances, said further Variance being by the amount of 23/50ths in front, and 2T/5Oths in the rear. The restrictions requested by the undersigned are as follows: that any dwelling to be built on the proper~y for which this Variance is requested be limited in height to one story above ground, and that no second story, attic or other structure may be built over it now or in the fu%ur~; 2e that no part of any dwelling to be erected on the propertgr, or added to the proposed dwelling thereon, now or in the future, may be closer than twenty-seven (27) feet to the Western edge of said proper~y, said edge being the line between the Harts- field and Phelps properties; © O STOWE C. PHELPS TO THE BOARD ~F APPEALS, TO~N OF $O~THOLD. December 2, 1979 pa~e 2 that no additional or separate structures of any kind may be erected on said proper~y; that the dwelling on this property be restricted to single- family residence. 'l~e undersigned argues that the existence of four dwellings o~ adjacent sub-sized lots, all with':se~bac~ at variance wi~existing zoning regu- lations, will ~ unless restricted as requested abo~e ~alter and sub- stan%ially erode the nature a~d values of all the adjoining properties. Said restrictioms are therefore respectfully reques%ed. STOWE C.
