1. Final survey of property with accurate location of all buildings, property lines;
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form) .
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
"pre-existing" land uses:
1 . Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
2. A properly completed application and a consent to inspect signed by the applicant.

Uniform Fire Prevention & Building Code
Upon the application of Bernard and Irene Sauter, filed pursuant to 19 NYCRR 450 on August 24, 2002, and
upon all other papers in this matter, the Department makes the following determination:
NATURE OF GRIEVANCE AND RELIEF SOUGHT
The petition pertains to a new building of Al (single family) occupancy, two stories in height, of type 5 (wood
frame) construction, approximately 2400 square feet in area, located at 1435 The Strand, East Marion, Town of
Southold, Suffolk County, State of New York. The petitioner is seeking relief from:
9 NYCRR 711.2(b), which requires that bathrooms, toilet rooms, kitchenettes, corridors and recreation rooms
shall have a minimum height of seven feet. [The petitioner requests relief to allow bathroom No.3 built into the
roof area of the second story with a horizontal ceiling height of approximately 7 feet 0 inches sloping down to 6
feet 9 inches and then to 4 feet 10 inches at the knee wall, and bathroom No. 4 with a ceiling height of 9 feet 10
inches sloping down to 5 feet 7 inches at the knee wall.]
FINDINGS OF FACT
1. As part of the new construction, a bathroom is to be constructed into the roof area of the second floor of the
building that is the subject of this petition.
2. The horizontal ceiling height in bathroom No.3 is approximately 7 feet sloping down to 6 feet 9 inches and then
to 4 feet 10 inches at the knee wall. The ceiling height in the area of the water closet is 6 feet 9 inches.
3. The horizontal ceiling height in bathroom No.4 is approximately 9 feet 10 inches sloping down to 5 feet 7
inches. With the placement of the fixtures the ceiling height is adequate for normal usage.
4. The petitioner has proposed to install a fire and smoke detecting device in the second floor as required by the
Uniform Code.

5. The local Code enforcement official has been consulted in this matter and does not object to the granting of a
routine variance under the provisions of 19 NYCRR 450.6.
CONCLUSIONS OF LAW
Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a
negligible additional health, safety and security benefit to the occupants of the building.
DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.2(b), to allow a
bathroom built into the roof area of the second story with a ceiling heights as shown above, be and is hereby
PROPOSED TO BE GRANTED with the following conditions:
1. That the petitioner installs a fire and smoke detecting devices in the second story in conformance with the
Uniform Code.
2. That the building meets all other applicable sections of the Uniform Code.
This DECISION is issued under 19 NYCRR 450.6. Unless obiected to by the petitioner in a writing received by
the Department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties.
This decision is limited to the specific building and application before it, as contained within the petition, and
should not be interpreted to give implied approval of any general plans or specifications presented in support of this
application.

The proposed accessory garage is not permitted pursuant to Article IIIA Section 100-33, which states;
"Accessory buildings shall be subject to the same requirements as 100-33 of the Agricultural
Conservation District,"which states;
"In the Agricultural-Conservation District and Low-Density Residential R-80, R-120, R-200,
and R-400 Districts, accessory buildings and structures or other accessory uses shall be located
in the required rear yard."
The proposed accessory garage is located in a front yard.
On February 27, 2002, the Southold Town Building Department issued the applicant a building permit
(#28111-Z) for construction of a single family dwelling with an accessory,garage, attached by a
breezeway. However, the buildingpermit was issued in error because the connection did not meet the
definition of a breezeway based on Article 1, Section 100-13, which states,
"BREEZEWAY—Open construction with a roof projecting from the outside wall of a building
not to exceed dimensions of 8 feet by 10 feet, connecting the main building and garage. Other
types of attachments, which extend more than 10 feet, or exceed 80 square feet in area, shall
not attach a main buildingto a separate building unless such attachment meets the requirements
of a livable floor area."

The purpose of this letter is to state that engineered floor joist located In the
approximate area above the first floor bathroom # 1 damaged by plumbing work
(a circular bite out of the top cord) is to be resolved by placing a new joist next to
the damaged one.
The other joist In which a segment of tho top cord was removed, does not
represent a problem because the Joists it each side are less of 24•o.c. as
called for by the manufacturers manual.
The corrected floors will match or surpass the requirements of the NYS Building
Code.

FINDINGS OF FACT
1. As part of the new construction a bathroom is to be constructed into the roof
area of the second floor of the building that is the subject of this petition.
2. The horizontal ceiling height in bathroom No.3 is approximately 7 feet 0 inches sloping down to 6 feet
9 inches and then to 4 feet 10 inches at the knee wall. The ceiling height in the area of the water closet
is 6 feet 9 inches.

3. The horizontal ceiling height in bathroom No.4 is approximately 9 feet 1 0 inches sloping down to 5
feet 7 inches. 4. With the placement of the fixtures the ceiling height is adequate for
normal usage.
4. The petitioner has proposed to install a fire and smoke detecting device in the in the second floor as
required by the Uniform Code.
5. The local Code enforcement official has been consulted in this matter and does not object to the
granting of a routine variance under the provisions of 19 NYCRR 450.6.
CONCLUSIONS OF LAW
Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would
produce a negligible additional health, safety and security benefit to the occupants of the building.
DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.2(b), to allow a
bathroom built into the roof area of the second story with a ceiling heights as shown above, be and is
hereby PROPOSED TO BE GRANTED with the following conditions:
1. That the petitioner installs a fire and smoke detecting devices in the second story in conformance
with the Uniform Code.
2. That the building meets all other applicable sections of the Uniform code.
This DECISION is issued under 19 NYCRR 450.6. Unless objected to by the petitioner in a writing
received by the Department, the decision shall become FINAL after fifteen days of receipt of the decision by
the parties.
This decision is limited to the specific building and application before it, as contained within the
petition,and should not be interpreted to give implied approval of any general plans or specifications
presented in support of this application.
