ZONING BOARD OF APPEALS
After investigation and i~spect~on the Board finds that the appli-
ccant is in the fuel oil business, and presently has'~a 20,000 gallon
fuel oil tank presently located on the North Fork Shipyard, Inc.,
property in New Suffolk. They desire to move this tank to their
storage yard on Youngs Avenue to consolidate their business, prevent
vandalism and the possibility of leakage. The Board agrees with the
reasoning of the applicant.
The Board finds that strict application of the ordinance would pro-
duce practical difficulties or unnecessary hardship; the hardship created
is unique and would not be shared by all properties alike in the inuaediate
vicinity of the property and in the same use district; and the variance
will not chance the character of the neighborhood and will observe the
spirit of the Ordinance.
On motion by Mr. Grigonis, seconded by Mr. Tuthill, it was
RESOLVED, that Goldsmith & Tuthill, Inc., 1560 Youngs Avenue,
Southold, New York, be GRANTED permission to relocate a 20,000 gallon
fuel oil tank on property o~ Youngs Avenue, Southold, New York. Location
of property: Youngs Avenue, Southold, New York, bounded on the northerly
Agway, Inc.; east by UYoungs Avenue; south by Long Island Railroad:
west by Agway, Inc., upon the following condition:
(1) Site Plan Approval of the Southold Town Planning Board.
Vote of the Board: Ayes: Messrs: Douglass, Grigonis, Doyen and
Tuthill.

because i% is presently in a very dangerous spo~ from an environ-
men% point of view. It i~ %~jacen% %o %he bay and in the middle of
a shipyard and res%auran% parking lo%. Should vandals d~mage the
piping oil could run in%o the Bay and crea%e a ~errible mess under
%he s~ored yachts.

1. That it is the intention of the undersigned to petition the Board of Appeals of the Town of Southold
to request a (Variance) (Special Exception) (Special Permit) (the following relief: To install one
20,000 gallon fuel tank above ground next to the two existing tanks )-7
2. That the property which is the subject of the Petition is located adjacent to your property and is des-
cribed as follows: directly south of Agway property and west of youngs ave and
directly north of Long Island Rail Road property
3. That the property which is the subject of such Petition is located in the following zoning district:
4. That by such Petition, the undersigned will request the following relief: To install
one 20,000 gallon feel oil tank
5. That the provisions of the Southold Town Zoning Code applicable to the relief sought by the under-
signed are:
