Upon application of John Gaston, Equestrian Avenue, Fishers Island, New York, for a variance to the Zoning Ordinance, Article III, Section 100-31 and the Bulk Parking Schedule for permission to divide property with insufficient width and area. Location of property: Equestrian Avenue, Fishers Island, New York, bounded on the north by Hay Harbor; east by Stauton; south by Equestrian Avenue; west by Coffey. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties hardship because SEE REVEI~SE or unnecessary (b) The hardship created (is) (is not) umque and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because SEE REVERSE (would not) and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE FORM ZB4 ~~ ZONING BOARD OF APPEALS ) be denied and After investigation and inspection the Board finds that the applicant requests permission to divide a parcel of property with 43,560 square feet into two parcels. Parcel "A" to be created will abut Equestrian Avenue, contain 20,000 square feet and have the existing main house on it. Parcel "B" will abut Hay Harbor, contain 20,489.5 square feet and will have a newly constructed house on it. Parcel "B" will be reached by an existing right-of-way on the westerly boundary of the property which is satisfactory for emergency vehicles. The adjoining properties in the area are of the same or lesser dimensions in many instances. The density will not be effected because the property will still have the main house a nd a new summer house. The Board finds that strict application of the Ordinance would pro- duce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. On motion by Mr. Gillispie, seconded by Mr. Douglass, it was RESOLVED, that John Gaston, Equestrian Avenue, Fishers Island, New York, be GRANTED permission to divide property as requested. Location of property: Equestrian Avenue, Fishers Island, New York, bounded on the north by Hay Harbor; east by Stauton; south by Equestrian Avenue; west by Coffey; subject to the following conditions: (1) The division granted is the one shown on survey for John Gaston, dated March 28, 1979, (SK-1). (2) The existing cottage shown on Parcel "A" will be demolished. (3) Suffolk County Planning Commission Approval. Vote of the Board: Ayes: Messrs: Gillispie, Grigonis, Doyen, Tuthill and Douglass. Form ZB! (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because Mr. Gaston has owned the p~operty for a number of years. Mr. and Mrs. Gaston have been divorced and each has remarried. Having 4 children by his first marriage and wanting them to continue to return to Fishers Island, at the same time wishing to time on Fishers Island with his now wife becomes very difficult because of the close p~oximity of the two houses as they ar~ now. Conseduently, Mr. Gaston would tike to cut the p~operty in two and give the big house to his children, which requires a deed and consequently separate parcels. 2: The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because Moving the cottage further out on the land reduces the har~lship for Mr. Gaston's now wife by giving her more privacy. There is no hardship because of their closeness as tong as they are owned and operated by one family, but tn view of the present circumstances, with essentially separate families, it becomes a strain on both by being so close. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because Allowing Mr. Gaston to not only divide his acre into 2 par~s but also to relocate a now small cottage on the point of his land will not in any way affect the presemt density or usage of his land. It will to a great extent enhance the aesthetics of the property in that the existing cottage is a bit of an eyesore and vet%/close to one neighbor. The character of the district can only be improved, particularly if the new cottage resembles the main house.
