( ) (X~ ( ) REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinance is requested forthe reasonthat applicant proposes to build a house in the location shown on the attached survey by Van Tuyl & Son dated August 19, 1968 as ammended, with insufficient setback. Form ZB1 (Continue on other side) Continued ]. STRICT APPLICATION OF THE ORDINANCE would produce procticoldifficultiesorunneces- s0~ HARDSHIP because the lot is quite narrow, particularly ak the location where applicant plans to build. If applicant located the house in the wider northerly portion of the property, he would significantly restrict his view of the Bay. Under the zoning ordinance, the front yard is technically along the westerly portion of the property because the right- of-way enters the property at the westerly boundary. However, as a practical matter, the front and rear yards will be to the north and south of the proposed house, as is the case with the other properties in the area. It would be impossible to have a 50' front yard along the westerly portion of the property and also to have a rear yard of 50' along the easterly portion of the property. Because the lot is so narrow, it would be difficult to erect a house in the proposed location and leave more than 15' on the west and 10' on the east. 2. The hardshipcreatedis UNIQUE and isnotshared by all properties alike in the immediate vicinity of this propedy and in this use district because the lot narrows down on the southerly portion of the property. Also, the right-of-way enters the property from the west, whereas most properties in the area have a northerly access. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because most of the houses in the area are built very clo~e to the property lines. The house to the east is approximately 12' from the boundary line. In addition, the front and rear yards of most of the houses in the immediate area are to the north and south respectively, rather than east and west. November 9, 1979 CO~ENTS: Met Mr. Norman Reilly, builder, who is in charge of the R.O.W. change. The area in- volved is shown in the shaded portion of the sketch shown below with measurements from Mr. Reilly. The existing entrance is one way only in the 20 ft. R.O.W. The road section is stable~ apparently is bankrun~ has bluestone surface and does not appear to have any drainage problemm. The revised section will have the same kind of materials. The R.O.W. beyond the revision will be taken over by another property owner. The first 150 ft. of the road cannot be widened in the 20 ft. R.O.W. without removing trees which I do not think is necessary. The present road provides access for emergency vehicles. Fire trucks have used it, and in my opinion, it is satisfactory for the. small amount of traffic that will use it.
