Pursuant to Section 267 of the Town Law and the provisions
of the Amended Building Zone Ordinance of the Town of Southold, New
York, public hearings will be held by the Zoning Board of Appeals at

1.' STRICT APPLICATION OF THE ORDINANCE would produce prccticcl difficulties or unneces-

i967 when it Was purchased'by its p~esent oWners, Ronald W. and Mignon T. Ry~, who
also owned the adjoining p~rcel to the west. ~Through this purchase, Hr. and Hrs.
Rya~ un'intontion&lly merged the two parcels into one, and it' is this u~intended
merger which is sought to be reversed. ~
Without the gz~ting of a variance to set off the fifty foot p~rcel from the re-
'hinder of the lot, Mr. and Hrs. Ryan will be forced to hold, ~intain and sell as
one unit,, a plot having greater width than any other in the vicinity. Additionally,
strict application of the ordinance requiring a total of fifty feet in side yard set-
back w&~ld ~ake it impossible to erect any sort of structure on this plot which mea-
'sung, ~fifty feet overall. Through' strict construction of the zoning ordinance and
application of S~me to this parcel, the Town of ~outhold would prevent construction
of an attractive, well-designed home for a local business ar~ it would sharply de-
crease the value of a parcel of land which is and should be p~ime business property.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because, to the applicantS' own knowledge, it
is the.only la,reel to/have be~n unintentional!y merged with another through inadver-
tence a~ the time of purchase; If sUch'merger had not occurred, this application
would be Confined solely to the question of a side yard variance for a fifty foot lot.
As such, failure to ~nt a variance would be the ~ as.declaring.that.the 'lot cot~ld
not be utilized for any type of structure, and the value of this fine business prop-
erty would be drastically reduced.
3. The Variance would observe the spirit of ~he Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the laroposed use of this /mid by the appliemlts
is directly in line with the objective of creating and ~aintaini.~g a clean, well-
designed business district for the Town of Southold. The parcel of land which the
applicants desire to improve is no lesser in width than others in the vicinity and,
unlike ~any existing businesses, will provide appropriate off-street pa~king for
its owners and clients. This variance sill allow the utilization of a pri~e busi-
ness property in line with an increaning de~and for office space while preserving
the essential c~racter of the TO~n of Southold.
