Dated ...~./...1..~.~,].~ ................................................... (.) (X) ( ) REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinance isrequestedforthe ~asonthat final survey indicates that barn-storage building (n/w corner only) is located 43.3' from street line rather that 45' as requested and approved per original application dated 8/16/79. Form ZB~ (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practicoldifficultiesorunneces- sary HARDSHIP ~cau~ the barn-storage building had to be located at an a~gle from the street line to remain parallel to the waterfront and thereby not violate ~he D.E,C; requiremen~ to's~ 60' fro~ the waterfront. In a~diti°n~ the sidsyard requirement, of 20' had to be maintained. According to meast~ements made by the applicant and the owner, a street setback .of 45f was deemed necessary and was applied For, however final°surveys indicate that the actual setback is 43.3'. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because the only adjoining residence is that. of the .owners,. Itt. amd Mrs, Robert Gazza. The application ms to reduce the front yard setback from 45 to 43.3' at the north- west corner ef the structure (see~ attached survey). The variance herein applied for would not affect ~any ,ether~'residences in the immediate vicinity of this property or in this use district. 3. The Variance would observe the spirit ofthe Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the adjoining property ~o the west consists of unbuildable wetlands (owner unknown) and the adjoingng property to the east*also consists of unbuildable wetlands (owner unknown). Land te the north consists of Cedar Beach Road and to the south is waterfront, D~yad's Basin. * of the ownerst residence STATE OF NEW YORK COUNTY OF~¢~~/~ SS for North Fork Equities, Inc. a/~~a z za / ELIZABETH ANN NEVILL~ NOTARY PUBLIC, State of New No. 52-8]25850, Suffolk C~u. III~ Section 100-30, for permission to have a non-farm, barn'storage building as the main structure on a lot which is not permitted in an A-Residential and Agricultural Dis- trict, and a variance to the Zoning Ordinance for permission to construct said building with an insufficientfrontyard setback. Location of property: Cedar Beach Road, Southold, New York, known and ~designated as part of Lots. No. 21, 22, 23, 24, on 2. VARIANCE. (b) ~he har~-l~!p created (~) (iS not) unique and (would) (would not) be. shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE. (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE. and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. FORM ZB4 ZONING BOARD OF APPEALS After investigation and inspection, the Board finds that the applicant wishes to construct a non-farm, barn storage building as a sole structure On'the lot with insufficient frontyard setback of 45 feet from Cedar-Beach Road. The Board finds that strict application of the Ordinance would produce practical difficulties.or unnecessary hardship; the hardship created is unique and would n6t be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance.
