Tasker, advised the Board thae Mr. Annison was given the wrong forms for his appeal. He should have been given variance forms not special exception forms. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? (there was no response). I think the Annisons were here before. There were no questions that anyone wanted to ask them at that .time, were there? MR. TUTHTLL: I believe it ha~ been used for the same purpose in prior years, hasn't it? · THE CHAIRMAN: I think Bill Smith ha~ a carpenter shop there. The ~olnt was made this afternoon in discussing this appeal, this business is certainly similar to the one that existed before. It is not really identical though because one of the reasons the applicant is in this building now is because he had an'explosion in the cabinet shop. MR. TUTHILL: From the things he showed us, I presume he uses a lot of adhesives with formica tops and so forth. THE CHAIRMAN: He works with volatile materials. This was changed from a special exception application to a variance application for procedural reasons. If this were a use going into the B-1 general business district, it would require a special exception. Because it is SOUTHOLD TOWN BOARD OF APPEALS -4- February 8, 1979 in a B light district, they need a variance. I think the property was zoned B before the more sophisticated zoning of .the Town of Southol~_/ After investigation and inspection the Board finds that the appli- cant wishes to operate a kitchen cabinet showroom and workshop. Before the more sophisticated zoning ordinance of the Town of Southold was enacted, this was a permitted use in the zone.in which this property is located. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would pro- duce practical difficulties or unnecessary hardship; the hardship cre- ated is unique and would not be shared by ail properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. On motion of Mr..Gillispie, seconded by Mr. Tuthill, it was RESOLVED, that Colony Cabinets, Inc., (Robert Annison, as Agent), North Road, Southold, New York, be GRANTED permission to operate a kitchen cabinet showroom and workshop, as requested.
