STRICT AP,pLIC~, .TION OF THE ORDINANCE would produce practical difficulties or unneces- sary HA~DSHIPbecause these.t~o par. cels were ptu~hased as aepazate lots~ Lot 13~ (Village" ~me~) ~a~ ~ved w~t~ a s~-ngle family dwellLng while Lot 14(Oyster Pon; Hoed) was vacant although it too was zoned for a single family ~welling. Subse- quently, these lots were merged, by iaw,, into single ow~;~ By this applica- tion for a variance petitioner seeks, to have the property restored to its origina state of tW° separate ~ d[stinut':P._ar, bels. Presently, Petitioner. h. as entered in: a contract of sale fo~' t/~e h6use on V~llage Lane (subject ~o .~bta~n~ng the variance herein)~.;-has :no .present plans to sell the vacant.~X~.uel.~ The strict application of the zoning :ordinance would not only negate .the present contract of sale but perhaps all futLlre contracts because the petitioner would have to find a purchaser~willing to .Pttrc~ase the two lots with the understanding tha~ the vacant parcel ~ould not be me, roved. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because the other parcels in the ~amediate area were deveZoped prior to the amendment of the zoning ordinance. Without the variance the vacant parcel would be landlocked, unusable and unsaleable. Had these two parcels been owned by different individuals and not' merge~i into single ownership, 'the vacant parcel could be improved with a single family ~welling because it was a pre-existing use prior to the zoning ordiance amendment. The technical merger should not prevent this parcel from being devloped in the same manner as other properties in the immediate area. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because 1. ) There would be no increase in municipal services required~ 2. ) The danisty would not be increased anymore than would be permitted if the properties were in single and separate ownership[; 3.) Most of the houses in the immediate area are on plots of equal or lesser size than the vacant parcel. BENNETT, KAYE & SCHOLLY By : RobertJ~. Pape STATE OF NEW YORK ) ) SS ............ I am the owner of the adjacent property on Village Lane, having inherited it following the death of my mother, Tabea Hofmann, and my aunt, Meltta Hofmann (please note correct spelling and my correct address, as given above)· grounds: I oppose the granting of the petition on the following I feel that it was the original intent of the owner in purchasing the property, that it serve as adjacent land, to enhance the property, preserve the view, and not be built upon {by"property" here, I refer to the adjacent tract of land bordering upon the lot upon which the house resides). Generally, I feel that the principle of one-acre zoning is a very wise one, and should not be set aside lightly. The reasons given in the appeal do not appear to me, as an affected landowner, to be compelling. As a National Historic Site, great care must be given in an~. determination regarding ?op~rty within the wllage of Orient.
