tion for a variance petitioner seeks, to have the property restored to its origina

2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because the other parcels in the ~amediate
area were deveZoped prior to the amendment of the zoning ordinance. Without the
variance the vacant parcel would be landlocked, unusable and unsaleable. Had
these two parcels been owned by different individuals and not' merge~i into single
ownership, 'the vacant parcel could be improved with a single family ~welling
because it was a pre-existing use prior to the zoning ordiance amendment. The
technical merger should not prevent this parcel from being devloped in the same
manner as other properties in the immediate area.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
1. ) There would be no increase in municipal services required~
2. ) The danisty would not be increased anymore than would be permitted if
the properties were in single and separate ownership[;
3.) Most of the houses in the immediate area are on plots of equal or
lesser size than the vacant parcel.

Gentlemen:
I wish Oo state my views as strongly opposing the granting
of a variance in the matter of the enclosed petition.
I am the owner of the adjacent property on Village Lane,
having inherited it following the death of my mother, Tabea
Hofmann, and my aunt, Meltta Hofmann (please note correct
spelling and my correct address, as given above)·
grounds:
I oppose the granting of the petition on the following
I feel that it was the original intent of the
owner in purchasing the property, that it serve as
adjacent land, to enhance the property, preserve the view,
and not be built upon {by"property" here, I refer to
the adjacent tract of land bordering upon the
lot upon which the house resides).
Generally, I feel that the principle of one-acre
zoning is a very wise one, and should not be
set aside lightly. The reasons given in the
appeal do not appear to me, as an affected
landowner, to be compelling.
As a National Historic Site, great care must be given
in an~. determination regarding ?op~rty within
the wllage of Orient. In grant~ng this petition,
surely the Board would violate the spirit, if not
also the letter and the intent of the enabling
legislation.

contract vendees.
4. Survey No. "3" dated September 20, 1978 again
showing the location of the vacant land and the improved

We are the attorneys for the Estate of Jean F. Brown
and on behalf of the Estate are filing herewith an application
to the Board of Appeals ~for a variance to divide the Estate's
property into two (2) single family dwelling plots.
Enclosed herewith please find the original and two
(2) copies of the application for a variance together with
a copy of the Notice which was sent to the adjoining property
owners. Please note that attached to the Notice are the receipts
for the certified mail indicating that a copy of the Notice was
properly mailed to each of the adjoining property owners. We
