is requesfed fo~ the reason thor premises are a two family residence in B-1 Zone, which
two family usage' has been discontinued for over two years.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because residence was built before zoning by U. S. Government for
use by two families - and improvement cannot be used for any other reasonable
purpose. Purchaser purchased same at General Service Administration auction
as a two family residence per advertising brochure, and U. S. Government now
takes position that purchaser cannot withdraw bid. -- -
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because this was formerly officers' quarters
in a limited area of Fishers Island, and some houses are two family, two story
houses with a~ common dividing wa!l~ as this iq, and common wall cannot be
removed without destroying structure.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because this area was formerly U, S, Army or Coast
Guard officers' quarters, and entire area is developed with similar residences
in architectural style.

Dear Mr. Matthews:
In reply to your letter of March 27, 1979, please be advised as
follows:
The action of the Board of Appeals on March 1, 1979, was definitive
in as far as relief under Article XI, Section 100-118D. The necessary
bulk and area variances are implicit in this action. If you will re-
call there was a discussion at the hearing concerning the subdivision
of the property, however no action on this was taken because applica-
tion for subdivision was not made in the legal notice or the original
disapproval from the Building Inspector.
In view of the above, I am enclosing herewith a disapproval from
George Fisher, Senior Building Inspector, together with the necessary
variance forms and notices to neighbors necessary for completing an
application for the above described bulk and area variances. This new
application will be placed on the May 22, 1979, agenda if you are able
to complete the paper work by May 3, 1979.
If we can be of any further help, please do not hesitate to call
our office.

Re: Appeal of Roger and Annette Betty Barmache
This will acknowledge receipt of the action of the Zoning Board of Appeals
of the Town of Southold, Appeal No. 2520, said decision being dated
January 31, 1979, which was approved March 22, 1979.
At the time of the hearing, there was a verbal decision granting the relief
requested in the appeal. The decision which I have just received apparently
reinstated only the non-conforming two family use.
The relief requested not only requested the reinstatement of the pre-existing,
non-conforming use as a two family residence but also requested the necessary
area width and side yard and rear yard variances, as well as permission to
subdivide the subject premises into two single and separate one family
residence lots with the dividing line running through the center of the common
wall between the existing apartments, both of which have their own p~rivate
entrances.
There was no mention in the decision of the granting of this right to sub-
divide, nor was there any mention of area and yard variances.
Conceivably the side yard and rear yard variances are covered in the re-
instatement of the non-conforming use. However. I feel there should be a
specific mention of the right to subdivide into two separate and distinct lots.
If you concur with me thai there should be a specific mention of the right to
subdivide and the yard variances specified, would you kindly have the decision
revised to cover these specific points?

Disapproval Notice for Certificate of Occupancy you requested.
Unless you can establish a continued use with less than a
two year non use you will be required to apply for a variance
for a re-instatement of this non-conforming use ( Article XI,
