By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because (SEE REVERSE SIDE) practical difficulties or unnecessary (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because (SEE REVERSE SIDE) (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) (SEE REVERSE SIDE) and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. FORM ZB4 After investigation and inspection, the Board finds as follows: The subject premises is known as Corey Creek Estates, Lot No. 15, containing approximately 25,000 square feet in area. Applicant requests an insufficient frontyard setback of 35' feet off Corey Creek Lane, due to the limited practical area in which they are left to build. A substantial portion of the property is covered by upland meadow. The Board agrees with the reasoning of the applicant. The Board finds the circumstances present in this case unique, and that strict application of the ordinance would produce practical difficulties or unnecessary hardship. The Board believes that the granting of a variance in this case will not change the character of the neighborhood and will observe the spirit of the ordinance. On motion by Mr. Tuthill, seconded by Mr. Grigonis, it was RESOLVED, that AUDREY E. WANZOR, by William B. Smith as agent, be granted a Variance to the Zoning Ordinance as requested in Appeal No. 2701, SUBJECT TO THE FOLLOWING CONDITIONS: (1) Approval of the N.Y.s. Department of Environmental Conservation; (2) Compliance with the requirements and regulations of the Flood Damage Prevention Law of the Town of Southold. Build a one family house on a waterfront lot containing 28,010 square feet of which 12,200 square feet is salt marsh and meadow, spartina patens. The lot is now vacant other than small wild cherry trees, poison ivy and sumac growth at the beginning of the upland. The lot at the proposed'house site is approximately seven feet above sea level. The property slopes from elevation of 9+ feet at Corey Creek Lane to 2 feet at the edge of the salt meadow for a distance of approximately 12~ feet. The elevation of the meadow 2+ feet comtinues to the high water of Corey Creek as indicated on the attached plot survey, exhibit #l. Request for cat walk over meadow and 16 foot dock parallel to meadow embankmen' is deleted from this construction application. 2. Where there are no trees on. the house site there will not be any disturbing of the meadow line growth or meadow other than to remove the poison ivy and sumac. Fill and top soil will be im- mediately seeded and sodded at the completion of construction. No eroded material will be allowed to enter into the meadow during construction or thereafter. 3. There will be no adverse environmental effects to the area when this p~uject is implemented. The sewer system has been laid out by the Suffolk County Health Department standards and meets all the'requirements of that agency, including distances to meadow and tidal waters. 4. As this action is for building a one family house with the necessary utilities, there are no alternates to the project other than the alternative of no construction which denies the applicant the use of his property. 5. There are no commitments of resources other than using well water for the usual one family dwelling and' the construction materials necessary for the project. 6. There will be seeding or sodding of all upland, including fill and the planting of shrubs and trees normal to a ohe family dwell- :ing to mitigate potential of eroded material from entering the sal~ marsh or adjacent waters of Corey Creek. 7. There will not be any growth-inducing aspects to this project which is a proposed one family dwelling. 8. This one family dwelling will have a total solar heating using hot air system with collectors with stone and masonry for storage of heat. The back up system will be electric heat supplied by the Long Island Lighting Company. 9.
