Location of properties: Southwest side of Horton's Lane, Southold; bounded northeast by Horton's Lane, southwest by Jennings, northwest by Romeo, Laria, Czelatka, Corwin, Sepenoski; southeast by Conway; County Tax Map Item No. 1000-54-7-18. (SEE REVERSE SIDE) 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because (SEE REVERSE SIDE) practical difficulties (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because (SEE REVERSE SIDE) (c) The variance (does) (does not) observe the spirit o! the Ordinance and (would) chan~e the character of the district because (SEE REVERSE SIDE) (would not) and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous derisions of the Building Inspecter ( ) be confirmed ( ) be reversed. ., FORM ZB4 After investigation and inspection, the Board finds that applicant is requesting approvaLof an'access road, which is presently 50-feet in width and appears to be access- ible for four lots in the'"Minor'SUbdivision'of'Louis Ramunni" granted by the Planning Board May 30, 1973. The Board feels that applicant's request for approval of access is not unreason-' able and certainly agree to the gr~nting.thereof. The Board finds that the circumstances present in this case are unique, and that strict application of the law would produce practical difficulties or unnecessary hardship. The Board believes that the granting of a variance in this case will not change the character of the neighborhood and will observe the spirit of the ordinance. On motion by Mr. Grigonis, seconded by Mr. Douglass, it was RESOLVED, that LOUIS and CARMELA RAMUNNI, Road, Melville, New York 11746, be GRANTED approval of access pursuant to New York Town Law Section 280A, SUBJECT TO THE FOLLOWING CONDITIONS: (1) That such access_road have a width ofnot less tkan 50 feet, and shall be cleared of all trees, brush and other obstructions to a width of 15 feet. 691 Walt Whitman (2) That such access road be improved 15-feet wide in EITHER of the following methods: (a) Surfaced with a minimum depth of 4 inches of packed 3/4-inch stone blend so as to afford access for emer- gency and other vehicles. Such stone blend may be either applied to the ground surface and shaped, or the surface may be excavated to permit the application of packed blend to a depth of 4 inches; OR (b) Top soil shall be removed to a depth of 8 inches and then filled with 8 inches of good-grade stone and sand bank run. The surface shall then be covered with a layer of 2 ~o..~4 inches of 3/4 stone blend, or in the alternative oiled with a minimum of 4/10the of a gallon of road oil per square yard. (3) Where the terrain of the land over which such access road is such that drainage problems may occur, applicant shall be required to construct drainage facilities to correct same as may be recommended by the Town Building Inspector or Town Engineer. (4) Ail work required as hereinbefore set forth shall be performed under the supervision of the Town Building Inspector and no building permits or certificates of occupancy shall be issued until same has been certified by the Town Building Inspector that such access road has been constructed in accord- ance herein. (5} The Board of Appeals may in ~ts~discretion make reasonable exception as it deems appropriate to the subject circumstances, by formal resolution and proper notification to applicant herein. Re: Appeal No. 2708 - Louis and Carmela Ramunni Mitchell to Goldstein Dear Mr. Pepe: Pursuant to your recent telephone call, your inquiry as to whether the full 150' frontage of the southwesterly parcel (1000-54-7-18.4) is required to be paved for access was referred to the Planning Board on August 3, 1982 for their comments. The Planning Board has determined this matter to be within their jurisdiction inasmuch as the right-of-way is within the subdivision. We are enclosing a copy of the Planning Board letter dated August 4th to our Town Engineer, Mr. John W. Davis. If we may be of further assistance, please don't hesitate to call. During 1980 the building department referred this for 280-a although the r-o-w is within the subdivision. In granting this approval of access, several conditions were placed, No. (1) being that "...such access road have a width of not less than 50 feet, and shall be cleared of all trees, brush and other obstructions to a width of 15 fee~." Condition No. (2) requires "...such access road be improved 15-feet wide in either of..." two methods. The last sentence in the second paragraph of your letter indicates that you are seeking to permit access from the Private Road through the Proposed Road (indicated on the enclosed survey at Liber 8834, page 480 you submitted) of a width of no greater than fifteen (15) feet for the required pavement/improvements. The requirement of this board for the pavement/improvements (Condition NO. 2) is for a~minimum width of fifteen (15) .feet. As you will undoubtedly recall, an inquiry was made with respect to the required width of access to the parcel as above-cited. A careful review of the survey, as enclosed, indicates that the roadway~ marked "Private Road", has a varied width of fifteen(15)feet, as per Appeal # 2708 (July 1, 1980). This variance apparently only covers that portion of the road leading into the subject parcel. My clients, on the other hand, seek a determination as to the width of the roadway passing through that portion noted as "Proposed Road".
