RIGHTER, 184 Livingston Street, New Haven~ Connecticut 06511, for a variance to the zoning ordinance, Article VII, Section 100-71 and Bulk Schedule, for permission to construct addition with insuf- ficient front and rearyard setbacks. Location of property: North side of Greenwood Road, Fishers Island; bounded north by F~I. Ferry District. east by Baird, south by Greenwood Road, west by Woolston~ more particularly known as #10 Greenwood Road, County Tax Map Item No. 1000-12-1-part of 13. (SEE RE%tERSE SIDE) ~?. VARIAi~CE. By resolution of the Board it ¥;as determined %hat (a) Strict application of ~e Ordinance (~uld) (~vou/d not) produce hardship because (SEE REVERSE SIDE) practical difficulties (b) The hardship created (is) (is not) uulque and (would) (wou!d net) be shared by all properties alik~ k: the Ln~ediate vich~ity of [his property and in ~he same use dis%rte% because (SEE REVERSE SIDE) .'c) The var~nce (does) (does not) obser%~e the spir~ of the Ordinance and (would) change ~e character of the district becaus~ (would not) (SEE REVERSE SIDE) ~d lherefere~ ii was £ar~er determined that the requested variance ( ) be geanted ( ) be denied and that the previous decisions of the B,Jilding Inspector ( ) be conf~med ( ) be reversed. FOR~ ZBI After investigation and inspection, the Board finds that the applicant is requesting permission to construct: (a) an addition with insufficient rearyard setback of 20' from the rear line, and (b) an addition with insufficient frontyard setback of 27' from the front line. The Board has found that the property is approxi- mately 100' x 95' with an existing structure approximately 38' by 48'. The Board agrees with the reasoning of the applicant, and feels that the additions will enhance the appearance of this building and the general neig~hborhood. The Board finds that the circumstances present in this case are unique, and that strict application of the ordinance would produce practical difficulties or unnecessary hardship. The Board believes that the granting of a variance in this case will not Change the character of the neighborhood and will observe the spirit of the ordinance. On motion by Mr. Doyen, seconded by Mr. Tuthill, it was RESOLVED, that JAMES V. RIGHTER be granted a variance to the zoning ordinance, as applied for in Appeal No. 2706, per- mitting the construction of two additions, one with a rearyard setback of not less than 20 feet and the other with a frontyard setback of not less than 27 feet.
