ZONING BOARD OF APPEALS
On motion by Mr. Grigonis, seconded by Mr. Douglass,
WHEREAS, on August 26, 1980 this Board received a formal
request of applicant to consider an amendment to its decision
of July 1, 1980; and
WHEREAS, this Board held a re-hearing on September 25,
1980 "to reconsider the decision of this Board made on July l,
1980, wherein applicant requested permission to display and
store openly boats and marine items outside of enclosed build-
ings,'' after duly posting notice therefor;
WHEREAS, the Board determines that by granting of
similar relief: (a) the orderly and reasonable use of
adjacent properties or of adjacent use districts will not
be prevented; (b) that the health, safety, welfare, con-'
venience, comfort and order of the Town will not be adversely
affected; (c) that the general purposes and intent of the
zoning ordinance will be observed; (d) the plot area is
sufficient, appropriate and adequate for the reasonable use
and anticipated operation thereof as planned herein;
NOW, THEREFORE, BE IT RESOLVED, that Dolores Strong,
Camp Mineola Road, Mattituck, New York be granted a Varian
to the ZOning Ordinance for permission to openly store boa
and related marine items outside of enclosed buildings SUB
JECT TO THE FOLLOWING CONDITIONS:
(1) That applicant obtain SOuthold Town Planning Boa
approval of the off-street parking plan pursuant to Articl
XI, Section 110-112 (100-112 sic) of the Southold Town Cod
(2) That display of boats and related marine items b
permitted only within five feet from the southerly propert
line for a length not exceeding the length of the stucco
building plus tweive feet at the east side, for a total of
a.pproximatelY 62 feet long;
(3) That a wooden split-rail fence be erected and ma
rained in the frontyard area bordering the area to be util
zed
for display or storage of marine items; said fence not to be
located closer than five feet from the southerly property line;
(4) That the Main Ent'rance~of the stucco building will
be either at the side or rear of the stucco building;
(5) That the existing front entrance of the stucco build-
ing be used only for emergency purposes;
(6) That the westerly side of the stucco building will
remain open and unobstructed at all times [never to be used
for storage or display];
(7) That the easterly side of the stucco building will
remain open and unobstructed for a minimum of 10' for egress
and ingress [never to be used for storage or display];
(8) That a directional "PARK IN REAR ONLY" sign be
placed on the split-rail fence, not to exceed the size two
feet by four feet;
(9) That this matter be reviewed, by the Suffolk County
Planning Commission pursuant to Section 1332 of the Suffolk
CountY Charter.

is requested for the reason that, applicant
boats and marine, items desires to openly display and 'store
and mmrine items other than in a fully enclosed building.

REASON FOR APPEAL

1. STRICT APPLICATION OF THE ORDINANCE would pr~uce practical difficulties or unneces-
sary HARDSHIP ~cau~ to conduct the business of retail sale of boats
and marine items without the right to open storage and display of
such items on the premises, would result in substantial practical
difficulty in the operation ~f the applicant'~ business. A retail
operation of~the ~atUre of the applicant's business requires the
storage and display of its boats and related marine items outside
of fully enclosed, buildings.
2. The hardship createdis UNIQUE and isnotshared by oil properties alike in the immediate
vicinity ofthis property end in this use district because the open display of boats and
marine items is peculiar to, the type of business operated by ~he
applicant. This uniqueness is not share~ by other commercial prop-
erties in the immediate vicinity of the subject premises.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the District and the us~s t[~d~rein are
conxnercial in nature. At the present time, the applicant is conduct-
ing a retail business identical to that now requested with respect to
the subject p=operty. The spirit and intent of the Ordinance Will not
be affected by.the granting of the variance requested, since £t,..merely
involves a relocation of the existing use to a location almost directly
opposite the present area of use. Without the grant of the variance
requested, the applicant would be compelled to conduct her business in
a "C" Light Industrial Area, the existence of such area not being con-
ducive to the type of the business now conducted by the applicant.

Dear Ed:
In reply to your letter dated April 21, 1981 asking
specifically which conditions are not being met concerning
the above appeal, please be advised as follows:
Condition No. 3 has not been complied with.
Condition No. 4 has not been complied with
Condition No. 5 has not been complied with, and it is
our recommendation that a "panick'lever" opening from the
inside be utilized. (Also, it has been noted that 'the front
doors have been open during the entire weekend of April 18th,
entirely in violation of the 'emergency-use' only condition.)

Please be advised that the following action was taken
by the Southold Town Board of Appeals on Thursday, October 16,
1980:
RESOLVED, in the matter of Dolore.s..St.rong, Appeal No.
2710, and Decision of this Board made September 25, 1980 and
filed October 9, 1980, that Condition No. 2 be revised as
follows to reflect the correct mathematics and coincide with
Condition No. 7:
(2) That display of boats an.d related marine items be
permitted only within five feet from the southerly property
line for a length not exceeding the length of the stucco
buildin, g plus ~ight feet at the east side, for a total of
approxlmatel),58 feet long.

MEMBER DOUGLASS: Because it was Stevenson that closed it
off. Stevens, or whatever that closed it off.
MR. SMITH: Well, I am hopeful that you may grant the
variance; and it was suggested to me that it was the better
way of proceeding to simply go forward with our work, rather
than trying to prove that a road was there. I'll tell you
personally that I think that if there ever was an easement
over in front of the present Wainer property for vehicular
traffic, that it probably has been extinguished. I would
not argue the same with respect to my house, but I would
prefer not to have to go through the argument.
MEMBER DOUGLASS: I was just wondering if you had the
information, or if you had found it anywhere, because if you
had found it somewhere, why it still would be in existence.
MR. SMITH: Yeah, but it's--unless I have to do it, I,
~t's not worth all that--

vote for a resolution closing the hearing and reserving

The Chairman opened the hearing at 8:53 p.m. by reading
applicant's attorney's request of August 25, 1980 requesting
that the Board further amend the decision of this Board.
MR. CHAIRMAN: Mr. Cron?
RICHARD J. CRON, ESQ.: If it would please the Board. · The
original variance as it was granted by the Board granting the
right to openly display boats and related marine items at the
subject property, imposed as the Board well knows a condition
providing for a 25-foot setback from the street line at which
the display of items could not be permitted. The review of that
decision necessitated our contacting the Board and asking the
Board for the relief that we have requested in our letter to
extend the area in which we could openly display boats and
marine items. The area that the Board, that the restriction
imposed was insufficient to do just that. The Board on its
motion as indicated in that letter amended the condition'to
provide that, if I recollect, that you permitted to openly
display boats and related marine items within eight feet from
the southwest line and 10 feet from the southeast line. I
pretty much followed that thinking when I wrote to you and
requested an extension on those lines from 15 to 17 feet.
However, I would like to point out to the Board that really
those figures should be reversed. The longest distance is
on the southwest line and the shorter distance to the street
line is on the southeast line. So really the distances
should be reversed the other way around. The 17 feet that
we have requested if that were to be granted should be on
the southwest side; and the 15 feet basically on the south-
east side. If you will look at the survey, if I recall, the
southeast corner to the Main Street is a distance of 30 feet,
whereas the distance from the southwest corner of the Main
Street is 34 feet. So I think it would make more sense to
reverse the distances, that we have a greater distance to
play on the southwest line than we do on the southeast line.
Notwithstanding our request qn that letter, if at all
possible we would ask the Board to consider granting us as
much area, even greater than that which we requested in our
letter, as close to the sidewalk line as we can possibly go,
and that's reasonably feasible. In no event however less
than the 15 and 17 feet that we'requested with the lines
however reversed. We ask the Board to give us that recon-
sideration if you could, knowing the type of items that have
to be displayed--the particular boats that are going to be
displayed, we still would find it awfully tight to properly
display those items to the public so as to engender their
interests in purchasing these things, by a distance of 15
and 17 feet. We really need a greater distance than that

if the Board determines that to be feasible. I don't think'
it's necessary to go into all the reasons why. We had gone
into this on the intial application in terms of the granting
of the original variance; but the point is we've got to have
as much area from the building line towards the sidewalk line
as is reasonable in order to properly do what we want to do
on the subject premises. I'd ask the Board to be as reason-
able and as fair as they can to extend the area in which we
can operate.

Is there anyone else to speak
DAVE STRONG: Yes. I'd just like to--I know we've been
over this before, but in addition to these things, I have
spoken to a couple members of the Board, and we do intend to
have an access door in the rear and on the east side of the
building so that people may park in the back and will not
have to walk the way around to the front. Just one thing
to what Mr. Cron said, it's not so much the footage of the
thing, and I think we're all aware of displaying the boats,
if it were feasible to get it--we're not trying to overrun
the sidewalk or anything like that--a reasonable limit, yes.
Just by the nature of the beast, and there is no set size
in a boat, it's awful hard to limit and say you have "x"
amount of feet. And so I'm certainly going to appreciate
any help we can get and the greatest distance that we're
allowed--and it's certainly not going to all come out that
way. It's going to be staggered naturally. Aside from
that, that's about all I have to add.
MR. CHAIRMAN: Thank you. Is there anyone else? Does

Applicant - Dolores Stror~
Dear Sirs:
On July 8, 1980, the undersigned requested that the Board
modify its decision dated June 9, 1980, with respect to the Con-
dition numbered (2) therein.
As a result of our request, the Board by resolution adopted
July 9, 1980, at a Special Meeting, amended its resolution of
July 1, 1980, so as to grant further relief to the Applicant.
Unfortunately, the relief extended was foumd to be insufficient
by the Applicant in the light of the intended use of the
property.
It was thereafter determined that before any further relief
could be granted the Applicant there had to be submitted to the
Southold Town Planning Board an o££-street parking plan. This
has now been submitted and approval thereof secured from the
Planning Board.
In the light of the fact that the Planning Board does not
require any off-street parking in the front area of the building
(all off-street parking to be provided in the rear), it is re-
spectfully requested that the Board further amend Condition
No. (2) as adopted by resolution dated July 9, 1980, as follows:

marine items be permitted within fifteen (15') fee~ from
the southwest front and within seventeen (17') feet from

may not be enough open space to be considered. Mr. Noyes said
the intent of FIDCO is to stay with this plan as they have been
right along. ~
Mr. 0'Neil asied if elimination of open development meant
going under zoning and Mr. Raynor answered in the affirmative.
Roads were discussed'andMr. Raynor said it wasn't the intent to
pave over the island. Mr. Noyes said they couldn't afford it.
Mr. Raynor offered any help that the office can give to the
FIDCO people. Mr. Wall was referred to for help on the island.
On motion made by Mr. 0rlowski, seconded by Mr. Latham, it was
RESOLVED to approve the proposed off-street parking of
Dolores and David StronE for property formerly knownas "Black
~Forest Restaurant" on map presented August 12~ 1980.

RESOLVED, that Condition No. (2) in this Board's
resolution as adopted July 1, 1980 be amended to read
as ~ollows-.
- (2) That storage.or display of boats and related
'marine items be permitted within eight [8"] feet from
the sOuthwest front and within ten [10'] feet from the
southeast front, a length not exceeding 77 feet, of the
existing "one-story stucco restaurant" noted on the survey
dated October 7, 1968 submitted with the subject applica-
tion.
Vote of the Board: Ayes: Messrs. Grigonis, Douglass
and Tuthill. Messr. Goehringer abstained. Messr. Doyen

'~A~ter investigation and inspection, the Board finds as follows:
The subject premises contains approximately 25,000 square
feet, a~d existing on the premises are an one-story stucco
building, formerly used as a restaurant, and an one-story
building towards the center of the premises which apparently
has recently been utilized as living quarters. Applicant
requests permission to store boats and related marine items
outside of buildings for display purposes.
The Board determines that by the granting of such relief:
(a) the orderly and reasonable use of adjacent properties or
of adjacent use districts will not be prevented; (b) that
the health, safety, welfare, convenience, comfort and order
of the Town will not be adversely affected; (c) that the
general purposes and intent of the zoning ordinance will be
observed; (d) the plot area is sufficient, appropriate and
adequate for the reasonable use and anticipated operation
thereof as planned herein. The Board agrees with the reason-
ing of the applicant.
On motion by Mr. Douglass, seconded by Mr. Grigonis, it
was
RESOLVED, that DOLORES STRONG, Camp Mineola Road, Matti-
tuck, NeWyork, be GRANTED a Variance to the Zoning Ordinance
for permission to openly store boat and related marine items
outside of enclosed buildings, SUBJECT TO THE FOLLOWING CON-
DITIONS:

approval of the off-street parking plan pursuant to Article
XI, Section 110-,112 (100'112) of'the Southold Town Code;

Dear Sirs:
In reviewing the decision of the Board relative to the
above captioned dated July 3, 1980, we note with respect to the
condition numbered (2) that no storage or display of boats and
other items shall be permitted closer than 25 feet from the
street property line (Route 25).
In discussing this matter with our client, it has been
determined that this particular condition will cause substantial
difficulty with respect to the proposed storage and display of
boats and marine items. A review of the survey attached to the
application indicates that a distance of 30 feet exists on the
easterly boundary of the property from the building line to the
street line, and on the westerly side the distance of 34.8 feet.
In the application of the 25 foot limitation this would
leave an area for display and sto~age of only 5 feet on the east
line and approximately 9 feet on the west line. Unfortunately,
this would be inadequate for our client's purposes.
In the spirit of what was intended by the application we
would respectfully request that the Board reconsider this condi-
tion hy amendment thereof, on the Board's own motion, as follows:
"(2) That no storage or display of boats and items
be permitted closer than 15 feet from the street
property line (Route 25)."
