Instructions: The application to the Building Inspector includes {each

posed work. The application must give complete information to show that
the proposed c~u comply to the Local Law No~ 1-1980~ Chapter 46 of the
Code of the Town of Southold known as "Flood D~uage Prevention Law~ of the
Town of Southold~ The applicant must submit approvals that any other
agency requires.
General Standards as required in Section 46-17 of the law to minimize flood

B. Use of construction material and methods

The applicant must s~omit plans and specifications as well as any other
information requested by the Building inspector to substantiate the facts
that the structure has or will have the lowest floor, including basement/
cellar, elevated above the base flood elevation or~ if permitted by the
Federal Regulation, that: 1. such structure is flood proofed in such
manner that below the base flood level the st~cture is water tight with
walls substantially and impermeable to the passage of water, 2. that
structural components are capable to ~esisting hydrostatic ~ud hydrod~u~auic
loads and effects of buoyancy, 3o applicant must s~omit certification by
a registered professional engineer or architect that the standards set
forth in Section 46-18B (1) (2) {3) of the Southold Code are satisfied~

specifications ~ncluding the required certifications and such other

Variance to Construct Lowest Floor Four Feet above
Mean Sea Level at Wiggins Lane, Greenport, NY
Dear Mr. and Mrs. Stetler'
On December 4, 1980 the Board of Appeals held a public
hearing concerning your variance and unanimously decided
to reserve decision within 45 days. The reason for their
not making a decision last evening is due to the fact that
they have been advised that the Town Engineer is in the
process of eliminating the 8-foot elevation in the flood
areas designated "A", as is your property, through the
Federal Emergency Management Agency in Washington, D.C.
Normally, if variances to the Flood Damage Prevention
Law are approved, they are approved subject to several
conditions:
1. That the basement be flood proofed so that
below the base flood level the structure is watertight
with walls substantially impermeable to the passage of
water;
2. That the floodproofing requirements be
certified by a registered professional engineer or
architect as meeting the standards set forth in the
preceding paragraph hereof;
3. That such engineer's certification be filed
with the Offices of the Board of Appeals and the Build-
ing Department;

4. That prior to the commencement of construction,
the applicant apply for and obtain a development permit
from the Town Building Inspector pursuant to the provisions
of the Flood Damage Prevention Law.
The Board requests whether or not you wish to wait through
the 45-day reserved decision period when the changes in the
flood areas designated "A" may be finalized by the Federal
Government, or perhaps whether or not you would prefer to have
the Board make a decision at their next conference, which would
be about December 20, 1980.

Pursuant'to Section 617.13 of the New York State Environmental
Quality Review Act (SEQRA), Article 8 of the Environmental Conser-
vation Law, and Section 44-4 of the Southold Town Code, the South-
old Town Board of Appeals has determined the following-described
project is classified as a Type II Action, not having significant
adverse effects upon the environment. Pursuant to Section 617.5(a)
of the New York State Environmental Quality Review Act, no further
determination or procedure is~ required herein. This declaration
should not be considered a determination ~made for '~ny other dePart-
ment or agency which may also be involved or any other project not
covered by the within application.
Applicant has submitted an environmental assessment in the short
form which indicates that no adverse effects were likely to occur to
the environment.
The~Subject property is located within 300 feet of tidal wet-
lands; however, constructed along the water, lying edge of this
