SCTM Nos. 1000-62-01-19 & 1000-62-1-11.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 20, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The property consists of two lots located at 55135 Route 25(Main Road) and 315 Boisseau Avenue, Southold,N.Y. The overall size of the property(both lots) is 111,048 square feet(2.549 acres). Together,the northerly property line measures 524.76 feet and borders the residential co-op community of Colonial Village,the easterly lines measures 333.48 feet along Boisseau Avenue,the southerly lines measure 529.79 feet which runs along Route 25 (Main Road) and the westerly line measures 320.00 feet along the entrance to the residential co-op community of Colonial Village. The parcel is owned by the Southold Fire District and is improved with a two story brick Fire House with garages, outside storage buildings, a two story residence(which has already been removed) and large paved parking areas for members of the Fire Department and Emergency Services to park. Furthermore,the property is located in the Hamlet Business District as shown on the survey prepared by Nathan Taft Corwin III;L.S., last revised on March 30, 2018. BASIS OF APPLICATION: Request for Variance(s) from Article X, Section 280-46 and the Building Inspector's April 2, 2018 Notice of Disapproval based on an application for a building permit to construct a storage building; at 1) less than the code required minimum side yard setback of 10 feet; located at 315 Boisseau Avenue and 55136 Route 25 (Main Road), Southold,N.Y. RELIEF REQUESTED: The applicant requests a variance to construct a storage building at the location of 55135 Route 25 (Main Road) and 315 Boisseau Avenue, Southold, N.Y., SCTM1000-62-1-19 & 1000-62-1-11.1. The proposed storage building, on a conforming lot in the Hamlet Business District, is not permitted pursuant to Bulk Schedule, which requires a minimum side yard setback of 10 feet. The construction has a minimum side yard setback of+or— of 5 feet. Lots 62-1-19 and 62-1-11.1 will be merged. The proposed new building will be a 60 Page 2, June 21, 2018 #7179, Southold Fire District SCTM No. No. 1000-62-1-19.1 foot by 54 foot accessory garage with mezzanine on a flat surface. The wall height will be 18.7feet and the roof height will be 29.2 feet. The new building will replace two smaller, older structures and accommodate large emergency vehicles and equipment. The frame house has been removed from the easterly end of the property to allow for vehicle access to the proposed accessory garage as well as turn maneuvering of large equipment as shown on the survey last revised on March 30, 2018 by Nathan Taft Corwin I11, and the site plan drawings prepared by Martin F. Sendlewski, A.I.A. The new building will be able to store large emergency equipment so it can be sheltered from the elements and public view. ADDITIONAL INFORMATION: The applicant's attorney provided the Board with a supplement identifying a balancing test mandated by New York State Law, describing a Fire District as a government entity. Under state law In the Matter of the County of Monroe, 72NY2d 338 (1988), a balancing test is mandated when one municipality seeks to undertake action which conflicts with the rightful laws of another municipality. In this case, as in most, the question is whether the Southold Fire District may be immune from the zoning regulations which pertain to the application and its denial by the Southold Town Building Department. The Attorney for the Fire District has provided the Zoning Board of Appeals of the Town of Southold with the criteria which is used in the "Monroe Test"which requires a balancing by the parties to the public interest in determining whether or not it is in the public interest to subject the Fire District to the Town's zoning requirements. The submission addresses all of the nine factors included in the Monroe Test which, as the applicant's attorney asserts, the District has met its burden. The submission also includes associated case law and legal memorandum. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 7, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance or will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject neighborhood is zoned hamlet business and there are many retail and commercial business along Main Road. There are also residential properties on Main Road and on Boisseau Avenue which is a side street that provides a second street frontage for the applicant. The Southold Fire Department has been in this location for many years. They purchased the new residential tract of land fronting on Boisseau Avenue because it is immediately adjacent to their Main Road property and it will allow space for a new accessory storage building and also permit the installation of new Fire Department fueling facilities as well as vehicular circulation on the site and a second safe means of ingress and egress for vehicles, and emergency and firefighting equipment. The house that was on the Boisseau property has been removed and relocated across the street. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed location allows for easy access and the option of more than one route to enter and exit the property in order to respond to emergencies. The location of the proposed storage building enables the storage of large pieces of fire apparatus, and the ability for large equipment to be maneuvered and exit the property when needed to perform emergency services to the community. The Fire House is vital to the health and safety of all the residents and visitors to the area when emergency services are needed. It is also important to the local responders to have easy access for their vehicles and then be able to maneuver the emergency vehicles when an emergency response is required. 3. Town Law X267-b(3)(b)(3). The variance granted is mathematically substantial, representing 50% relief from the code. However, the two small buildings to be removed were also located in close proximity to the property Page 3, June 21, 2018 #7179, Southold Fire District SCTM No. No. 1000-62-1-19.1 line. The new storage building will be in the same location and with the same non-conforming side yard setback of + or — 5 feet. The adjacent property contains a commercial construction/lumber business that is screened by an existing fence and whose operation will not be affected by the proposed improvements. By removing three structures from the total property and replacing them with one large structure, less lot area will be affected. Finally, based upon the intended purpose of the storage building, there is no other practical location available. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The Southold Fire Department has been in this location for many years, is essential to the neighborhood and the public interest will be served by the proposed improvements. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase However, over the years the community has grown in population and local and tourist traffic has increased. The Fire Department now needs a second means of ingress and egress to the site to be able to best respond to emergencies. In addition, disrupting the current parking area in order to construct the proposed storage building in a conforming location would have negative impacts on the ability of the Fire Department to maneuver large equipment on the site. 6. Town Law V67-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a providing vital emergency services and housing for emergency vehicles and equipment while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Planamento, and duly carried, to GRANT the variance as applied for, and shown on the survey prepared by Nathan Taft Corwin III, L.S., last revised March 30, 2018. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Leaders and gutters shall be installed on the accessory structure to prevent any adverse stormwater run-off. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. PROPERTY FACTS/DESCRIPTION: The applicant's 219 acre site is improved with a firehouse with 40 ft. high tility pole with siren, a fire hydrant, roof access stairway, masonry garage, flagpole, and other improvements as shown on the site plan prepared by William F. Collins, A.I.A. dated 12/11/02, revised 6125/03 (ref, survey prepared 11/18/02 by Barrett, Bonacci and VanWheele, P.C.). BASIS OF APPLICATION: Building Department's May 25, 2004, Notice of Disapproval, citing Code Section 100-162B.3 in its denial of a building permit application concerning a replacement of a wireless communications antenna and related equipment, for the reason that the proposed antenna (measured at 60 feet) projects higher than 20 feet above the average height of buildings, which is 23 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on July 15, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to replace the existing 40 ft. high wooden pole with a new wireless telecommunications facility monopole at 60 ft. in height, on a 10' x 12' concrete pad, behind the firehouse along the northeast rear wall section. The property contains a firehouse and related equipment for emergency. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant is licensed by the FCC. The 60-ft. high tower will replace existing SFD 40-foot wooden pole. No testimony was presented to refute this statement. With regard to the design elements of the structure, the applicant's testimony confirmed that a "flagpole" design would reduce coverage, be twice as costly, and would prohibit the company from future heightening of the pole. A flagpole design was stated would require an additional 10' to 20' in height to ensure the same coverage as the pole design. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's expert witness, Nicholas Balzano, Radio Frequency Engineer, testified that there is a significant service gap in the Southold area, and that the height and location of the antenna is required to eliminate the gap. The gap affects coverage for the public, as well as police, fire, ambulance and emergency response personnel in Southold. 3, The variance granted herein is substantial. The height of the new tower would exceed the code limit by 17 ft. (23' existing tree line plus 20 ft. allowed above code = 43 feet), for a 60 ft. height. 4. The difficulty has been self-created, as a result of the applicant's desire and need to replace the existing structure at a height which exceeds the code limitation of 43 feet, in this Hamlet Business (HB)Zone District. 5. No evidence has been submitted to suggest that the requested variance in this community of commercial and residential uses will have an adverse impact on the physical or environmental conditions in the neighborhood. There was no opposition to the wireless telecommunications facility, either written or oral testimony, presented in this matter. The benefits to the community of improved service and ensuring public safety outweigh the affects of the variance. 6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a 60' wireless telecommunications facility, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The application is for an area variance, specifically,the siting of a permitted accessory building with a required side yard setback. The purpose of this communication is to supplement and amplify the District's oral application to this Board. More particularly the purpose is to clearly and concisely set forth those factors that apply to this application pursuant to the balancing test mandated by In the Matter of the County of Monroe, 72 NY2d 338 (1988). As you may know,that balancing test must take place when one municipality seeks to undertake action which conflicts with the rightful laws of another municipality. In this case, as in most,the question is whether the Southold Fire District may be immune from the zoning regulations of the Town of Southold as those regulations pertain to the above referenced application. In making such a determination the parties are required, by law,to engage in a balancing of public interests test. The purpose of this test is to determine whether the Fire District's public function of providing emergency fire,rescue, and EMS service to the community may outweigh the Town's interest in enforcing its zoning laws in this particular instance. Put another way,the ZBA is to weigh several factors in determining whether or not it is in the public interest to subject the Fire District to the Town's zoning requirements as they pertain to these poles. The factors to be considered, and the District's input as to each, are as follows: 1. The nature and scope of the instrumentality seeking immunity. The Southold Fire District"is a political subdivision of the state" of New York. NYS Town Law § 174(7). f , It is governed by a popularly elected Board of Fire Commissioners. 2. The encroaching government's legislative grant of authority. The Fire District's statutory purpose is to provide emergency fire, rescue, and EMS protection to the citizens and property of the District. It does so through the operations of the Southold Volunteer Fire Department, which it governs and supports. For the residents,businesses, and motorists of the Fire District the Southold Fire Department is the sole provider of fire and EMS response. More particularly,the District is specifically authorized: For the preservation,protection and storing of fire apparatus and equipment and for the social and recreational use of the firemen and residents of the district and for any of the purposes authorized by law,may acquire by purchase, lease, gift, devise or by condemnation, real property and erect, construct, alter,repair and equip suitable buildings, and may furnish necessary supplies for such purposes, and may lease portions thereof not required for fire district purposes. All real property required by any fire district for any purpose authorized by this article shall be deemed to be required for public use and may be acquired by such fire district. NYS Town Law § 176(14). 3. The kind of function or land use involved. The function involved in the District's application is the furtherance of the operations of the Southold Fire Department. The land use is the erection of new storage building on District property. This structure is being built to house and secure various pieces of Fire Department equipment and apparatus and will replace an existing, smaller structure. 4. The effect local land use regulation would have upon the enterprise concerned. The existing land use regulations would render the District's overall physical plant unworkable. The District has acquired an additional tract of land on Boisseau Avenue, immediately adjacent to its main firehouse. The location of this accessory building is required in order to permit the installation of new Fire Department fueling facilities as well as driveway access through the property. It should be noted here that the Southold Fire District is completely dependent upon the approval of this application. The District has already spent considerable sums to acquire the real property as well as for architectural and engineering drawings. 5. Alternative locations for the facility in less restrictive zoning areas. There is no other area that is a satisfactory location for this structure. The building will,by necessity, be larger than its predecessor and the proposed footprint must be located nearer the fence line than would be required by the Town Code. 6. The impact upon legitimate local interests. The impact of this structure on legitimate local interests is negligible. The existing structure is already as close, if not V _ closer,to the property line than this structure. When the Fire District had a public [�� hearing on this proposal there was one local resident present who supported it. 7. Alternative methods of providing the proposed improvement. As noted above,the structure must be erected and maintained in close proximity to the existing fence line. As the Court of Appeals noted in the Monroe case, "given the existing land use,there is no other practical location for the proposed use." In the Matter of the County of Monroe, 72 NY2d 338 (1988). 8. The extent of the public interest to be served by the improvements. The Southold Fire District is engaged in a critical governmental activity,to wit: emergency fire, rescue, and EMS service. This improvement is specifically and solely directed at improving the Fire Department's ability to safely store and protect its equipment. The Fire Department has various pieces of equipment that are seasonal in nature, including a fire boat and brush truck. Such items, as well as smaller equipment, cannot be stored in the firehouse or substation due to a lack of room. Similarly,the existing storage structure is too small in height and area to be useful. 9. Intergovernmental participation in the project development process and an opportunity to be heard. The District's application to, and appearance before,this ZBA is proof positive that this last factor has been met. Testimony is being presented in an open forum and the community members present have given the opportunity for a full hearing. In addition,the ZBA has the opportunity to pose direct questions of the applicant. In addition,I note the Fire District's own public information session held on August 30, 2017,which session was publicly noticed and attended. While this decision at first created a flurry among the fire services, analysis reveals that it is actually a beneficial result. The petitioner in the case was a private,not-for-profit fire company. As such, it had its own board of directors, lacked taxing authority, and could not be considered as a separate unit of government as would be the case for a city,town,village or fire district. Under these circumstances,it could be concluded that the Fire-Company was fully subject to the Town's zoning, as would be true for any other not for profit organization conducting its business in town. The court,however, looked to the relationship between fire districts and fire companies, and held: A fire company...'is essentially under the control of the Fire District...' In order for the fire district to provide the services it is required to provide by law, it must function through fire companies...Thus, for purposes of determining whether property to be utilized for a fire station is subject to applicable zoning laws, a fire company stands upon the same footing as a fire district... The court concluded that the construction of a fire house by a not for profit fire company is subject to the Monroe balancing of interests test rather than to the unqualified application of the Town's zoning, and returned the matter to the Town to conduct the balancing of interests. After the balancing was conducted by the Town, it was determined that public safety and other factors warranted allowing the construction to proceed. For example, a municipality may be undertaking the construction of a new town garage, park, or community building. Likewise, local governments may find their community to be the site of a development action by another nearby municipality or another level of government, such as the county or the state. When this happens, questions are often asked about how zoning regulations affect these development activities. This paper is a guide for local government officials faced with these questions. Certain acts of government may be exempt, or"immune," from zoning. Historically,New York courts have recognized that certain entities are entitled to absolute immunity from zoning regulations, including the federal government; state government; state urban development corporations; and public schools. These entities are not required to comply with local land use regulations. Other governmental entities,such as towns,villages,cities,counties and fire districts, are accorded only a limited immunity,and may be subject to local land use regulations. In making a determination as to whether the actions of governmental units with limited immunity are "exempt"from local zoning regulations,the New York Court of Appeals in the 1988 case of Matter of County of Monroe v City of Rochester 72 N.Y.2d 338,533 N.Y.S.2d 702, established a new method for resolving inter-governmental land use disputes using the "balancing of public interests" analytic approach. Unless a statute exempts it, the encroaching governmental unit is presumed to be subject to the zoning regulations of the host community where the land is located. Working from that premise,a host community then considers several factors to determine whether or not it is in the public interest to continue to subject the encroaching government to its land use regulations. The host community is to weigh the following nine factors: 1. the nature and scope of the instrumentality seeking immunity; 2. the encroaching government's legislative grant of authority; 3. the kind of function or land use involved; 4. the effect local land use regulation would have upon the enterprise concerned; 5. alternative locations for the facility in less restrictive zoning areas; 6. the impact upon legitimate local interests; 7. alternative methods of providing the proposed improvement; 8. the extent of the public interest to be served by the improvements; and 9. intergovernmental participation in the project development process and an opportunity to be heard. A subsequent case indicated that a public hearing should be held to elicit public input on the nine factors. Neither the New York Court of Appeals nor the New York State statutes specify which board in the host municipality makes the determination of governmental immunity. This raises two questions—when in the development approval process is this determination made,and who makes it? The following are some alternative scenarios which may lead to a determination of governmental immunity. A Municipality Developing Within its Own Jurisdiction JAMESA.COON LOCAL GOVERNMENT TECHNICAL SERIES When a local government proposes to establish a facility or undertake an activity within its own geographic boundaries,the courts have held that it is subject to the County of Monroe"balancing of interests" test. In other words, the local government is presumed to be subject to its own regulations. Which board conducts the balancing analysis to determine whether this is in the public interest has been a matter of speculation. Some suggestions: A municipal governing board may choose to bind some or all actions of its own municipality to the requirements of its zoning regulations by specifying so within the zoning law or ordinance. Where a municipality has done so,a zoning permit should be applied for. A referral to the planning board or zoning board for a special use permit or site plan review may be necessary as well. Any immunity challenge that the municipality wishes to make may be brought before the zoning board of appeals. Where a local government has not bound itself to the requirements of its zoning regulations, the municipal governing board must protect the public interest by examining the nine factors as applied to the current project. It must determine whether it is immune from the requirements of the zoning regulations, and whether a zoning permit is necessary. Even where a municipal governing board has declared an action immune from zoning, it may still wish to comply with the requirements of zoning,where practicable,and with public notice and hearing requirements. A Municipality Developing Within Another Jurisdiction In the absence of a statute to the contrary,where a municipality or other governmental unit proposes a project in another community,the two governments should assume that the action is subject to the host community's zoning requirements.The host community should apply the nine factors set forth in the County of Monroe case to determine the extent to which the host community's regulations will actually apply.Any disagreement between the parties should be resolvedby the appeals process of the host community. Where a municipality or other governmental unit undertakes development activities associated with a project without applying for a zoning permit, the host community will need to make a determination as to whether to initiate enforcement action against the developing municipality or governmental unit. Unresolved Questions Although the County of Monroe case was decided over ten years ago, several questions regarding the application of the test remain unanswered. First,the case dealt with site plan regulations which were adopted as part of the local zoning law. Whether the decision of the court would apply to the application of site plan regulations adopted independently of zoning,or for that matter to compliance with subdivision review or other land use regulations is has not been resolved. Second,it is not clear which board in the host municipality weighs the nine factors and determines whether the governmental unit undertaking the development activity is immune from local land use regulations or not. Also ambiguous is when in the development process that decision is made.
