SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 26, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject 22,250 square feet irregularly shaped parcel, with three road frontages, located in the R-40 Zoning District measures 126.23 feet along Navy Street, then runs 133.09 feet along Bay Avenue, then runs east 125.98 feet along a residential neighbor and turns north 85.60 feet along the same neighbor to 52.49 feet along Willow Street with an eastern lot line of 207.70 feet along a second residential neighbor. The property is developed with a one and one half story, wood-frame single family residence with wood front stoop and steps, an enclosed porch, slate patio, accessory detached garage with stone driveway and stone garden wall as shown on the site survey prepared by John C. Ehlers Land Surveyor, dated February 22, 2018. BASIS OF APPLICATION: Request for a Variance from Article I11, Section 280-15 and the Building Inspector's February 27, 2018, Amended March 20, 2018 Notice of Disapproval based on an application for a building permit to construct an accessory shed; at; 1) located in other than the code required rear yard; located at: 2395 Village Lane, Orient,NY. SCTM#1000-26-1-12.1. RELIEF REQUESTED: The applicant requests a variance to construct and place an accessory garden shed of approximately 120 square feet in size and measuring 10 feet by 12 feet, with a traditional pitched roof, in the front yard where such accessory structures are required to be located in the rear yard. ADDITIONAL INFORMATION: Prior relief was granted for this site under file 45218 dated April 17, 2003 for a minor subdivision. Review by Southold Town Landmarks Preservation Commission requests the accessory shed to be located, as applied for, on the west side of the Willow Street access to the residence. A Certificate of Appropriateness, endorsed by them, is required to be issued prior to the Building Department issuing the Building Permit. An immediate neighbor to the north, living opposite the Willow Street site access, spoke against the Page 2, June 21,2018 #7172, Lewis SCTM No. 1000-26-1-12.1 placement of the shed as applied for, requesting that the shed be placed on the opposite side of the access along the eastern lot line between existing evergreen landscaping, thereby screening her view of the shed from her residence. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 7, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Orient Village and the homes surrounding the applicant's property was developed well over two centuries before current Zoning was put into place. The immediate neighborhood is made up of homes of varying sizes and scale, architectural design, roof pitch and lot size and coverage, many of which have accessory structures including several in front or side yards which the current Code does not allow. The subject property has three road frontages making it among the most unique in the immediate area. The addition of a customary accessory garden shed to a primary residence is common among all homes in Southold Town and many in the Village of Orient. The location applied for, as approved by the Town of Southold Landmarks Preservation Commission strived to place the accessory shed in a position compatible with the neighbor to the west's accessory structures. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Challenged with three road frontages and three front yards it is impossible to place the accessory shed in a Code compliant rear yard. 3. Town Law 12267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the Town of Southold Landmarks Preservation Commission approved the siting of the shed, as applied for, and as a result of the triple front yards does not have a Code compliant location to place the accessory structure. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The chosen placement of the shed is consistent with various shed locations of the surrounding properties. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garden shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento, seconded by Member Dantes, and duly carried, to GRANT the variance as applied for, and shown on the survey prepared by John C. Ehlers, Land Surveyor, dated February 22, 2018. Page 3, June 21,2018 #7172, Lewis SCTM No. 1000-26-1-12.1 Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. In your email you also submitted a survey(date stamped April 26,2019)showing the new location of the shed, and indicated that the HPC will make their final decision during their May meeting. Since the shed will remain in the front yard,as granted in our decision of June 21,2018, and will be reduced to 99 sq. ft. in size from 120 sq. ft., a de minimus approval will not be required. The new location will be acceptable to this Board once a Certificate of Appropriateness is issued by the HPC, along with a revised stamped survey depicting the new shed location, and submitted to our office. Please be advised that all conditions set forth in Appeal No. 7172 will still apply. Contact our office if you have any further questions or concerns. I met recently with the HPC (it was unexpectedly a "working session" as the public notice had not been issued) and in discussing the plan with them, it was determined that the shed should be moved slightly due to location preference by the HPC and my desire to accommodate a neighbor's (Ellen McNeilly's) objection which was raised during the ZBA hearing. The size of the shed (previously 120 sf) has also been decreased to 99 sf. O My question is if the variance that was granted is still valid if the shed's location is moved approximately 20 feet to the East. I have attached both the ZBA decision as well as a document indicating the desired location. The new location is superimposed as a small orange rectangle. My intent is to meet with the HPC for their final blessing/decision in mid May at which point the shed will be constructed and installed. Thank you in advance for your help. I look forward to hearing from you. Regards, Evan ATTENTION: This email came from an external source. No. 5218–JOHN AND JERILYN WOODHOUSE Southold Town Clerk Property o-c on: 225 Navy Street, Orient; CTM 1000-26-1-12 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' property is a 42,154 sq. ft. parcel with 229.80 feet along the north side of Navy Street and 133.09 feet, along the east side of Bay Avenue (a/k/a Main Street or Village Lane). The property is improved with four buildings: (a) single-family, 1-1/2 story frame house and accessory frame garage on the westerly portion, and (b) single-family, two-story frame house and accessory frame building on the easterly portion, detailed on the map prepared 9-22-98, revised 11-04-02 by John C. Ehlers, L.S. BASIS OF APPLICATION: Building Department's August 15, 2002 Notice of Disapproval, amended December 16, 2002 and December 24, 2002, citing Section 100- 30A.3 in its denial of applicants' August 14, 2002 application. The reasons stated in the denial is that the sizes of the two lots, as proposed, are not permitted because the Zoning Code Bulk Schedule requires 40,000 sq. ft. of total area and a lot width of 150 feet. Also noted in the denial is that the merger law would not apply to"the property in question, and the Building Department removed references to nonconforming setbacks noted in the previous disapprovals. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 20, 2003 and April 3, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants are requesting variances under Section 100-30A.3, Bulk Schedule, for the following: (a) lot area of proposed Lot 1 of 22,250 sq. ft, and lot width of 144.09 along Navy Street; (b) lot area of proposed Lot 2 of 19,904 sq. ft. and lot width of 85.71 feet along Navy Street. ADDITIONAL INFORMATION: On April 3, 2003, the applicants confirmed an amendment to this application requesting area variances for a minor subdivision application to the Planning Board, rather than a lot-line change. Page 2—April 17,2003 Appl. No. 5218—J. and J.Woodhouse 26-1-12 at Orient RECERvE® MAR 2 0 2018 ZONING BOARD OF APPEALS, REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of an area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Applicants request area variances for a minor subdivision resulting in two lots, each with a dwelling. The dwellings were built before 1957, the effect date of zoning, and are located in a historic district. At the hearings, no objections or concerns were raised by any of the adjacent or contiguous neighbors regarding the proposed area variances. The neighborhood is very developed consisting of many preexisting, non-conforming parcels approximately equal in size to the applicants' proposed lots and will not result in a significant increase in the density of the neighborhood. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances for a minor subdivision. The lot sizes as proposed are almost equal in size and are not able to be created without the requested area variance relief. 3. The relief as requested is substantial. Although the lot sizes are less than conforming, they are larger than lots existing in the neighborhood. 4. No evidence has been submitted to suggest that the proposed lot size variances will have an adverse impact on physical or environmental conditions in the neighborhood. The proposed variances will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood, or district because there will be no increase in density. Each will contain a dwelling and accessory garage (which are existing). 5. The alleged difficulty for the applicants is self-created, since the applicants seek to create Lots 1 and 2 with nonconforming lot sizes. 6. The relief offered to this applicant is the minimum necessary for the applicants to enjoy the benefit of conveying land for each house, by separate deeds, while at the same time protecting and preserving the character of the neighborhood, as well as the health, safety, and welfare of the surrounding community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman J Page 3—April 17,2003 & Appl. No. 5218—J.and J.Woodhouse RECEIVED -71 ,,a 26-1-12 at Orient BAR 2Q 2018 / ZONING BOARD OF APPEALS Tortora, seconded by Member Goehringer, and duly carried, to GRANT the Variances in this proposed minor subdivision, and shown on the map prepared by John C. Ehlers, L.S. dated 9-22-98, amended 11-4-02.
