SCTM#1000-74-2-11.2 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 25 and the Suffolk County Department of Planning issued its reply dated March, 5, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The property is located1005 Mill Road, Peconic, N.Y. SCTM41000-74-2- 11.2. The overall size of the property is 44,546 square feet in the R-80 Zoning District. The southerly property line measures 222.75 feet, the westerly property line measures 200.00 feet, the northerly line measures along Mill Road measures 222.75 feet and the easterly line measures 200.00 feet and runs adjacent to the private road/driveway of the neighbor to south. The property is improved with a two story residence with an in-ground swimming pool under construction. The property has a sloped topography on the southerly and easterly side of the property that is adjacent to the in-ground swimming pool as shown on the survey and site plan submitted by D'Amaro Engineering and Surveying,P.C. last dated January 17, 2018. BASIS OF APPLICATION: Request for a variance from Article III, Section 280-15 and the Building Inspector's January 23, 2018 Notice of Disapproval based on an application for a building permit to legalize an "as-built" accessory above-grade patio surrounding an in-ground pool; at; 1) less than the code required minimum rear yard setback of 15 feet; located at 1005 Mill Road, Peconic,N.Y. SCTM#1000-74-2-11.2. RELIEF REQUESTED: The applicant requests a variance for a permit to legalize"as-built" above-grade patio and retaining wall surrounding a swimming pool currently under construction at 1005 Mill Road, Peconic, N.Y. SCTM#1000-74-2-11.2. The "as-built" construction on this 44,546 square foot lot in the R-80 Zoning District is not permitted pursuant to Article III, Section 280-15, which states accessory building and structures shall have a minimum rear yard setback of 15 feet. The construction has a setback of 4.9 feet from the rear yard property line The retaining wall was built by the applicant to keep all drainage on the property as the sloping topography does pose runoff problems. Upon inspection by the Building Department to review the grade around the pool and property line,the need for a variance became apparent. Page 2, June 21, 2018 #7164, Digenakis-Drakopoulos SCTM No. 1000-74-2-11.2 ADDITIONAL INFORMATION: At the recent Public Hearing, the Board requested information regarding the location of the proposed drainage for the pool. The representative for the applicant submitted a copy of an earlier survey originally submitted to the Building Department with a letter dated June 7, 2018 (received June 11, 2018) (not drawn to scale) depicting a hand drawn 4 foot by 8 foot drywell to be located adjacent to the pool equipment. The exact location of the proposed drywell cannot be verified. The applicant's agent testified that they applicant had applied for a swimming pool building permit, but did not realize that the retaining wall would also require a building permit and variance relief. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 7,2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of various sized dwellings and in ground pools are a common accessory. The applicant's pool is in a conforming rear yard and can only be seen by one other adjacent property to the south which is accessed via a private Right of Way. The applicant and his southerly neighbor have planted evergreens along the length of the shared property line to create visual privacy. Conditions of approval will insure that the as built improvements will not cause stormwater damage to the adjacent property. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The retaining wall and pool are both as built with a non- conforming rear yard setback and cannot be reasonably removed and relocated to a conforming rear yard setback without substantial cost and regrading on the subject property. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 67%relief from the code. However, the sloping topography necessitates the retaining wall to keep the grade of the pool and patio even, and to keep all stormwater run-off on the property. Evergreens have been planted along the southerly property line to visually screen the pool area from the adjacent neighbor, whose house is set back at a substantial distance from the retaining wall on pool on the applicant's property. 4. Town Law V67-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. All work proposed will need the approval of the Building Department and the Town Engineer to ensure that the requirements of the Town's Stormwater Management Code Chapter 236 are met which includes drainage for the entire site and all structures on the site, including the drywell for the swimming pool. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in-ground pool and patio protected by a retaining wall while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3, June 21, 2018 #7164, Digenakis-Drakopoulos SCTM No. 1000-74-2-11.2 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variance as applied for, and shown on the survey and site plan prepared by Jerome T. D'Amaro, P.E. &L.S., last revised January 17, 2016 SUBJECT TO THE FOLLOWING CONDITIONS: 1. All Evergreen screening along the southerly boundary line shall be maintained in perpetuity. 2. Pool mechanicals shall be placed in a sound deadening enclosure. 3. Drywell for pool de-watering shall be installed. 4. Prior to the issuance of a Certificate of Occupancy for the in-ground swimming pool,the Town Engineer shall inspect the subject property and confirm that drainage for the entire site and all structures on the site, including a drywell for the swimming pool,be in compliance with Chapter 236 of the Town's Stormwater Management Code." That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three(3) consecutive one(1)year terms. Pat, Attached please find a drawing from the underground detection company. This sheet proves that the roof drainage is directed into multiple leaching pools although the information is incomplete. To further investigate the drywells it would be necessary to damage both hardscape and landscaping features on the site, which I think is unnecessarily disruptive and costly. It is possible that this sheet alone will satisfy James Richter's requirement to establish the existence of controlled stormwater runoff disposal for this building. I suggest that you bring this to his attention and ask if anything regarding the roof drywells is needed to be shown on the revised Stormwater Management Control Plan that I will be preparing when I get back from vacation on the 13th. Hi Kim: The client called me today to ask me to proceed with the request from the zoning board to reconsider the requirement that the entire property meet storm water code. The house and addition (built by prior owner) has leaders, gutters and go into the ground (presumably into drains). Jamie is requiring that the owner dig up the dry well in order to take a picture of what is there (show existing conditions). 2 The problem with the request is that the owner only sees the pipe going into the ground but not where the drainage ring is located. The area has mature plants all around the house. He would have to dig up his yard & his landscaping. He called the former architect and a previous contractor but no one remembers and the Town does not have a record. The client is getting a test hole in order to design the drainage for the existing driveway, existing and new patio and new pool. Please ask the ZBA to clarify the condition- he is providing drainage for the new structures (patio and pool) and some of the existing structures (driveway and patios) but it is very difficult, very expensive, and will make a mess of his yard to obtain "as built" for Jamie the existing drainage of the house. We had a very productive conversation. This is an open message and includes copy to the Town. Mr. Richter said he is not going to require that all runoff from the site conform to Chapter 236 with regard to the existing lawn and landscaped areas that slope towards the property lines (you were correct, Pat). He is only concerned with seeing the following added to the plan: 1. Runoff from the dwelling roof be directed to leaching pools with calculations added to the plan, 2. A trench drain installed across the driveway just before it reaches the retaining walls with calculations added to the plan, 3. A test boring or other certification fiom an engineer willing to take responsibility for the soil conditions, and 4. Moving the staggered plantings and berm completely onto the site or a letter from the adjoining property owner allowing the plan as-is. 6° 3 Regarding these discussion points I recommend the following: 1) On Mr. Richter's suggestion, we should contact the building department to have them search their microfiche files for plot plans or surveys showing leaching pools for the roof runoff. If no information is available from this or other sources then we will have to dig up the leaching pools to verify their size, location, and connecting pipe. He wants certification of the drainage system for the roof runoff, including pictures, if acceptable documentation is not discovered. 2) He would prefer to have the trench drain installed at the end of the driveway just before the apron but is willing to concede that the difficulty of installing new drainage pipes under the existing retaining walls is onerous for this application. 3) A test boring should be ordered from McDonald Geoscience. They usually charge about$600. The soil profile is classified using the visual Unified Classification System and the acceptability of the percolation rate can be estimated from there. 4) It is my understanding that the adjoining property owner has already given permission to stagger the property line plantings and berm across the property line. The two owners are in agreement and will be planting in the Spring (they have asked that my office hold the money to assure payment to the contractor). The applicant is paying for the trees located along the length of the retaining wall and applicant and neighbor are splitting the cost of the Green Giants along the balance of the shared property line. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The topography of the property requires a retaining wall. The retaining wall leaves room for the evergreens and maintenance to the wall. (3) The amount of relief requested is not substantial because: The setback is reasonable for the retaining wall. The grade difference is not high and drainage is proposed in the pool and patio area to retain all water run-off. (4) The variance will NOT have,an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The retaining wall prevents erosion and drainage problems which grading alone would not address. The owner believed that he was being a responsible neighbor by protecting the down-gradient property from erosion or drainage issues.
