SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 27, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 17,143 square foot parcel located in an R-40 Zoning District. The parcel runs 160.07 feet along Watersedge Way, 107.61 feet along Gin Lane, 158.55 feet on the North property line and 107.62 feet on the Western property line. The parcel is improved with an existing frame dwelling and a shed. On the West side of the property is a 25 foot right of way. All is shown on a survey by John T. Metzger L.L.S., dated September 28, 2017 and last updated October 26, 2017. BASIS OF APPLICATION: Request for Variance(s) from Sections 280- 124 and the Building Inspector's November 22, 2017 Notice of Disapproval based on an application for a building permit to construct additions and alterations to an existing single family dwelling; at 1)less than the code required minimum front yard setback of 35 feet; located at 1700 Gin Lane(AKA 1230 Waters Edge Way), Southold,NY. RELIEF REQUESTED: The applicant proposes to construct first and second floor additions and alterations to an existing single family dwelling that includes a new front porch with deck above having a 30.7 foot front yard setback where code requires a 35 foot front yard setback. ADDITIONAL INFORMATION: As indicated by the submitted survey, an above ground swimming pool with a surrounding deck and fence has been removed. The existing shed located on the north west portion of the property sits within an unopened right of way pursuant to a recorded subdivision map (Map of Bay Haven) filed on January 22, 1959. Page 2,June 21,2018 #7146,Neimeth SCTM No. 1000-88-3-19 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 7,2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of non-conforming parcels of similar size with single family residences. The subject property is burdened by having two front yards and burdened by a 25 foot easement on the Western side of the property. The non-conforming setback is for a front porch with proposed deck above. These areas will not be enclosed as conditioned space. 2. _Town Law &267-b(30)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling has a distance of 37.8 feet from the front yard property line along Waters Edge Way therefore any expansion of the home on the south side would require the benefit of an area variance. The setback off Gin Lane is 45.1 feet which conforms to code. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 12% relief from the code. However, the applicant is burdened by being a corner lot with two front yards, as well as a 25 foot right of way located on the northern portion of the property, although it is considered a paper road and a dead end. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The lot abuts protected and vacant town and county land to the west. The non-conformity is the outcome of a proposed open porch having approximately seven feet in width which will consist of unconditioned space. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of proposed additions to a single family dwelling with a front porch and deck above while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes , seconded by Member Planamento, and duly carried,to GRANT the variance as applied for, and shown on the Architectural plans by Tehn Design Group dated September 5, 2017 and labeled 1-3, and the survey by John T. Metzger L.L.S., dated September 28, 2017 and last updated October 26, 2017. SUBJECT TO THE FOLLOWING CONDITIONS: 1) The new septic system shall not be located within the 25 foot right of way. 2) In the event that the existing shed should need to be replaced, a replacement shall not be located within the 25 foot right of way. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. The existing house is very modest and the location is on the end of Watersedge Way. The proposed second floor addition to the house is to relocate the bedrooms to the second floor and expand the living area on the first floor. The house remains modest in size. The foot print of the house is only slightly modified behind the garage. Front porches are being proposed to enjoy the waterfront views and summer breezes across Watersedge Way. Their view is between the waterfront homes across the street. A first floor and second floor porch is proposed on Watersedge Way which will reduce the front yard setback to 30.7 feet. The existing house has a front porch/deck addition which received a Zoning Variance reducing the front yard setback to 27.5. The Zoning Board granted appeal #4775. The proposed front yard setback is 30.7 (less than what was previously granted) Building permit(26337-z)and CO enclosed. The Building Department uses Gin Lane address as the "front yard" the other yards are conforming as side and rear yards. When the house is renovated and addition constructed the existing decks on the side of the house with an above ground pool will be removed. The existing house is the last house on the north side of Watersedge Way. The proposed two story decks will not impact the character of the neighborhood. The homes are primarily second homes and the outside living space is used primarily in the summer. The existing house is modest in size and character, and the proposed addition and porches will give additional architectural character to the simple home. The decks will give the owners a water view. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The existing house is located at 37.8 feet from the road. There is no ability to construct a usable porch without a variance. The road in front of the house has an extended green space and the setback from the road will not be obvious, the distance of 35' verses the 30.7 requested will not appear visually as a significant front yard reduction. There is no adjacent property. The Town of Southold owns the land to the west. (3) The amount of relief requested is not substantial because: Only 5' reduction is requested from Watersedge Way. The parcel is a corner lot and the house is 45.1 feet to Gin Lane. The variance from the front yard setback is minimal and because the pavement does not run to the property line there is additional distance to the road surface. The variance would be visually undetected. The house is the last house on Watersedge Way. To the west is Town property (open space) to the east is the road(Gin Lane)and to the north is the"rear yard"for the property. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The house sanitary system will be replaced from the 1961 system when the house was constructed. The lot consists of 17,150 sq. ft. with 107.61 ft. frontage along Gin Lane and 160.07 ft. along Watersedge Way. The lot is improved with a one-story frame dwelling with attached garage. The dwelling was built many years ago (40 years plus) and is set back approximately 37.5 feet from the front property line and the 10' front deck reduces the front setback to approximately 27.5 feet BASIS OF APPLICATION: Building Inspector's November 5, 1999 Notice of Disapproval which states that under Section 100-244 of the Zoning Code, a minimum front yard setback is required at 35 feet and the applicant's deck creates a setback of 277". AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance for a 10' deck at the. front of the dwelling, leaving a front yard setback of 27.5 feet facing Watersedge Way. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) Applicant purchased the property in 1996. The 10 ft. by 24 ft. deck was added in 1998, without a building permit. Applicant now seeks a building permit and certificate of occupancy for the deck.' Because the house is 37.5 feet from the front property line, and the Code requires a 354 setback, applicant needs a variance in order to have any sort of deck on the front of the house, which is the side with the sunny southern exposure and water view. (2) The deck is modest in design and does not stand out noticeably from the house. The house is the last one on the northerly side of Watersedge Way, and has no immediate neighbor to either the east or west. For these reasons, grant of the requested variance will 'not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. (3) There is no evidence that grant of the requested variance will have an adverse effect or impact on physical or environmental conditions.
