Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. An undesirable change will not be produced in the character of the neighborhood` or a detriment to nearby properties, if granted because: The proposed improvements will enhance the property and the character of the community. The existing house is a 1935 ranch with a detached garage constructed in 1963 pursuant to a variance. The owners of the house were elderly and the house had been neglected for decades. The prior owner's father had built the house, it has only one bedroom, one bath, and is only 1,000 square feet. The , house is in need of renovations and repair. The existing roof was patched, but must be replaced, therefore the proposed renovations and additions to the house are coordinated to be performed simultaneously. The house had no flooding but suffered wind damage from Sandy. The grounds have been improved and the applicants removed over 100 yards of yard debris after closing. The owner has proposed a partial second floor of 624 s.f. plus a small deck walkway with stairs to the yard. This design is primarily as an emergency and fire egress from the second floor. To minimize expansion towards the creek the deck and stairs are proposed on the side, therefore requiring a 10.6 side yard setback. Both first and partial second floor will add 816" to the overall width of the existing house. The lot is 90 feet in width where the house is sited, at an angle, and not parallel to the property line. The south side yard is a generous 23 feet. The proposed additions on the north side yard will result in a 1018" side yard setback thus requiring a variance. The existing garage was granted a variance, approved May 9, 1963 "for permission to erect detached garage in the front yard approximately 100' from the property line" . The Zoning Board determined that "the proposed location of the garage would be both practical and adequate" . The proposed front first floor addition of 78 square feet will project 514" . This will result in placing the existing garage partially in the side yard. The applicant, after living in the house for a few years, has designed the house to retain the character of the house as well as maximize protection from the winter storms and northeast winds. 2. The benefit sought by the applicant CAN NOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The pre-existing house is in place and the garage was granted a variance and will remain. Additions to the structure necessitates the variances. The house is located on Little Creek, Cutchogue and every effort was made to maintain the setbacks from the wetlands. Effort has been made to preserve the privacy and water views of neighboring properties. The neighboring homes are staggered along Little Creek rather than side by side for optimal use of each parcel. The applicant has maintain the existing setbacks to the wetlands with only a proposed 3.8' addition to the existing first floor kitchen. The setback from the wetlands for the side yard addition, requiring the variance, is landward of the wetlands of the existing structure. 3. The amount of relief requested is not substantial because: The proposed deck is 101 .8" to the property line. The deck and stairs will ,serve primarily as the means of egress from the second floor. The deck setback have not been increased towards the water. The deck and stairs block the sunlight into the house, so only one window is proposed on the first floor, north side, of the house. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The design is intended to be modest, implementing a "perfect hip" roof to mitigate potentially damaging north easterly winds, while allowing maximum sunlight and waterfront vistas. A minimal first floor addition is proposed. The proposed additions to the first floor provide handicap accessibility and a code compliant interior stairway to the proposed second floor. The proposed 'design is low profile, only , ^�from grade. The existing sanitary system is located where the proposed �P addition is to be located so a new conforming sanitary system has been approved by the Suffolk County Health Department. The new system is to be located in the front yard further from the Creek. The house is being made safe and code compliant because the owner hopes of growing old in this house. 5.Has the alleged difficulty been self-created? { ) or {No) NO. Why: The existing house pre-dates zoning. The lot width is narrow so expansion of the house is limited. The proposed addition to the garage is only storage. The entire house is being made handicap accessible on the first floor. The owner is preserving the existing house and the modest addition is designed to maximize living space.
