DESPINA GIANOPULOS LANDERS/LANDERS FAMILY TRUST , LLC #7072 Request for Variances under Article XXII, Section 280-116B and Article XXIII, Section 280-124 and the Building Inspector's April 10, 2017, Amended June 9, 2017 Notice of Disapproval based on an application for a permit to construct additions and alterations and to legalize an "as built" deck addition to an existing single family dwelling, at: 1) located less than the code required minimum front yard setback of 35 feet, 2) located less than the code required minimum rear yard setback of 35 feet, 3) located less than the code required minimum side yard setback of 10 feet, 4) more than the code permitted maximum lot coverage of 20%; at: 5705 Stillwater Avenue, (Adjacent to Eugene's Creek) Cutchogue, NY. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with the LWRP. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The 18.2' front yard setback (35' required); rear yard setback of 16.8' (35' required) and lot coverage (exceeds the 20 percent maximum) does not enhance community character. Policy 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The structures are located within a FEMA flood zone AE base flood elevation 6'. It Is unknown if the first floor elevation of the dwelling complies with FEMA standards. If the dwelling does not comply with the standards the threat of property loss from flooding is high due to the close proximity to the waterbody. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The as built, large, deck, pool and other structures did not benefit from Board of Trustees review or a Wetlands Permit. The deck is setback 6.6' from the bulkhead and all structures are extremely close to the wetlands/waterbody (see figure 2). The top elevation of the bulkhead is unknown and the threat from flooding of the property exists. I picked up keys from the Four Sails Realty office in Cutchogue and began this inspection at approximately 10 :30 A.M. The dwelling consists of two bedrooms, a bathroom, living room, and a kitchen that opens to antenclosed porch used as a dining and sitting room. Building's foundation is cement block with a crawl space. Section of porch on Sound side of building is constructed on wooden posts. The source of heat for the building is a gas-fired, free standing room heater located in living room vented to exterior. The following violations of the Housing Code, Chapter 52, Town of Southold, New York were found: Front entry - no means of controlling light in room on entry, Article V, Section 52-56 B (2) . Kitchen - gas cooking .range, no shut off valve at unit, Article V, Section 52-52 B (2) . Heater - insufficient clearance to side wall combustible maw 1, no protection. The unit stands on wood flooring, no protection provided, Article V, Section 52-53 F. The board made the following findings and determination: This is an appeal to Article III: (a) Section 100-31 for approval of the construction of a 14' by 28' swimmingpool which will exceed the 20% lot coverage requirement for all structures, and (b) Section 100-32 for permission to locate an accessory pool and storage shed in the sideyard area. Article III, Section 100-31 permits a maximum of 20% of the total lot for construction. The premises in question fronts along Stillwater Avenue 100 feet in length and contains an area of approximately 7,250 sq. ft. Existing on the premises is a one-family, one-story dwelling and attached garage, which cover approximately 1 ,268 sq. ft. Twenty percent of the total lot area is 1 ,450 sq. ft. By an addition of the swimmingpool and 6' by 8' storage shed, the total lot coverage would be 1 ,708 sq. ft. , in excess of approximately 258 sq. ft. The appli- cant does not intend at this time to construct a deck and therefore is not under consideration by this board. The only other structures to be placed is a fence as required by Section 100-30(C)'[2] enclosing the pool yard area. Article III, Section 100-32 requires all accessory buildings to be located in the rearyard area. The rearyard area of this parcel is limited with the dwelling' set back 12.5± feet from the wood retain- ing wall . The pool would be set back eight feet east of the dwelling within the sideyard area; the shed would be placed towards the rear along the easterly side of the dwelling.
