No. 5223— DANIEL WEST Location of Property: 120 Private Road #31, Southold 77-3-24 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: This 14,605+- sq. ft. described parcel is situated along a private right-of-way extending from North Bayview Road, Southold. The property is improved with an one-story frame house (built about 1979). The westerly boundary is 105.18 ft. along a traveled right-of-way, with 139.05 ft. and 105.18 ft. along paper right-of-ways as shown on the survey prepared March 21, 1980 by Roderick VanTuyl, P.C. The Building Department has determined these boundaries as front lot lines. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 14, 2002, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: APPLICANT'S REQUEST: Applicant is requesting a Variance under Section 100-2448,, based on the Building Department's July 27, 2002 Notice of Disapproval, for the proposed addition (approximately 9' x 33' L) at the southwest side of the dwelling within the 35 ft. restricted area, leaving a new setback at roughly 28 feet. (Although there is a porch addition shown on the plan at the opposite (easterly) front yard, this area which conforms to the front yard setback was not issued a disapproval, and there is no objection to the 9 ft. extension at 41+- ft. setback.) REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board made the following findings: 1. Grant of an area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The relief is for a small sunroom and porch. The proposed additions for a sunroom and porch will not alter the character of the neighborhood, or cause any detrimental effects to nearby properties. J ' SID w Page 2—November 21, Al Appl. The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue other than an area variance due to the pre-existing, non- conforming rear yard setback of the building. The applicant's plan is constrained by the fact that this property bounds a right-of-way on three sides, and therefore is considered as having three front yards, each requiring a minimum setback of 35 feet. One of the rights-of-way is unpaved and grassy. 3. The variance granted herein is not substantial because the applicant will maintain two front yards at greater than the required minimum setback of 35 feet. The total lot coverage will also be conforming to the close at less than 20 percent (15 percent) after the completion of the project. 4. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. No evidence has been submitted to this board to suggest that this minor variance will have any adverse impact. The scope of the project is very limited, and the rear yard is already nonconforming at 18 feet. 5. The difficulty for the applicant has not been self-created because the zoning code defines the property with three front yards when three lines border rights-of-way. 6. The relief offered to this applicant is the minimum determined necessary for this applicant to enjoy the benefit of a porch and sunroom, while at the same time protecting and preserving the character of the neighborhood, as well as the health, safety, and welfare of the surrounding community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for, and shown on the plan prepared by East End Drafting and Design dated 11-1-02 and the (undated) shaded site sketch prepared by the applicant. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In checking this over, we find that there apparentlyage some discrepancies in the right-of-way, stuff that has to be straightened out, still yet by you people somewhere along the line. Out in front of it, the right-of-way which they want a setback variance for, because this is a corner lot and it ends up with two frontyards, it is on a very definitely set-up private right-of-way. There being no objections to it, it is a pre-existing_ lot, why I would make a motion that 'the setback:ibe granted arid .the access be granted provided they have legal right of title' for the access road and that the access road be improved to our regular specifications. If that meets with your approval, why I-- MR. TUTHILL: I 'm not clear--there' s an existing blue stone-- MR. DOUGLASS: That' s not it. MR. TUTHILL: The stone road that goes along the side of this property. Now there' s another one that' s a paper street. Is that the other proposed corner or is it actually'va physical road that comes off of the-- MR. DOUGLASS: There isn't any there; it' s still a paper road. MR. TUTHILL: They propose to open it up? MR. STA KEW.ICE,: I think they would propose to open the minimum , up to gain access because of the expense. Mrs. McLean has sold the lot at $6 , 000 , a very low price in order to finance her son' s educa- tion. And sell this and an adjoining lot, so-- And the purchaser' s builder, I'm sure, is, I think he' s going to pay for the improvements but only minimum improvements because it' s his daughter' s house and he' s doing it on a-- MR. STANKEVICH: True, and that' s the necessity of a variance. It' s got to comply with technicalities or get a variance. MR. DOUGLASS: Right. So I would go with it that way, approve the setback on the private right-of-way and the access with proof of legal right of title, and it to be improved to the specifications that we require. A 15-foot with either stone-blend or oil and so on and so forth. MR. STANKEVICH: I have the,- specs. MR. DOUGLASS : You have them, right. As I said there seems to be some dispute on that access road. MR. STANKEVICH: The title company has the -answer. We will provide you with a copy. MR. DOUGLASS: Right. Do you agree with it? MR. TUTHILL: I'll second it. After investigation and inspection, the Board finds that the 1-0 applicant is requesting a variance for 24-foot frontyard setback, and the property has three front yards leaving the other a rearyard which requires this variance for 24-foot setback. The applicant is also requesting approval for access on the 30-foot right-of-way extending from the Goose Creek Lane Association right-of-way for which there appears to be litigation pending about legal title.
