REASON FOR APPEAL
A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance
is requested forthe ~a~nthat each appellant owns lots which pre-date
zoning; each appellant could build on such lots without re-
questing variance, but-such buildings would have less side-
yards than would occur if built on prdposed modified lots which
are requested on this appeal.

1. STRICT APPLICATION OF THE ORDINANCE would produce pmcticaldifficulti~ orunn~es-
san HARDSHIPb~au~ present lots are very long (440+ feet) and
narrow (about 50.5 feet) so that dwellings built at the south
end of each lot under ordinance would be 22.5 feet apart, z
Appellants propose to transfer part of each lot to the other,
so that dwellings can be constructed which meet all the side
yard requirements of the ordinance and remove the practical
difficulties and unnecessary hardship of building close to
property lines.
2. The hardshipcreatedisUNIQUEandisnotshared by all prope~ies alike in the immediate
vicinity ofthis property and in this un district becouse
lot immediately to the east of subject lots on Peconic Bay
Boulevard, although of lesser total square footage than either
of the subject lots and apparently pre-dating zoning (as do
most lots on the Boulevard), is shorter and wider than either
of subject lots and therefore does not present the small side-
yard problem of the subject lots. The modifications proposed
by appellants would result in lots of substantially similar
dimensions to the lot immediately east of subject lots.
3. The Variance would observe the spirit ofthe Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT b~ause variance would allow buildings to
meet all side-yard, front and back yard requirements of Ordinance
rather than using statutory 25% side-yard provision for pre-zoning
lots (and thus is more in keeping with the spirit of the Ordinance)
and would result in lot dimensions which are similar to those of
the lot immediately to the east of the subject lots and which
are believed to exceed those of many lots along the Boulevard
(and thus would not change the character of the district).

of the Town of Southold, written request has been made by Ted Down,
subdivider of Sea-Aire Estate~ in Mattituck, that he be allowed the
use of swales in place of curbs on the road to be known as Sea-Aire
Lane, and
WHEREAS, the Superintendent of Highways, Raymond C. Dean, has
given'written approval of said change,
Now, therefore, be it RESOLVED that the Southold Town Planning
hereby consents to same. -

Dear Ms. Kowalski and Ms. Tolman:
Reference is made to the letter dated March 17, 1980
from Royal R. Reynolds of the Suffolk County Department
of Health to Ms. Kowalski re Appeal No. 2671 (Application
of Helen McNulty and Anita McNulty, Laurel).
I have spoken with 5~. Reynolds by telephone today,
and am advised by him that the Suffolk County Depart-
ment of Health does not require a test well or any other
action On the part of applicants Helen McNulty and Anita
McNulty prior to action by the Southold Town Planning
Board on the pending application. At such time as appli-
cants apply for building permits on the revised lots (if
the "subdivision" application is approved by the Planning
Board) or on the existing lots (if the application is
denied by the Planning Board), then applicants would be
required to apply to the Department of Health and drill
test wells.

An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project be
implemented as planned.
Because there has been no response in the alloted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency.
The Suffolk County Department of Health Services has
indicated that soil conditions for individual sewage
disposal systems are acceptable; however, based on data
from recent construction in the area, the potable
groundwater supply in the area is limited bothin quantity
and quality. This Department would normally request a
test well prior to approval.
The project will meet all the requirements of the Code of
the Town of Southold Subdivision of Land Regulations.

WHEREAS, a public hearing was held on the said subdivision
application and plat at the Town Hall, Main Road, Southold, New York,
on July 28, 1980 at 8:00 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of the
Town of Southold have been met by said subdivision plat and
application,
Now, therefore, be it RESOLVED that the application of Anita
McNulty and Helen McNulty for approval of said subdivision plat
prepared by Young & Young be approved and the chairman be authorized
to endorse his approval on the map subject to the following:
1. Elimination of flaglots making Lot No. i the full width of
the property with a 25 foot right-of-way over that property running
to Lot No. 2 with a l0 or 15 foot right-of-way to Peconic Bay running
over Lot No. 2.

Mr. Orlowski voted in the negative because he felt it would set a
precedent for undersized lots in the neighborhood.
Chairman of the Board of Appeals, Charles Gri~onis, and member

no problem with the chan~e in the fla~lots and it wou~d ~. b~w~
to go before their board again. -
On motion made by Mr. Gordon, seconded by Mr. Latham, it was
RESOLVED to approve change of right-of-way for resubdivided
lots 10, ll, 12 and 13 of "Map~of Captain Kidd Estates", map dated
January 21, 1980 and amended March 8, 1980, subject to the following:

The meeting was recessed at 10:55 a.m. After this time, the Board
went over the map of Fishers Island Estates prior to meeting with
Mr. Jansen Noyes, President of FIDCO. Mr. Wall took the Board on
several inspections. The first was a proposed subdivision of nine
acres into three lots on property of the Estate of Zabahonski. There
was a question as to who owns Crescent Avenue and this will be
researched. An inspection was made of the property to be subdivided
by Mr. Valentini into two lots also on Crescent Avenue. The Board
investigated the finished building of three units at the Golf Course
which building was to house help. The Board reviewed several
properties belonging to the Rutherfords but were unsure as to exactly
which property will be subdivided.
The Board reconvened at 1:50 p.m. with Mr. James Wall in attendauce.

With refernce to your letter dated March 18, 1960
to Southold Zoning Board of Appeals and with refe~nce
to our telephone conversation today, I enclose a map
.prepared by Young & Young Surveyors dated February 22,
1980 for Anita McNulty and Helen McNulty which shows
a wood bulkhead on the subject properties. Said bulk-
head has been maintained in good working order since its
installation many years ago.
We request that you verify the existence of said
bulkhead, and upon such verification issue a no jurisdiction
letter to me and to the Southold Zoning Board of Appeals
as you indicated to me today by telephone

Dear Ms. Kowalski:
We are in receipt of your letter, dated February 28, 1980. We are in agree-
merit with your designation of lead agency.
Indications are that soil conditions for individual sewage disposal systems
are acceptable; however, based on data from recent construction in the area,
the potable groundwater supply in the area is limited both in quantity and
quality. This Department would normally request a test well prior to approv-
al.
Our records indicate that these lots may be part of a major subdivision.
Whether these lots are, in fact, single and separate should be established
prior to approval.
If you have any questions, please feel free to contact the undersigned.

The following action was taken by the Southold Town Planning
Board at a regular meeting held March 10, 1980.
RESOLVED to report to the Zoning Board of Appeals on its
request for an over-view of the property of Helen &Anita McNulty
that it is the opinion of the Southold Town Planning Board that
this property should come in for a subdivision of the 3.2 acres
under current zoning standards as there is sufficient property in
all probability for three lots.

This Department has received the subject application for
permission to obtain Certificate of Occupancy-variance approving
insufficient width and area of proposed lots, Art. III, Sec. 100-31.
Pursuant to Article 8, Environmental Conservation Law,
6 NYCRR Part 617, and Chapter 44 of the Code of the Town of
' Southold, notice is hereby given that the Southold Town Board
of Appeals has determined that the project does not appear to
have a significant effect on the environment; and the project
is classified as a Type II action.
As an agency which may also be involved, you are hereby
requested to indicate whether or not you agree with this
Department's assuming lead-agency status and our initial
determination of non-significance for the subject project if
implemented as planned.
Please let us know your comments and recommendations on
this action not later than March 19, 1980 We shall
interpret a lack of response to mean no objection by your
agency.
