Dear Mr. Tillman:
The Town Board discussed your letter of September
13, 1980, which was received October 15, 1980 by the
Supervisor's Office, at their meeting on October 21,
1980, and Supervisor Pell and Town Attorney Tasker visited
the library a few days prior to that.
After a thorough review of the case, it was the
determination of the Board that the proper agency to
pursue this matter with is the Planning Board.

Dear Bill,
As I mentioned to you last Saturday night the
Mattituck Free Library's second appeal to Father Henry
for formal written permission to use the Church lot fell
through.q~
E~cept for an appeal to Councilman Drum, who is a
member of the Parish Council, which was suggested by Wm.
Essex our attorney, our only alternative is a request to
the Southold Town Board for a change in the status of the
parking lot.
Atticle XV, Section 100 - 150, P-10073 states that the
Town Board upon its own motion may amend, supplement, change,
modify or repeal. See Section A and B for procedures.
~ile the Town Board has the legal right to take action on
our behalf, we realize that such action may be time con-
Suming.
In the meantime, we have a completed extension ready
for public use. We need a temporary Certificate of Occupancy
so that the building can be used until a modified parking
lot can be built.
We would like to appear before the working session
of the Town Board on October 21st. If required we will
appear at the public meeting. ..
The basis of our appeal is'economic hardship, We
also would have to destroy many beautiful trees to acc0modate
a 19 oar parking lot. FurtherI we are afraid that perhaps
an undesirable element may uSe such a lot for non-library
related activities. This has been a problem at other libraries.
It is very difficult to understand the attitude o£ the
Planntng Board and the Zoning Board of Appeal. When East
Hampton:Public Library built a 4000 square foot extension
no off-street parking was required. Most recently, the
Riverhead Library was not required to add additional parking
for their large extension. It makes one wonder if our Town
government really has the interest of the public in mind.
We remain open to any helpful suggestions.

Temporary Certificate of Occupancy.
Gentlemen:
I am hereby requesting your consideration of a problem encounted when
attempting to obtain temporary certificate of occupanc~ for thc ~ubject
premises, based on a hardship.
At a special meeting of the Southold Town Planning Board, on At)ril 21, lqSO,
approval of the site for the subject addition was granted, subiect to a one
year review. This site plan indicated off-street parking in accordance
with the zoning code of the Town of Southold. The Library Board agreed
to the off-street parking as shown on the site plan although they felt that
some other reasonable alternative, at a much lower cost, could be pro-
posed and approved. Further, they'did agree to the site plan as presented
to the Planning Board with a stipulatiola at the meeting that they would be
given a reasonable amount of time, one year, to either get approval of
an alternate or complete a partying lot'.in accordance with the site plans.
Although, this was not stated in the minutes of the meeting of the Planning
Board, it had been verbally agreed to by the Planmng Board, and the
implication of-approval was there, and. probably tape recorded.
During he planning stages of this project, an effort to obtain Federal Funds
for the removal of Barriers for the handicapped was in progress. This
program would also provide the necessary parking in compliance xvith the
laxv. These plans were integrated into the total prolect plan, both in
anticipated product and funding.
Early in August, knoxving that the Federal Funds were to be delayed, I
broached the idea of a temporary Ceriiflcate of Occupancy with
Mr. George Fisher. At that time, he had agreed that if the building
was in compliance with the code and the Planning Board, he xvould issue
a ternporary Certificate of OccFpancy, 1%'e have both these elen]ents.
On August 21, 1980, on behalf of the Library Board, I made application
for a temporary Certificate of Occupancy because the parking lot was
not completed. The Librar? did not h4ve the funds for this improve-
ment. They were depending on a portion of the funds for this parking
lot to be farthcoming from Federal Funds allocated from Barrier Removal
for the handicapped. The feasibility s~tudy made by Sills and Company
on Barrier Removal included the required drive~vay and t~vo parking
spaces designed for the handicapped, as well as a walk. This xvould
defray one-third of the .cost of parking facility, which would greatly
reduce the remaining burden to be carried by the Library.
On August 26, 1980, a notice of disapRroval of application was issued
by Nit. Edward Hindermann, B~uildingiand Housing Inspector, Town of
Southold. The reason for dlsapp'roval~was "Certificate of Occul)ancy
is denied until final site plan approval is given". Several lette?s passed,
(see enelosurds). '
Article Xlll, Section 100-~44 of the Town Zoning Code does not preclude
the issuance of a temporary Certificate of Occupancy. %Ye do in fact
have an approved site plan with the difference being that all work is not
completed. The purpose of the temporary Certificate o£ Occupancy is to
alleviate hardship cases such as these. A~n I to infer that the avenue of
the temporary Certificate of Occupancy is closed?
I.would agree with the Buildin~ iuspector if applicatiou were being made
for a final Certificate of Occupancy. However, the rea~ou for requesting
a Temporary Certificate of Occupancy !s ex,actly as stated above, and well
within the New York State and 'l~own
If the Building Inspector's Office is concerned about the question o~ safety,
then there is an alternative. 1%~ould s~ggest that we be allowed to use the
cleared area behind the building as a temporary parking field until th~ znoney
is raised to complete the required parking. It is intended that this %vi]! be a
sod covered area. ;
I believe, that a request for a temporaTy Certificate .of Occupancy is
reasonable, under the circumstknces,i I fur.ther belie~fe, this Certificate
of Occupancy can be legally iss_~ed, anld also that the Board of Trustees
of the Library ~vou!d not put the:library ~njeopardy by nor complying
with any regulation or limitation. I believe that the Library.wi1! comp!y
without reservation to any reasonable stipu-la.tion made by the Building
Inspector's office, so~ that they may be allowed to use the bui.lding.
This situation has caused, considerable impact in terms of non-productive
work on my part, on the part of the Library Board, and the Town Depart-
ments involved. It seems like a consic~erable waste of time to say nothing
about the fact that a Community facility is staflding dormant.
I h~reby request your consideration, ia ,taking some action, so that we may
be allowed to use the library building..

~attituck Library Presubmission. Steve Tsontakis, ~esident of the'

~/ were present. The Library proposes an addmtion to its present
~ building. ~ere is a problem providing parking. At present, the
overflow parks in the ch~ch parking lot. There would be a problem

getting an agreement from the Diocese of Rockville Centre. The
inadequate side yard will be a matter for the Zoning Board of
Appeals. They will also require a special exception toconstruct
and a variance from the parking requirement. Mr. Raynor would
lire to get the opinion o~ the town attorneV in regard to a waiver
of the parking requirement. One of the officers of the library
commented that the expense of a parking lot would preclude the
addition. . ~
Robins Island. The Board does not want to act on the sketch map
'for the development of Robins Island until such time as a field
inspection can be arranged for the Planning Board and membersof~
the Conservation Advisory Council. Mr. Esseks will be contacted
to make arrangements.
On motion made by Mr. 0rlowski, seconded by Mr. Wall, it was
RESOLVED to set 9:00 p.m., Monday, February 25, 1980, at the

for a public hearing on the question of the approval of the

I have reviewed the site plan for the above and the following are
my comments:
While your plans do not state, I have assumed 30' equals
1". Accordingly, I scaled existing building and find it
occupies an area of 3248 sq. ft. of land; addition of
30.0' X 40.0' is a total Of 1200 sq. ft. Total building
area, therefore, should be 4448 sq. ft. or, 6.74% of lot
coverage.

SUBSECTION
THE SPECIAL EXCEPTION IS REQUESTED BECAUSE The Library Board is desirous of
extending the existing library building to accomodate the need for expanded
library service to the community. Since this site is zoned agricultural as
is the adjoining church property the building inspector has denied application.
Let it be noted that the construction of the existing building did not require an
exception to the Zoning Ordinance.
This expansion will in no way change the character of the neighborhood and would
be a considerable distance away from the residential neighbors adjoining at the
rear of the property.
