A Variance to the Zoning Ordinance
A special exception

1'. ~'~CT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because:
A. Side Yard
Total lot width is approximately 1341 wide therefore a 1001 total
side yard wouldCnot allow the constrUCtion of a* 40t wide ~xtensio~

because of:t~keLirr~egular shape of the lot, Complicnce wou~d~requir, e
offse{ting the addition at much greater expense and less of utility.
Parking
Addition of parking area would require the remo~rl ef rnauy beautiful
trees eliminating the isolation from not o~/y the church and the
lumber yard but also the residential neighbors to the south.
2. The hardship created is UNIQUE and is not shored by oil properties alike in the immediate
vicinity of this property and in this use district b~ecaus~_ t~:let,is~a~L~o,v~/3~tb.~neigb, b0rs

3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the area is generally btti~aess oriented,

Term Exoires March 30,
After investigation and inspection, the Board finds that the applicant,
Mattituck Free Library, in Appeal No. 2665, is'requesting permission to
construct addition with an insufficient sideyard setback to 30 feet, and
for permission to waive off the street parking requirements of Article XI,
Section 100-112A of the Southold Town Code, whereas they state if they
complied it would require the removal of many beautiful trees eliminating
the isolation from not only the church and the lumberyard but also the
residential neighborhood to the south and the sideyard compliance requir-
ing offsetting the addition at much greater expense and loss of utility.
The parcel ~nvolved contains approximately 66,000 square feet; the
existing building a floor area of 2830 square feet, and the proposed
addition 1200 square feet to be constructed at the rear of the existing
building. The total floor area of the existing and proposed structures
will compose 4030 square feet. The Board finds that the existing build-
ing and proposed addition are located on the northerly one-third of
the lot, and that the entire remaining two-thirds is unoccupied.
The Board finds that the applicant has not shown any hardship or
difficulty in complying with the parking requirements of the zoning
code. ~owever, the Board does find that by reason of the location of
the existing building that a hardship would exist with respect to the
proposed addition with the requested sideyard setback and approves the
the addition proposed as shown on the plan filed with this Board. The
Board determines that the applicant has not proved any hardship or
difficulty with respect to providing the required parking; that there
is land available for parking, and therefore denies the variance for
the reduced parking requirements.
The Board finds that the circumstances present in the variance for
insufficient sideyard are unique, and that strict application of the
ordinance would produce practical difficulties or unnecessary hardship.
The Board believes that the granting of the sideyard variance in this
case will not change %he character of the neighborhood and will observe
the spirit of the zoning ordinance.
On motion by Mr. Douglass, seconded by ~r. Grigonis, it was
RESOLVED, that MATTITUCK FREE LIBRARY, Main Road, Mattituck, New
York 11952, in Appeal No. 2665, be DENIED a Variance to the Zoning
Ordinance, Article XI, Section 100-IT~2-~ to waive off the street park-
ing requirements, .bp~.~e GRANTED a Variance to the Zoning ordinance,
Article III, Section 100-~1 for permission to construct addition with
an insufficient s{deya~d setback-to-30 feet as applied for, SUBJECT
TO THE FOLLOWING CONDITIONS:'
(1) That th9 applicant is required to provide off the street
parking p~rsuant~to the Southold Town Code regulations;
(2) Tha~ ~his mat~er be referred to the Suffolk County Planning
Commission pursuant to'Section 1332 of the Suffolk County Charter;

Pursuant co the requirements of Sections 1323 to 1332 of the Suffolk County
Charter; the above'captioned application which has been referred to the Suffolk
County Planning Commission is considered to be a matter for local determination.
The decision of local determination should not be construed as either an approval
or disapproval.
CommentS: The parking waiver appears inappropriate and unwarranted as sufficient
information has not been submitted to demonstrate compliance with applicable
variance criteria. Available on-site area should therefore be improved for parking
purposes.

"Site Plan" (Proposed Expansion)
Dear Steve:
I have reviewed the site plan for the above and the following are
my comments:
1)
While your plans do not state, I have assumed 30' e~uals
1". Accordingly, I scaled existing building and find it
occupies an area of 3248 sq. ft. of land; addition of
30.0' X 40.0' is a total of 1200 sq. ft. Total building
area, therefore, should be 4448 sq. ft. or, 6.74% of lot
coverage.
2) Additiom is within the allowable 50.0' to property
variance required,' (Art. III,Sec.100-30-~) 6 ~.~-
Lot coverag% 20% allowable, actual 6.11% (Art. III,
Sec.lO0-30 B)
Height of building not shown - 35.0' max. allowable
(Art. III,Sec. 100-30 C)
5) Are there to be any landscape changes (Art. III,
Sec. 100 D)
6) Exterior illumination required - not given
(Art. III,Sec.100-30 E)

"Site Plan" (Proposed Expanslon)
7) Off street parking areas are required - Art. XI, Sec.lOO-
112.A). Based on following formula - 1 space for each
200 sq. ft. of floor area: not less than 1 for each 5
spots. (Seating not given)
No off street parking exists; existing requires 16 spaces
plus an additional 6 spaces - allowable 1 space for exiist~
ing driveway total 21 spaces required.
A Special Exception from Board of Appeals would be required, subject
to site plan approval by the Planning Board.
