State of New Yolk Ne. 52.8125850. Suffolk ~ Term Exoires March 30, After investigation and inspection, the Board finds that the applicant, Mattituck Free Library, in Appeal No. 2665, is'requesting permission to construct addition with an insufficient sideyard setback to 30 feet, and for permission to waive off the street parking requirements of Article XI, Section 100-112A of the Southold Town Code, whereas they state if they complied it would require the removal of many beautiful trees eliminating the isolation from not only the church and the lumberyard but also the residential neighborhood to the south and the sideyard compliance requir- ing offsetting the addition at much greater expense and loss of utility. The parcel ~nvolved contains approximately 66,000 square feet; the existing building a floor area of 2830 square feet, and the proposed addition 1200 square feet to be constructed at the rear of the existing building. The total floor area of the existing and proposed structures will compose 4030 square feet. The Board finds that the existing build- ing and proposed addition are located on the northerly one-third of the lot, and that the entire remaining two-thirds is unoccupied. The Board finds that the applicant has not shown any hardship or difficulty in complying with the parking requirements of the zoning code. ~owever, the Board does find that by reason of the location of the existing building that a hardship would exist with respect to the proposed addition with the requested sideyard setback and approves the the addition proposed as shown on the plan filed with this Board. The Board determines that the applicant has not proved any hardship or difficulty with respect to providing the required parking; that there is land available for parking, and therefore denies the variance for the reduced parking requirements. The Board finds that the circumstances present in the variance for insufficient sideyard are unique, and that strict application of the ordinance would produce practical difficulties or unnecessary hardship. The Board believes that the granting of the sideyard variance in this case will not change %he character of the neighborhood and will observe the spirit of the zoning ordinance. On motion by Mr. Douglass, seconded by ~r. Grigonis, it was RESOLVED, that MATTITUCK FREE LIBRARY, Main Road, Mattituck, New York 11952, in Appeal No. 2665, be DENIED a Variance to the Zoning Ordinance, Article XI, Section 100-IT~2-~ to waive off the street park- ing requirements, .bp~.~e GRANTED a Variance to the Zoning ordinance, Article III, Section 100-~1 for permission to construct addition with an insufficient s{deya~d setback-to-30 feet as applied for, SUBJECT TO THE FOLLOWING CONDITIONS:' (1) That th9 applicant is required to provide off the street parking p~rsuant~to the Southold Town Code regulations; (2) Tha~ ~his mat~er be referred to the Suffolk County Planning Commission pursuant to'Section 1332 of the Suffolk County Charter; (3) That the ingress and egress be at least 20-feet wide.
