VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because (SEE REVERSE SIDE) difficulties or unnecessary (b) The hardship created (is) (~- noi) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because (SEE REVERSE SIDE) (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character ~} the district because (would not) (SEE REVERSE SIDE) and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Building Inspector ( ) be confirmed ( ) ha reversed. ) be denied and ZONING BOARD OF APPEALS FORM ZB4 After investigation and personal inspection, the Board finds that applicant has applied for a variance for permission to pivot the easterly side yard by 12 feet decreasing the existing undersized lot to the east by 1,000 feet, more or less, and increasing the existing undersized lot to the west by 1,000 feet, more or less, due to the unusual loca- tion of the cesspool and driveway for the westerly parcel on the easterly parcel. The Planning Board gave formal approval of the change in lot line at a regular meeting held June 30, 1980. This Board feels that applicant's request is not impractical or unreasonable under the cir- cumstances. The Board finds the circumstances present in this case are unique, and strict application of the oYdinance would produce practical difficulties or unnecessary hardship. The Board believes the granting of a variance in this case will not change the character of the neigh- borhood and will observe the spirit of the zoning ordi- nance. On motion by Mr. Tuthill, seconded by Mr. Grigonis, it was RESOLVED, that Adeline Lee be granted a Variance to the Zoning Ordinance, Article III, Section 100-30, as applied for in Appeal No. 2723. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sar HARDSHIP becau~ the cesspool and driveway of the adjoining property on the East, also owned by the applicant, encroach on this lot. The easterly side yard of this lot is quite large and will not be affected by the small decrease in side yard. The reduction in lot size is only about 1,000 square feet and the size of the lot will not be reduced below 20,000 square feet, the permissible lot size at the time these lots were created by subdivision dated May 13, 1969. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because of the encroachments of the driveway and cesspool mentioned above. 3.
