By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties hardship because (SEE REVERSE SIDE) (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because (sEE REVERSE SIDE) (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) (SEE REVERSE SIDE) and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Building Inspector ( ) be confirmed ) be reversed. ) be denied and FORM ZB4 ZONING BOARD OF APPEALS After investigation and inspection, the Board finds that applicants present!yhave two legal lots -- that of Daniel Hallock containing approximately 47,000 square feet in area and approximately 145 feet in width, and that of Susan Hallock containing approximately 40,000 square feet in area and ap- proximately 200 feet in width. Existing on the westerly parcel is a two-story frame house, and it is found that the septic system for the house is not within the boundary lines of that parcel. Applicant proposes the change the lot line between the two parcels to an angle as shown on the amended survey dated August 5, 1980, giving approximately 48,000 square feet in area and 195 feet in width to the westerly parcel of Daniel Hallock, and giving approximately 38,000 square feet in area and 150 feet in width to the easterl parcel of Susan Hallock. The Board does agree with the reasoning of the applicant. The Board finds the circumstances present in this case unique, and strict application of the ordinance would pro- duce practical difficulties or unnecessary hardship. The Board believes that the granting of a variance in this case will not change the character of the neighborhood and will observe the spirit of the ordinance. On motion by Mr. Tuthill, seconded by Mr. Goehringer, it was RESOLVED, that Susan Hallock be granted a Variance to the Zoning Ordinance, Appeal No. 2713 approving the insuf- ficient area of the easterly parcel (owned by Susan Hallock) of 38,000 square feet as shown on the amended survey dated August 5, 1980, SUBJECT TO THE FOLLOWING CONDITIONS: (a) That applicant obtain the appropriate approvals of the Southold Town Planning Board; (b) That this matter be referred to the Suffolk County Planning Commission pursuant to Section 1332 of the Suffolk County Charter. Southold, N.Y. 11958 August ll, 1980 Re: Appeal No. 2713 Dear Sirs: The enclosed surveys are presented with the purpose of, again, petitioning the Board for a variance with regards to the original appeal as recessed on July 1st noted above. Taking into consideration the Board's recommendation that the square footage be increased with regards to the unim- proved parcel, please note that the amended line brings the square footage up to 38,000sq. ft., a 5,000sq. ft. increase above the original request. If consideration is allowed to be given to the amount of 'usable land" with regards to the two parcels, I think the amended proposed line is most equitable and safely provides acquistion of the septic system for the existing residence. Of course, my main objective is to maintain a buildable lot for only one house concerning the unimproved parcel involved in this petition. Thank you for your continuing considers~ion of the matter. Enclosures (6) Sincerely, Susan Hallock O O MEMORANDUM FOR FILE OF SUSAN HALLOCK - APPEAL NO. 2713 Tuesday, August 5, 1980 This date Mrs. Susan Hallock was in asking where would be the best place to situate the lot line. The secretary told her that a few of the Board members felt that the 40,000 square feet could be reached by including part of the wetlands unbuildable area. Mrs. Hallock said she would be agreeable to draw- ing the line approximately 5' from the cesspools at an angle drawn from the 150' road frontage mark for Lot 2 and then drawn at an approximate angle_of 140© at the upper wetlands mark and over to get the 7,000 square feet needed for Lot 2. Mrs. Hallock would have the surveyor mark out the new line(s) and submit same as soon as possible before the August 14, 1980 meeting. In the interim, Mrs. Hallock will get a letter from the Planning Board indicating they had no objection to the proposal. Mr. Fisher of the Building Department said that if the Planning Board had no objections and indicated so in writing, and the lots contained at least 40,000 square feet and 150 road frontage, a Certificate of Occupancy for vacant land can be issued. No variance would be needed. L.
