By resolution of the Board it %vas determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because (SEE REVERSE SIDE) difficulties (b) The hardship created (is) (is not) unlque and (would) (would not) be shared by all properties alike in the hnmediate vicinity of this property and in the same use district because (SEE REVERSE SIDE) (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (SEE REVERSE SIDE) (would not) and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. (SEE REVERSE SIDE) ) be denied and FORM ZB4 ZONING BOARD OF APPEALS After investigation and inspection, the Board finds that applicant is requesting approval of insufficient area of three parcels due to the widening of Grange Road Extension, which is reducing each of the parcels five feet deep. The Board finds that the subject parcels are part of the "Exception List" for area and width requirements of the Town Zoning Ordinance, Article I, Section 100-12. Applicant states the reason for this change in area is because they wish to dedicate Grange Road Extension to the Town of Southold, and the Town requires a 50-foot wide road for dedication. The road is presently 40-feet wide, and five feet would be added from each side. The Board agrees with the reasoning of the applicant(s). The Board finds that the circumstances present in this case are unique, and that strict application of the ordinance would produce practical difficulties or unnecessary hardship. The Board believes that the granting of a variance in this case will not change the character of the neighborhood and will observe the spirit of the ordinance. On motion by Mr. Tuthill, seconded by Mr. Douglass, it was RESOLVED, that RENE GENDRON, by Rudolph H. Bruer, Esq., be GRANTED a Variance to the Zoning Ordinance, Article III, Section 100-31 as applied for. Accomplishing this necessitates reducing the depth of Lots 11 & 12 by five (5) feet along Grange Road Extension, and reducing the width of Lot 9 by five (5) feet along Grange Road Extension (as shown on ~ed photocopy of portion of survey), thus creating three (3) lots (Continue on other side) of insufficient area and width. REASON FOR APPEAL O Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because Appellant would be unable to dedicate Grange Road Extension to the Town of Southold. 2. The hardship createdis UNIQUE and is notshared by all properties alike in the immediate vicinity ofthis property and in this use district because the subdivision known as "South Harbor ~Homes" ( of which the aforesaid lots are a part), is excepted from the lot area and lot width requirements under Article I, Section 100-12 of the Southold Town Zoning Ordinance. A further five (5) foot reduction would not affect the use of the property. 3.
