By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because (SEE REVERSE SIDE) practical difficulties or unnecessary (b) The hardship created (is) (is not) unique and (Would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because (SEE REVERSE SIDE) (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because - (SEE REVERSE SIDE) (would not) and therefore, it was farther determined that the requested variance ( ) be ~ranted that the previous decisions of the Building Inspector ( be confirmed ( ) be reversed. ) be denied and FORM ZB4 ZONING BOARD OF APPEALS After investigation and personal inspection, the Board finds as follows: Appellant has appealed to thi~iBoard seeking a variance to construct a new single-family dwelling with an insufficient frontyard setback of Manhanset Avenue of 35' and insufficient rearyard segback at the west end of 25'. The premises in question is a parcel of land containing an area of 11,460 square feet as shown on survey of R. Van Tuyl amended September 4, 1980, and is a corner lot as defined by Article III, Section lO0-13 of the Code. Applicant has desig- nated the shortest yard (22') to be his sideyard, and the west Yard (25') to be his rearyard. There are no structures existing on the subject premises. The Board finds the circumstances present in this case are unique, and strict application of the ordinance would produce practical difficulties or unnecessary hardship. The Board believes the granting of a variance in this case will not change the character of the neighborhood and will observe the spirit of the zoning ordinance. On motion by Mr. Grigonis, seconded by Mr. Goehringer, it was RESOLVED, that Gus Dourmas, by William H. The hardship created is UNIQUE and is not shored by all prope~ies alike in the immediate vicinity of this property and in this use district because the subject parcel ±s a corner lot. If the house were located so that the provisions of Section lO0-34~'~orner Lots, were met, either the side yard or rear yard requirement could not be met. If the house were located so that the rear yard requirement under the bulk schedule were met, the front yard setbacks could not he met. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because a single family dwelling is to be erected on the subject parcel which will be setback 71 feet from Landing Lane and 35 feet from Manhanset Avenue. The house will also be setback 25 feet from one adjoin- ing neighbor and 22 feet from the other adjoining neighbor. Both of those set- backs are greater than what would be required for a side yard requirement.
