ZONING BOARD OF APPEALS FORM ZB4 After investigation and personal inspection, the Board finds as follows: Appellant has appealed to this Board seeking a variance approving the insufficient area of two proposed parcels, zoned residential-agricultural, to wit, 37,500 square feet each and having 150 foot road frontage. The Board finds and determines that the relief requested in relation to the Code requirements is not substantial; that if the variance is granted no substantial detriment to adjoining properties will be created; that the interests of justice will be served by granting the relief requested; that no adverse effect is produced on available governmental facilities of any increased population; that no substantial change will be produced in the character of the neighborhood On motion by Mr. Grig6nis, seconded by Mr. Doyen, it was RESOLVED, that Katie J. Dexter, Park Avenue, Mattituck, NY (by Gary Flanner Olsen, Esq.) be granted a variance to the zoning ordinance, Article III, Section 100-31 approving the insufficient area of 37,500 square feet, as applied for, and subject to applicant's obtaining approval from the Southold Town Planning Board for the subject minor subdivision. STRICT APPLICATION OF THE ORDINANCE would prOduce practical difficulties or unneces- sary HARDSHIP because Applicant seeks to divide the subject premises containing a total area of 1. 722 acres into two parcels, each containing 37, 500 square feet. Each parcel would have frontage on Park Avenue of 150 square feet. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because each parcel to be created would con- rain 37, 500. square feet rather than 40, 000 square feet. 3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because parcels to be created would be generally in keep- lng with the size and shape of parcels in the neighborhood and would meet all of the Town requirements other than being slightly under the required 40, 000 square feet, i.e. each parcel would be 37, 500 square feet.
