The validity of this permit is or may be subject to the ap~rovat of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall nor commence operations here-
unoer until such approval nas been obtained in writing. The failure to obtain such other approval when
reouired shall subject this permit to immediate revocation by tine Trustees upon receipt by the
Trustees of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceotance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and properw resulting from such operations. By such acceptance, the applicant also agrees to indemn[-
~ and save harml ~ss the Town, and its officers, agents and employees from an'y' and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
~qis permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter u con the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially: A. AdverseI¢ affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidat flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral suoport of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

Dear Mr. Schuler:
The following action was taken by the Board of Trustees
during their regular meeting held on September 25, 1986 regarding
your wetland application no. 421.
WHEREAS, Kenneth Schuler applied to the Southold Town Trustees for a permit under
the provisions of the Wetland Ordinance of the Town of Southotd,
application dated July 10, 1986 , and
WHEREAS said application was referred to the Southold Town Conservation
Advisory Council for their findings and recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on September 25, 1986 at which time all interested persons ware
given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will not
affect the health, safety and general welfare of the people of the Town,
NOW, THEREFORE, BE IT
RESOLVED that KENNETH SCHULER BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS
OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Consnruct a catwalk and
deck with float to be secured with two spiles on property located at
3145 Main Bayview Road, Southold based on his mutual agreement to go along
with the revisions instituted by the Board of Trustees as follows: Stairs
are to be constructed on the north side of the property. The catwalk is to
be elevated 3'6 above the grasses to be constructed on the north side of
the property parallel to same and 5' from the drainage easement 8' off the
property line. This permit will expire on September 25, 1987 if work has not
commenced by said date. There are two
inspections required and the Trustees are to be notified upon the
completion of the work. Prior to the issuance of said permit by the
Clerk, the applicant shall file with the Clerk a certificate that he

has public liability insurance policies insuring against any liability
which may arise in the performance of the operations pursuant to such
permit in such amount as shall be ~ixed by the Trusnees, which said
pclicies shall name the Town as a name insured. Please take further
notice that this declaration should not be considered a determination
made for any other department or agency which may also have an application
pending for the same or similar project.
The following fees are due and payable. Upon remittanc your
permit will be forwarded by mail.

The following-recommendations were made by the CAC at the regular
meeting held Thursday, August 21, 1986:
No. 409 - Disapprove pending a Declaration of Significant Impact.
No. 415 - Approve

No. 427 - Declare Non - Significant Recommend denial of wetland

No. 418 - Approve but suggest the applicant reconsider. The project may
result in the loss of beach if bulkheaded. The current
vegetation and beach system is working very well.
No. 419 - Table pending receipt of a good quality map-site and shoreline.
No. 420 - Approve with stipulations. Must take action to prevent erosion
and runoff on east side of bulkhead; install fill and put in
ground cover to prevent rain induced runoff.
NO. 423 ~ Approve with proposals. Construct cesspool away from wetlands;
put in drywells to contain runoff on site; no bulkhead; no
lawn; build a catwalk; leave natural vegetation; and plant
buffer around foundation.
