SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 13, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. BASIS OF APPLICATION: The applicant requests a Special Exception pursuant to Article III, Section 280-13B, Subsection 14 of the Zoning Code, to operate a four (4) bedroom Bed and Breakfast within his existing single-family dwelling, accessory and incidental to his residential occupancy under the Building Department's Certificate of Occupancy #Z-22652 dated October 8, 1993. The proposed four bedrooms shall be for lodging and serving of breakfast to eight B & B casual, transient roomers. The applicant received a certificate of occupancy for an "as-built" alteration for a finished basement in order to provide for recreation areas as depicted in his submitted floor plans prepared by Sandra Weiss, R.A., undated and received February 15, 2017. The proposed 4 bedroom B&B was based upon the conversion of the basement into private habitable space for the applicant. ADDITIONAL INFORMATION: The Zoning Board previously approved a Special Exception Application for a Bed and Breakfast in a residence owned by James O'Hagan also located on Windward Road. The O'Hagan's currently operate the only Bed & Breakfast in this small six home residential development. The O'Hagan residence is situated as the first residence as one enters the private road. This location aids in preventing B & B guests from disrupting the lives of homeowners on Windward Road from County Road 48. Moreover, the floor plan layout of the O'Hagan home is conducive to the operation of a B & B with defined private areas for the homeowners and a separate area for the guests. Additionally, guests are barred from using the private beach at the end of the private road. Page 2,May 18,2017 r #7049,Kougentakis SCTM.No. 1000-14-2-30.5 During the public hearing, the neighbor, who lives in the home that is adjacent to the subject property, testified that she does not believe that the applicant lives in the house as a full time resident. She further testified that even after the short term rental law was adopted by the Town Board, the applicant continued to rent his house through an online website for less than the 2 week required minimum stay, and allowed large "party buses" to be driven down their private road, dropping off large numbers of people at the applicant's home and thereby infringing on the quiet enjoyment of her own property. AMENDED APPLICATION: The applicant's attorney stated at the hearing that the application is being amended to a three (3) bedroom Bed and Breakfast, and that one of the bedrooms located on the second floor will be used by her client. The Board asserted that the owner is required to occupy a bedroom with its own private bathroom. A bathroom used by the owner shall not be shared with guests. Additionally, if the owner wishes to use the basement space for his private living space, then he would need to seek a certificate of occupancy from the Building Department, as well as approval from the Suffolk County Department of Health. APPLICABLE PROVISIONS OF TOWN CODE: § 280-142: No special exception approval shall be granted unless the Zoning Board of Appeals specifically finds and determines the following: A. That the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts. B.That the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the proposed use is to be located or of permitted or legally established uses in adjacent use districts. C.That the safety, the health, the welfare, the comfort, the convenience or the order of the Town will not be adversely affected by the proposed use and its location. D.That the use will be in harmony with and promote the general purposes and intent of this chapter. E.That the use will be compatible with its surroundings and with the character of the neighborhood and of the community in general,particularly with regard to visibility, scale and overall appearance. F.That all proposed structures, equipment and material shall be readily accessible for fire and police protection. X280-143 MATTERS TO BE CONSIDERED: A.The character of the existing and probable development of uses in the district and the peculiar suitability of such district for the location of any of such permitted uses. B.The conservation of property values and the encouragement of the most appropriate uses of land. C.The effect that the location of the proposed use and the location that entrances and exits may have upon the creation or undue increase of vehicular traffic congestion on public streets, highways or sidewalks to assure the public safety. D. The availability of adequate and proper public or private water supply and facilities for the treatment, removal or discharge of sewage, refuse or other effluent (whether liquid, solid, gaseous or otherwise) that may be caused or created by or as a result of the use. E. Whether the use or the materials incidental thereto or produced thereby may give off obnoxious gases, odors, smoke or soot. F. Whether the use will cause disturbing emissions of electrical discharges, dust, light,vibration or noise. G. Whether the operation in pursuance of the use will cause undue interference with the orderly enjoyment by the public of parking or of recreational facilities, if existing or if proposed by the Town or by other Page 3,May 18,2017 #7049,Kougentakis SCTM.No. 1000-14-2-30.5 competent governmental agencies. H.The necessity for bituminous-surfaced space for purposes of off-street parking of vehicles incidental to the use and whether such space is reasonably adequate and appropriate and can be furnished by the owner of the plot sought to be used within or adjacent to the plot wherein the use shall be located. I_ Whether a hazard to life, limb or property because of fire, flood, erosion or panic may be created by reason of or as a result of the use or by the structures to be used therefor or by the inaccessibility of the property or structures thereon for the convenient entry and operation of fire and other emergency apparatus or by the undue concentration or assemblage of persons upon such plot. J. Whether the use or the structures to be used therefor will cause an overcrowding of land or undue concentration of population. K. Whether the plot area is sufficient, appropriate and adequate for the use and the reasonably anticipated operation and expansion thereof. L. Whether the use to be operated is unreasonably near to a church, school, theater, recreational area or other place of public assembly. M. Whether the site of the proposed use is particularly suitable for such use. N. Whether adequate buffer yards and screening can and will be provided to protect adjacent properties and land uses from possible detrimental impacts of the proposed use. O. Whether adequate provision can and will be made for the collection and disposal of stormwater runoff, sewage, refuse and other liquid, solid or gaseous waste which the proposed use will generate. P. Whether the natural characteristics of the site are such that the proposed use may be introduced there without undue disturbance or disruption of important natural features, systems or processes and without risk of pollution to groundwater and surface waters on and off the site. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 4, 2017, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, and upon review of the code requirements set forth pursuant to Article III, Section 280-13B(14) to establish an Accessory Bed and Breakfast, the Board finds that the applicant complies or does not comply with the requirements for the reasons noted below: 1. Petros Kougentakis the applicant herein, is the owner of the property at 590 Windward Road, Orient NY. The waterfront property is improved with a 2 story brick house and garage with masonry deck as shown on the survey by John T Metzger, LLS, dated December 21, 2016. Testimony from a neighbor alleges that the owner/applicant has not occupied this home as his principal residence. The applicant has another residence at 37 Bassett Avenue in Brooklyn, NY. In testimony at the public hearing, the applicant stated that he now rents that dwelling and that his Orient residence is currently his principal dwelling. Board research revealed that, as of May 12, 2017, the Brooklyn home is still listed as the applicant's principal residence on the NYC Department of Finance assessment roll and that the applicant receives a STAR exemption on that property which requires that the property be declared as a principal residence. The STAR exemption approval is based on the taxable status of the property and owner as of January 5,2017. 2. The applicant's plans comply with the on-site parking requirements and provide for seven parking spaces, two for the principal single-family use and one (1) for each of the proposed Bed and Breakfast bedroom(s) 3. In the amended application, the applicant applied for three guest bedrooms and one personal bedroom for himself on the second floor. The applicant proposed to use the smallest bedroom with Page 4,May 18,2017 97049,Kougentakis SCTM.No. 1000-14-2-30.5 a bathroom shared with guests as his own personal room. The personal room is adjacent to the three proposed guest bedrooms, one of which has a private en suite bathroom. In the application, the owner did not identify on the submitted floor plans any proposed personal area in the home. A Bed and Breakfast operation should have a defined personal area for the owner/operator and a defined area for guests. A personal interior site inspection by the Board Members, in addition to a photograph submitted with the application, showed sleeping beds and mattresses set up in the basement. The certificate of occupancy does not permit legal sleeping quarters in the basement. 4. The Accessory Bed and Breakfast, as applied for, is not reasonable in relation to the District in which it is located, adjacent use districts, and nearby and adjacent residential uses. The applicant's residence is part of a small six lot subdivision accessed off of CR 48 by an unpaved private 30 foot wide Right of Way (Windward Road) which is privately maintained by property owners. Testimony was given at the hearing by neighbors that there is no formal procedure or homeowner's association responsible for maintaining the private Right Of Way. The applicant's property is a flag lot at the end of Windward Road. To reach the subject property, one must drive on Windward Road, passing all of the other homes in the subdivision. The increased traffic and use of the property will not be in harmony with the quiet, private, character of this small community and will be detrimental to all of the private properties the applicant's guests will have to drive past. 5. This accessory use will prevent the orderly and reasonable uses proposed or existing in adjacent residential use districts. The applicant is proposing to be the second B & B to operate in a six lot community. If the special exception were to be granted, one-third of the residential community would consist of commercial enterprises. One-third of all homes in a district becoming B & B's would intensify density in any residential district, and furthermore, create a hardship for the other property owners by affecting their safety, by increasing noise levels and a transient population, and by limiting the quiet enjoyment of their property. If the Zoning Board of Appeals were to approve this B & B then this district would lose its private residential character and this Board would, in effect, be re-zoning this district through the special exception process. 6. Evidence has been submitted to show that the safety, health, welfare, comfort, convenience or the order of the town will be adversely affected. Since there is no formal procedure for maintaining the road and no one is responsible for guaranteeing that the road is maintained up to the safety standards pursuant to Section §280-A of the New York Town Law, there is no guarantee that emergency services can access the home if guests of the proposed B&B or property owners are in need of assistance. 7. This zoning use is authorized by the Zoning Code through the Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory use may be occupied. 8. Adverse conditions were found after considering items listed under Section 280-142 and 280-143 of the Zoning Code. The layout of the applicant's home is not conducive to operating a professional B & B. The approval of a second B & B in this small six home sub-division will create a hardship for the other homeowners which includes an increase in noise and vehicular traffic, which will undermine the homeowner's right to the quite enjoyment of their properties, congestion and maintenance problems on the private right of way, and the possible reduction of property values. ZBA Application#7049. The only comment I can offer is with regard to the road access. This road/driveway was approved by Planning approximately 30 years ago. My only comment would be in regard to the maintenance and up keep of this access road. If a minimum 12' wide road has been maintained without ruts and/or pot holes, and; If there is a clear 15'x 15' corridor free of vegetation to allow access for emergency vehicles there would be no issues. Such precautions may include providing adequate work area between the 10' contour or topographic crest and the project- (i.e._a 15'_to_20'- wide constrlxctign area) __ or erection of a temporary fence, barrier, or hay bale berm. If I remember correctly, the application contemplated the use of the basement as habitable space, for which the applicant did not have building department, or department of health approval. Pat Moore's position was that she could make the application and get approval for the 6713 and then obtain the above approvals. I advised the Board that I did not think the application should be heard until the applicant obtained the above-referenced approvals. Mr. Kougentakis came to my office and I did tell him his other option was to amend the application so that the basement was removed as habitable space from the application. I do not know if the application has been amended, or if Mr. Kougentakis received department of health and/or building department approval for the basement. Last year,the ZBA, following considerable objection of four of the six homeowners, granted a bed&breakfast application to James O'Hagan (Application number 6945). The current Kougentakis application represents the prospect of a second bed &breakfast on Windward Road—approving a second B&B will turn a private,family focused enclave into a busy, boisterous and short term rental neighborhood. As a father of three small children, I'm sure that you can understand my concern for their safety and exposure to lude behavior. My opposition to the application includes, but is not limited to,the following: 1. Applicant is a repeat offender of the Transient Rental Law("TRL") passed by the Town of Southold. The Town previously attempted enforcement of the TRL against Applicant(see Attachment A). Applicant repeatedly violated the TRL following attempted enforcement. The Town sued Applicant attempting to implement a TRO (see Attachment B). Applicant continued to violate the TRL and the attempted TRO. A contempt of court count is pending against Applicant in New York State Court(see Attachment C). Applicant's extensive defiance of the Town Code should preclude Applicant from a special exception permit due to Applicant's well established history of abuse. 2. The Applicant has not,as of the date of this letter,occupied the subject property or has otherwise used the subject property as a primary residence. As the ZBA should be aware, Windward Road is a private drive of six homes. Last year, the ZBA, following considerable hearings, granted a bed &breakfast application to James O'Hagan (Application# 6945) (see Attachment A). The current Kougentakis application represents the prospect of a second bed &breakfast on Windward Road. Opposition to the application includes, but is not limited to,the following: 1. The Applicant has not, as of the date of this letter, occupied the subject property or-has otherwise used the subject property as a primary residence. Any affidavit or representation to the contrary is misleading. 2. The existence of two bed and breakfasts would be destructive to privacy, welfare and the comfort of a micro neighborhood of six homes. 3. The granting of the subject application will have a clear and significant negative effect on the property values on Windward Road. Prospective purchasers would either discount or avoid a property bordered by B&Bs. ; 4. The Windward residents are responsible for the maintenance and insurance of the private road. It is inappropriate for Applicant to financially benefit therefrom and expose the Windward residents to added depreciation and liability. 5. The granting of the application will be an invitation for the public to enter private property and may have a negative effect on the safety and security of the Windward residents. 6. Most importantly, Applicant is a repeat offender of the Southold Transient Rental Law ("TRL")with a long history of abusive rental practices. The Town previously attempted enforcement of the TRL against Applicant(see Attachment B). Applicant repeatedly violated,the TRL following and during attempted enforcement. The Town sued Applicant attempting to implement a TRO (see Attachment C). Applicant continued to violate the TRL even after the Town's legal action against him: A contempt of court count is now pending against Applicant in New York State Court (see Attachment D). Applicant's extensive defiance of the Town Code should preclude Applicant from a special exception permit due to Applicant's well established history of abuse. The granting of Applicant's request will signal an abrupt end to the,Town's efforts to have a meaningful transient rental law. No doubt this news will spread. The considerable efforts of the Town Board and the Town Attorney will have been largely wasted upon the next newspaper headline. One of six houses on Windward Road in Orient,its owners are now seeking a new way to rent out their property in light of Southold Town's new short-term rental law:becoming a bed and breakfast. Last Thursday,nine months after that law was adopted — and just weeks before the busy summer season gets underway— this property owner and three other short-term landlords appeared before the town's Zoning Board of Appeals for public hearings on four separate applications.Two of the homeowners are seeking to turn their houses into bed and breakfasts.The other two are seeking an interpretation of the town code that would permit their rental operations to continue as a non-conforming use, allowing them— and other"grandfathered" short-term landlords — to rent for less than the minimum 14 nights. common thread among the four applicants is that they are all seeking a way to,keep their existing rental properties viable. James O'Hagan, owner of the rental property,is requesting approval to operate the house as a four-bedroom B&B. His wife, Renee Murray,appeared on his behalf at last week's ZBA meeting, saying recent changes in their professional lives have made it possible for them to make Orient their full-time home and they intend to operate it as a legitimate bed and breakfast. Ms. Fleischman said that during 2015, she rented out a room in her home on Airbnb every weekend except one from mid-May to mid- September.Since the current law took effect last November,she has not booked a single rental, she said in an interview following the hearing. ! A licensed clinical social worker who also operates a therapy business out of her home,Ms.Fleischman said she's always lived on the property full-time. She said she began renting out her daughter's former room once she left for college and uses the supplemental income to help pay her taxes. "I was born and raised here and don't want to do anything to bring the area down," she said in an interview. "I had no complaints from anyone last summer." Still, the town has received five letters from residents on her block objecting to her application for the special exception.One of her neighbors,Gerard Schultheis,also spoke at the hearing.He questioned whether the town code allows for a bed and breakfast and an office in the same residence,among other concerns over COs on the property.Ms.Fleischman said the,town building department has since assured her she could operate both a bed and breakfast and her therapy practice from her home.
